It is an EU requirement. It's a bit of a grey area if they're factory-fitted like that, but you might be in trouble with aftermarket ones.

Do you think there's anything to be said for paint correction where the clear coat is beginning to peel in areas, or would that be too far gone?

Nothing done as such but I think I've located the leak. The spoiler clip pictured below has been dripping (middle of the picture). I suppose the first thing to try is some silicone around the base of the spoiler. Could also do with replacing that rusty retaining clip from the trim but I assume that's not available on its own?
