Well as many of you know some donut hit my car. We are bith insured with admiral (I knew this was going to be a problem) now they have come out and saidthe damage I claim he has caused was already there!!!!! They offered me a £300 settoement before VAT. Ummmm NO!! I am well and truely fed up with thus. 28 days ago I put my car up for sale(for financial reasons) and a few days later the tit hit my car putting the sale on hold and it then starts costine me money. I have the listing on gumtree which is about to expire. With all relevant photos with NO DAMAGE! Because there wasn't any. I've offered to show them this and they said it doesn't matter about that. So I demanded a ln assesor to come out and inspect the car because they say they can see rust on the rear panel below the light from a photo! Un fooking beliveable!! Any ideas on how I can argue my case (with my for my own insurance company , against my iwn insurance company)?? Winter is not a good time to sell a zed and the worse this weather gets the harder it will be for me to sell up. Ive had over 40 people get in touch about buying the car and had to turn them all away. Fed up to the limits and to top it all off I got underpaid for 52 hours work from work and I get paid on the 21st of December. Low and behold im working from the 19th till xmas day so I've sod all cash to do xmas shopping unless I sell my car. Oh wait. I can't!!! I must have been a murdering rapist terrorist in my past life and I'm paying for it now

 

When I was 16 u held a cbt and drove a scooter (fully legal) for 12 months. At 17 I went up to a 125cc (fully legal) until the 10th march 2008 when my cbt and insurance ran out. My driving test was the 12th march 2 days later. I drove my scooter uninsured ended uo going through the rear window of a golf. (My fault and daft and naive and I was an idiot. That accident has cost me close to £16000 yes thats £16000!! I was only 17 for gods sake. Today I paid my last payment after getting sued for injuries to the driver ( I was doing 25 mph on a 125cc scooter) the only one who got injured was me. 40 stitches to my neck and throat.

 

The point im making is. You drive uninsured and you get hammered. You get insured and it still costs a fortune but you get called a lier and it still costs a fortune. Insurance companies or politicians.... I'm not sure which one ****s me off more!

 

Sorry for the rant but what a shite year I'm having. Father having 2 strokes. Lost my job (im self employed now) getting sued, car gets crashed into at the single worst time of the year., underpaid from work just before xmas.

****ing insurance companies. Did you send them the same photo's you showed us, becuase there is no Rust showing on those pics in the damaged areas.

 

Have they agreed to send assessor? There is the Insurance ombudsman route to take, I dont know much about it though.

Yeah I have the pictures on my phone still. However they were only taken 24 hours before the insurance company had their photos done by the bodyshop. 24 hour rust eh??

Life has a way of dropping shit on you from time to time; but sometimes it can be just the opposite. Look on the bright side, 2013 is almost over - so good luck in getting things sorted and here's to 2014 being a better year all round:clover:

Sounds a nightmare Adam, are the pictures you have taken time dated on either your phone of camera, if so then i would think you have a case to take against the insurer via the ombudsman.

 

An assessor should be able to look at both vehicles and detemine the "hit" areas and if they match furthering the case, if there was contact and thereby fault.

 

I hope you get something sorted Mate and by the way enjoy Xmas with the old man, that's worth celebrating at least.

Cheers for the kind words guys. You won't belive this but I've just spoken to my dad who had an appointment with a consultant today about having a new hip. It appears his pelvis has badly crumbled and he will be spending his days in a wheelchair as of next year by the looks of thinks. He's just had an application for a new house with my mum accepted after waiting months which he will now have to withdraw. Cannot wait to get this day over with.

I had a similar situation many years ago when the " head of transport " for a large company pulled straight across me and caused a collision , 100 percent his fault . i started getting really shitty letters of his company soliciters trying to tell me it was all my fault , so i basically told them to keep there fooking noses out as it was a matter of my and his insurance companys to deal with .

