  1. I am not condoning the companies business practicies. Certainly they could have dealt with the situation better. The best policy was definately to get a refund a take your business elsewhere. It's just not worth the hassle and they don't deserve the business. It is certainly true that a companies terms and conditions do not automatically state law. However, terms and conditions can be legally binding - the whole point of having them. In this case my answer is based on case law - not this particular companies terms and conditions. I have cited the Argos case which relates to a pricing mistake on their website for which customers had ordered and paid for. Argos were not bound to deliver the goods.
  2. This problem relates to contract law not the sale of goods act. The question posed is what constitutes an offer and acceptance. "An electronic confirmation of an order may be no more than this, i.e., it may not constitute an acceptance of an order but serve only to identify and warn customers of orders placed unintentionally" Site provider's terms and conditions normally spell out precisely what action will constitute acceptance. For example, terms and conditions may specify that acceptance will not occur, and a contract will not be formed, until the goods are dispatched (Argos incident, Aug 2005). It follows that the retailer can withdraw the advertisement prior to the dispatch of the goods - regardless of whether payment had been made or not.
  3. A guy stopped outside my house a month or so back. Said he'd bought a yellow zed for £80 which was generally complete but missing some engine parts, lights etc. He was asking about sourcing parts with the view of getting it running. Wonder if it's the same one - if it is he's obviously given up.

  5. As I say it all depends on the terms and conditions of the website. They may legitimately claim that an order is not accepted until the goods are despatched.

  9. 19,660 miles - not even a contender to the crown :rofl: In all seriousness though thats a lovely car. Rare to see a UK series 2 manual, never mind one as clean as that. I notice it has a Reynolds sticker on it. There used to be a Reynolds Nissan dealer in Southport so maybe it orginated from these sunny shores.

  13. Pretty much The tension rod bushes have gone, a shock is leaking, very slight oil leak and needs a new air con condensor. But its very very clean underneath and Jeff reckons the brakes are the best he's seen.

  16. Went to Zedworld today for a conzult/health check. Just to add my recommendation (to the many) to anyone needing work done its worth the trip. Great set up, facilites and knowledgeable staff.

  18. It's looking really good with the work you've done to it. Always was a great car - but with the 99 spec bits and other bits and bobs its even better. One of the best standard-ish cars around. I've been doing a bit of work to the Black Brunei car as its now on the road. Aftermarket stereo, air con controller and turbo timer have been removed. Original climate controls re-instated. Off to Zedworld for a health check - week on sat. Drives really well though - as you know ;)
  19. Looks great. Exhaust suits it - standard style with a bit more get up and go. Can't be much left to do now.

  21. Glad your enjoying it Richard. It never let me down - if I hadn't bought this other one I'd gladly have kept it. Have you finished the work you wanted to do on it?

  23. It is not easy. You would need to get a professional to remove and refit into the new tailgate. The window's are bonded in and must be cut out.
