i just found the club application form that i thought i had submitted, so i have to submit asap. who is interested in this one? whole weekend? saturday only? sunday only? i come back from holiday on that friday, so might not be able to do the whole weekend myself, but can definitely do one of them.

Steven, obviously, we are all sorry that you have had such a bad experience with a trader. For his own reasons, Garry has declined to comment on the thread thus far, whether we think that is good or bad, that's his prerogative and we have to respect that position. Although we do our best to protect members, traders are also paid up members, who have paid extra to have an advertising presence and access to the ready made market available. In may cases, traders are members that have decided to try and help the club by providing a service. But it is unfortunate that there will always be a customer of any trader that has a bad experience, whether on here, out in the world, wherever. No trader will ever escape this fate, no matter good they are. As an internet based publishing medium, we also have to be mindful of any relevant publishing laws regarding libel, etc. In which case, we may need to moderate or clean up any posts that we feel might impinge those laws This is not us "protecting the trader", or "taking sides" in any way. This is us performing a necessary legal obligation. So please do not think we are acting on you personally in any way if this happens. This also applies to any member who finds their post has been moderated. Unfortunately, many of these type of threads turn into a witch hunt, where we may lose members, traders, reputation, without ever establishing the full facts of the matter. In this case there are a number of disgruntled customers, but also many happy customers that have not posted, as often happens on these types of thread. There are still a few things that are unclear to me here, so if possible, would you be able to elaborate? I am not trying to discredit anyone, or take sides, i just want to be sure that all of the details are available for people to form an opinion from. I always assume 3 sides to every story: 1 for each concerned, and the neutral one between them. Regarding the sourcing of the car: Did Garry find the car, advertise details, and you followed up on it? Did you ask Garry to specifically find a car for you with certain criteria? Did you find the car listed, and approach Garry about bidding and importing on your behalf? Regarding details of the car: Did you have all of the same information as Garry, regarding description, pictures, etc before you decided to bid? If Garry had someone local providing information, did you receive the same information back? Did yourself and Garry discuss any of the description and detail, and did either advise caution? Regarding price: I think the price of the car and the price for the import are 2 separate things. Although they add up to a considerable amount, they are separate. This is especially important if you located the car and asked Garry to import on your behalf, rather than buying a car advertised by him. Regarding the garage service: This is where i can see there is a definite problem for all parties. If they have told Garry and yourself that work has been done that has not been done, then unless Garry knew this was the case, you have both been misled equally. If Garry had sourced the car completely, then all of the interaction with the garage should be by him, and any remdial work should have been at his cost before selling it on. If Garry had sourced the car completely, then i would not have expected him to even want to sell it in that condition. This is where you would have legal rights to refund based on the sale of goods, because in law he would be classed as a trader based on previous activities, even if not declared. If you sourced the car and he bidded on and imported it on your behalf, before passing it to his regular garage for "conversion to uk" work, then that is where the problem starts to appear. At this point it is your car, not his car, regardless of the actual condition that it came in as. Any problems with the car, work needing to be done, etc, is down to you. As you were not happy with the garage, then you had every right to take it elsewhere. If other people have experienced problems with cars supplied wholly by Garry, with work from that garage not being as described by Garry, it might be that he is unaware that they are not providing the service to him that they claim? My view: If you had asked him to source the car for you based on a specification, or if you have asked him to get local inspection for you, and if he has then supplied misleading or incorrect information as to the condition knowing the true condition, then you may also have grounds for legal complaint. If he has recommended the car in any way, then again that may be cause for recourse. In this case, as a club, we would also be unhappy with his actions and have to consider how to handle that. If he has been completely impartial, or even advised against bidding, based on the description, pictures, and any local information provided, then you and he have had the same amount of information to make a decision on, and presumably it was your decision to make a bid. If i had asked someone to find me a car, or provide information or recommendation that proved to be bogus, i would be as upset and annoyed as you are too. But if i had located the car and made the decision myself, based on everyone involved having the same information about the car, then i would have to accept some responsibility for that. Even though i might have been relying on the experience of the importer to help me out, you can only use the information available. Hopefully you can see from this big ramble that i am not showing any bias, just stating that without ALL of the facts, there is no clear cut way for anyone to identify clear fault or resolution, and the exact detail and position would need to be clarified for a successful legal challenge if you went that way. We always prefer to give the benefit of any doubt to any party, until that doubt is gone. Please message myself or any of the committee guys if you want to discuss this with us.

Weekend Trip to France.
Nice weekend away! I just got back from a 9 day bike tour down through France, Route Napolean up into Italy, Switzerland and back through France Sunday. Eurotunnel port was delayed and very busy Sunday afternoon. I presume the ferry port was fine then? Would like to organise a club tour next year back through some of the mountain passes that we did on the bike.

very sad to hear. regardless of registered business or not, i think you will find he has sold enough cars to be classed as a trader, and therefore you should be able to use the sale of goods guidelines to get your money back or pursue legally. as a club, we do our best to attract good traders, but no trader can be 100% for every person every time. it is a problem for the club, as registered traders should be considered as trusted, but the only real answer is NOT to have traders listed.
