I was coming down the M1 on Thursday in the middle lane just about to pass a recycling container truck on the insdide lane. Next thing I know some shit flies off the back of the container and hits the front of my car. I pull over, see the damage, then chase after him to pull hum over. I show him the damage and he says sorry, don't worry it will be sorted, so he writes down the name and number of his manager and said just phone him and explain what happened, so I thought no problem I'll do that. I ring the guy and he says he'll have to speak to his driver and assures me I won't be fobbed off. I rang him about 3 times that day and he keeps telling me he can't contact his driver. So Friday morning I call again. He tells me as far as the driver is concerned he didn't do any damage and as there is no evidence or witnesses, it's my word against his. I asked him why his driver didn't say that at the time and why he gave me his details, for which he says - no idea! I asked if we could arrange to meet and sort this out witht he driver and I was told no the driver is busy. After going round in circles he ended up by saying "I'll see you in court the" - fucking wanker!!!!

 

I ring my insurance to tell them what's happened and they tell me there's nothing they can do as there is no witnesses and it's my word against his - great!!!! Then they inform me that my excess on my insurance went up to £900 on my renewal and really pissed me off as they never told me that when they gave me the new quote (teaches me right for not looking at the paperwork that came through the post afterwards more closely)

 

I can't believe that you'de have to get the other person in an incedent to sign the fact that it was there fault. I all ways thought that if someone handed over their details that that was and admition of fault but that's not the case.

 

I've been told that the only way is to try and take them to court and I was just wondering if this has ever happened to anyone or anyone you know.

 

I feel better now I've moaned.............no I dont!!

What will probably happen is the driver will say he didnt see anything come off his truck and hit your car, and he propbably didnt. If it goes to court it will be thrown out becuase it was your word agains his.

 

 

if you can remember where you were on the m1 at the time of the incident AND when you stopped the driver, then try contacting the local police forces to see if they picked it up on CCTV, assuming they have cameras on that stretch....

Thats a good point Craig. My sisters boyfriend had an accident on the M6 a few months ago with cameras all down it. When we asked if there was a tape of it they said no. They are just to see the flow of traffic and not recorded. Typical.

it just pisses me that the driver says sorry, don't worry it'll be sorted and gives me details, then denies it later when nothing can be proved. It just seems trust is a thing of the past and next time I'll have to make sure I get them to sign something.

a few more large chips on the front spoiler, smashed indicators and blank side light thing-a-me-jigs. Yeah, I know the driver is not the one being a wanker, it's his boss. I just think it's a lesson from everyone, if there'e no witnesses, make sure you get them to sign liability.

Just a thought for the future (tho not helpful for Vijay - sorry, guy) why not keep a camera in your car all the time? Either a disposable film or cheap digital thingy.

the problem with that is is still doesn't prove liability. You need a witness or something signed or a thing called trust!

Vijay, I think there have been a couple of good points raised, firstly report it to the boys in blue as this makes it an official enquiry or incident at least, if you suffered any sort of personal injury they would be in deep shit (leaving the sceen of an accident, unsafe load, driving without DCAA etc.) All you need for 100% certancy for this is a witness that happened to be following. Then get a friendly 'no win no fee' solicitor to take it on and go for it. And if you don't win it will cost you nothing and if you do win (remember, they might not want to go to court as it costs big style!) you would get awarded costs anyway.

Good luck dude, don't back down - go for it they will think you won't or can't be arsed with the hassle.

Easy - not all lorry drivers are gorillas. The lorry driver in question probably would have sorted it - it will be the money-pinching manager who has concocted this story as he is the one that would have to fork out for the damage, not the employee of the company.

 

 

Very sorry to hear about this Vijay M8. There really are some gits out there. You would think that because the bloke exchanged details it would prove something occured. Report it to the police M8. At a minimum they will have to go and question the other bloke about the accident. As Mark said they probably think you can't be arsed with the hassle. They should not be able to just walk a way from it, bastards!!.

As Ajay says, it's probably not the driver but the wanky manager. I did get the reg, drivers name and he gave me his managers name and number. Gonna go to the c.a.b tomorrow and see what they say.
