I'm not sure how many of you know about the zed that I bought last October but here goes anyway.

 

I bought my car from a trader in Bedford on an 93' plate with 53000 miles (when converted). The car began to cause me problems on the way back home so i got back and made enquiries as to what it could be. After some research it was established that the tubs had gone....great.

 

I then requested the money back from the trader which he refused. Actually he refused to help at all saying he knew his rights.

 

Deciding I needed to take things further I had the car fully inspected by Jeff at Zedworld. We discovered problems with the suspension and HICAS that would have constituted an MOT failure....and it was sold with MOT!

 

As the work wasn't too expensive and I am definately naive with regards to legal matters I endeavoured to get the work done privately and pay myself.

 

Today.....Mark from turbosport calls me (he was in the process of putting my new tubs on) and says that there is no compression in one side of the engine ie. piston damage, cracks and possible melting! He is going to take the head off and but reckons between £800 and £2000 is realistic just for the rebuild then the turbos will be on top £1500...then I have to pay Jeff for the suspension work.........

 

Basically I will end up paying nearly £9000 for this car....HELP!

 

I really really wanted a Zed and thought I'd made the right choice with this car.

 

I have driven approximately 250miles in it.

 

So...in tears as I will be shortly do I...

 

Pay for the repairs

Proceed legally (I have a reciept for the car and Jeffs reports)

Scrap the car :x:

 

Sorry to drone on I'm just so gutted it hurts.

if the car was sold by a trader you have more rights then if you bought the car privately.

the trader has certain obligations when selling a vehicle. especially if it was sold with a full mot and on later inspection was found to be defective. you can report them to the mot inspectorate as they are falsifying documants to sell unroadworthy vehicles.

have a quiet word in the guys ear saying that you have the rights not him and you CAN GET HIM PROSICUTED!

 

If you have not joy with the cock get him prosicuted

Yes, you've got to take on the trader, in the civil courts if necessary.

I'm pretty sure the law will be on your side - the car was not 'fit for purpose'.

He may have blustered but he's in the wrong.

 

Sorry to hear your story too - gutting! Hope you get it worked out whatever you decide to do.

the car was not fit for the purpose it was intended for and was sold to you under fraudulent means. as such you need to have the car put back together as original, no new parts added keep it old. also get full reports from all who have looked at it. goto a solicitor and get him to get in touch with the trader, also contact trading standards as they will be very interested, you will also need to contact the department of transport as they will be very very interested as to how this car got an mot in the first place!!

 

now you could ring this trader and explain to him what you intend to do, but i would see a solicitor first, it shouldnt cost you anything to get advice and do not touch the car in the mean time until the vehicle people have looked at it as im sure they will want to..

 

this trader is gonna crap himself when these letters start arriving and they get spot checks from the dept of motor vehicles..

 

get your cash back and get one from here..

then go to the guy that sold it to you...and.......burn the soles of his feet with a hot crack pipe...hehehe..

Gutted for you mate, my immediate reaction would be to go back to where u bought the car and kick seven bells of s**t out of them, however this wouldn't stand you in good stead when it comes to legal proceedings. However I would definately take this one further, there are some good legal boffins on here so hopefully they can talk u through your best actions to take. I'd also visit citizens advice / a solicitors for some advice. I definately wouln't let them get away wiyh that one though, misleading discription on goods (MOT) etc etc. Really hope this one gets sorted out ok.

By law you would get 3 months warranty. The car also has to be fit for the purpose for which it was sold, i.e in a driveable roadworthy state. If the advert also states that the car was in excellent condition then he is also guilty of misrepresentation. Further to that, if he knowingly did not disclose faults on the car then he is further in the poop so to speak. I went all through this with a solicitor some time ago so know loads about it.

 

Take legal advice, get the soliticor to send him a letter and proceed fully. Ask your solicitor to ensure that he reclaims all costs from him and let him know that is how you are proceeding. He will then, if he has a shred of sense, give you your money back. If not...then take him to the fookin cleaners...

Thanks guys looks like I'll have to take the w***er to court then. No new parts have been added yet apart from my refurbed tubs he was about to fit.

 

I'm so wounded by all this hassle...all I wanted was one of these powerful beauties on my driveway!

if you can get it in writing that the vehicle is unroadworthy surly the mot inspectorate would be very interested in the traders mot testing policies!

Not sure that I can. My warranty was valid for 3 months, although the problem did occur after a month (blew dipstick out)....which was the tell tail to my bore problems

if you can't then I can't...I never even got a warranty with mine.

 

There are some sick individuals out there selling these cars to innocent people. i haven't got it in my heart to rip people off and feel really robbed and genuinely upset by it all.

do as advised and get full reports, speak to solicitor, dept of motor vehicles, trading standards. get them to come inspect it and then send letters of intent to take to court if not satisfied out of court, also add a notice of intended action this will state a date as to which you intend to further proceedings.

you know what they say

Any 'warranty' with a used car in IN ADDITION to your consumer rights.

 

The car was sold as running and roadworthy and should have remained like that for a reasonable amount of time.

 

You should be entitled to your money back or even money towards the cost of putting it right.

 

A small claims court can be one way to do this - I think you can only claim £3000 so it might not be enough but you can download all the forms from the net and do it yourself with a one off fee of about £60 (IIRC!).

 

I'd call a solicitor and see what they say - they'll only take it on if they think you have a case and will win. CAB are worth a call too. It probably all seems a lot pof ahssle when all you want is a nice car - but it could save you thousands of pounds and that's well worth doing (unles you're LOADED lol).

If I was loaded I would have bought a mint Zed for £9000 in the first place LOL!!!!!!

 

In fact I would have had that sweet motor with the red leather interior and wide arches!!

If you get no joy legally , hire a couple of heavy,s to take the car back for you and i,m sure he,ll reimburse the money then :x:

i miss that car and I only had it for 250 miles of turbo'd joy.

 

Got to get this sorted and get a nice one..was looking forward to the meets and social aspect of Zed ownership...