His insurer then started writing to me saying i was at fault hoping i,d back down ! .... wrong

I copied down three A4 pages full of quoted paragraphs about how to approach junctions and turnings and after each quote put " your client obviously didn,t do this " after each quote and sent this to his insurer , i finished off by saying they,d best get this sorted out quickly or i,d be taking it to the next level and suing them for the stress they were causing me .

Got a cheque through within a couple of weeks !! Result . :thumbup1:

Or the RAC - both have a free legal assistance service for members....

 

.....Failing that, what about legal cover on your house insurance? Not to mention the (so called) legal protection you pay for with your car insurance; I know it's still with Admiral, but they sold you the policy so they have to stand by what you paid for and honour the legal expenses if you chose to bring the matter to court!!

Well here's an update that I promised, the assessor came out. Said my damage was unrelated and it was already there. They have offered me £400 excluding VAT. I've said that's not enough and that I would like a review from you up line management. Today they call me back and say they're sticking to the £400 and the only way they will review it again is if I pay for another independent assessor to come out and send them his findings. That's going to cost me more money!! It's not like I'm filing a claim for thousands of pounds and claiming whiplash injuries. I said I'd settle for £800 and that I would get the repairs done in my own time using the money. Still a big fat no from the big fat insurance company. Anyways I've called the insurance ombudsman now and filed a complaint and they're getting in touch with admiral for me. To say I'm fuming is an understatement. I will not be getting re insured with such a fooking poor company, because as far as I'm concerned being insured with admiral is the same as not being insured at all. JOKERS!!!

I would go with a company like Heritage next time buddy, you can send them photos each year to prove the condition of yr car and get an agreed valuation certificate so if the car gets written off theres no argument as to the value.

You have recent pics from the guy you bought it off, i would write a letter to admiral enclose the photos showing no damage and tell them you are prepared to go to Watchdog, ombudsman etc. They may cave if they see you are serious. Also tell them you have sent a copy to your solicitor and are taking legal advice too.

I've sent them photos of the car taken 10days before the accident. They have offered me a payout of £400 which I've said isn't enough. That wouldn't cover the work and sure as hell wouldn't get me a courtesy car while the work is being done. I'll bear in mind heritage Ian thanks for that. Will have a nose on their website now. I'm with admiral. I must admit they are good at getting money off other people, but even better at saving their own money. When I got rear ended they arranged a bodyshop of my own choice and a similar but better courtesy car. ( celica gt instead of my tsport) but obviously the person who hit me was with a different company. Use of a courtesy car is an added extra on your policy. Incidentally, they also charge for windscreen repairs. They know how to claw their money back.

I was offered a courtesy car (1.2 corsa or a 1.2 fiesta) but this was before they said they wouldn't repair all the damage. I always tend to get the extras with insurance but I will certainly not be re insuring with Admiral, cheap prices cheap service. I'm paying silly money compared to most insuring the zed. The cost of the repairs isn't anywhere near the cost of my insurance policy, not that it should matter.

If you go straight to the FOS, they take down brief details of the case and send a notification to the company giving the brief details. The company should then acknowledge the complaint within 5 working days and issue a final decision. If you then remain unhappy you can approach then aproach FOS for them to review the case (you should go to the FOS within 6 months of the companies final decision).

 

An adjudicator (your FOS case handler) will then ask both you and the company for all of their evidence etc. the adjudicator will then make a decision on how he/she sees then case. If either party are unhappy with the adjudicators decision, they can request the case be reviewed by an actual ombudsman (although its rare they change the adjudicators decision but it does happen).

 

Let me know if you need any help. I would suggest getting screenshots showing the time stamps the photos were taken (especially those taken 10 days before the incident). I guess The problem with rust it that it could have been underlying before the accident.

Spot on! That's word for word what I've been told, the complaints procedure has been issued and I'm waiting for a reply. This all seems a bit ridiculous for the sake of £300. They've offered £400 and I'm asking for £700. I hear this is quite a common theme with admiral.
