Hi All... Your help is required...

 

A member of the SXOC has been jailed for 5 Years for Death by Dangerous Driving. Please Read the post linked and see what you think... I personally think what a complete farce!

From what i can surmise a) He did not cause the accident b) should not have been advised to plead guilty c) did not force the driver of the fiesta to drive like an idiot... If there was one thing i can blame him for that would be having the compassion to stop and help...

 

In no way do i advocate street racing... But to be honest i have had a blast against other cars and i am sure that most of you have. This is a real matter that has wrongly imprisoned a young bloke for 5 years of his life for the poor judgement and ability of another... This could happen to any of us really... :(

Signed this the other day after seeing it on UJCC. Completely agree with you. There's no way the fiesta would have been a match for the nissan and the fact that the fiesta was ahead of the nissan when it crashed proves it for me. EVERYONE should sign this.

the argument of the cars werent match to race won't hold in court, he should not have plead guilty, does anyone know if he can get a retrial when he has admitted to it?

 

he didn't make the fiesta go fast or push it off the road so I can't see why he was advised to plead guilty

sory mate, gona sit out on this as I have no way of knowing if he was or wasnt responcible. need a little more info than what was in the thread to jump to a conclusion.

there has to be more to this than meets the eye... first off, how do you actually prove they were racing? All he has to say was this fiesta shot past me at doing a crazy speed and it crashed, unless there is video eveidence to support otherwise. yes he should be banned for or given points for doing 90 when the road conditions obviously werent suitable or done for dangerous driving or something, however he wasnt the one who made the other guy go fast. The other guy chose to drive quick and it was his allegend poor driving which looks to have caused the crash, but we dont know the full details so we can only speculate.

Is this a case of the " i'm a victim.. i'm the innocent one" , you know like when someone stuffs their car its never their fault its always cos there diesel on the road...

 

for the guy to get sent down then there must have been some pretty good evidence indicating that he was directly reponsible for the crash.

from what ive read he was blamed for encouraging Mr Hughes to drive faster??

he also had witnesses in his car??

as Scoops says there must have been more than his guilty plea?

he deffo can't withdraw the guitly plea, unless he has new evidence or was coerced into making it??

as Mike says the argument whether the fiesta was a match for the nissan is pointless, especially as the fiesta WAS IN FRONT, and i assume he has pleaded guilty to doing 100 on a 40mph road??

 

i won't attempt to act as judge and jury on the bare facts posted, but also would like to hear what ACTUALLY HAPPENED,

at the end of the day 2 have lost their lives and this guys life is ruined by a jail sentence:(

i think that if your on a roads with twists etc small cars can keep with slightly more powerful,you would be surprised,im running aprox 350hp and have had ****y pevgeots golfs etc keep in my mirror round bends etc,on straights its bye bye but you see what im saying

 

im with some of the others wasnt there so dont know what happened,feel for your mate though,and the 2 dead people regardless of them being chavs there humaun beings,your friend certainly didnt do the right thing changing his plea :rolleyes:

To take any advice to pleed guilty when you know you aint guilty is foolish. To get a reduced sentence for something you didnt do is no better than getting a long one? If you aint guilty then you should recieve no sentence. :smash:

 

Plee bargaining is the laws way of tiding up loose ends.

Obviously this guy has been made an example of, he admitted the charges and by the post I've just read it states that the Nissan was doing 90mph in appallingly wet conditions and from the newspaper cutting I've also read it was also dark, the Fiesta seems to be doing a simlar thing.

 

We've all taken the big risk with our cars and I think we all know the consequences, The guy with the Nissan has had a bit of bad luck and if his case is as strong as you say he could successfuly appeal against the sentance. The guys in the fiesta are dead and they will stay dead! No appeal...just dead.

Heres my take on the situation, i lived in Stoke for six years, right near Festival park:

 

1- I know how bad the A500 is, it twists all over the place and is covered with slip lanes that have inadiquate distance, it is also extremely busy, if he was driving at 90 down that road then he is an absolute plank.

 

2- Some of the night coppers in Stoke are from Stafford, and they practically wear nazi insignias, they are some of the worst, most millitaristic coppers in the country, ive been stopped and given multiple producers for the heinous crime of 'looking young', ive also been dragged out of my car at 4 in the morning and told 'that i shouldn't be driving at that time', when I questioned this I was threatened with a speeding ticket (I wasn't even remotely speeding at the time)- that lot of coppers would have no problem with sending down someone just cos they don't like the look of them and they'd bend the rules to do it.

 

3- That road is absolutely covered with cameras, as is all of the surrounding area, chances are the police had plenty of video evidence that didn't help his case.

 

4- That is an absolute travesty of justice, whether he was racing or not is irrelevant, when the judge says:

"The plain and simple fact is that, had you not chosen to race him, he would not have driven as he did. I'm afraid that racing is a feature of high culpability in this case."

he is talking out of his arse, the fiesta driver was so reckless and stupid that with a dodgy back tyre and people in the car, he tried to race a 200sx. He almost certainly would have driven that stupidly anyway, if he hadn't killed himself that night, it would have been the next. The deaths in the fiesta are the responsibility of the fiesta driver.

 

5- The courts in that area are terrible as well, I saw a man get a suspended sentence for getting beaten up by two coppers. He thought someone trying to wake him up was assaulting him and he called to the cops for help, instead of helping they proceeded to beat him black and blue. They even said that they struck him 3 times on the back of the leg, the photographic evidence of his beating said otherwise. I thought it was open and shut- I was gobsmacked when the victim was the one who got punished.

I,ve had a metro do something similar to me but not with these consequences.... i was just takin a breeze round with the odd blip here and there next thing i come up behind a metro with three chavs in it. All of a sudden unknown to me the driver thinks he,s in the fookin street race world cup as you all know a stock zed i perfecly capable of goin round twists and turns at relativly low speeds up to about 60mph with ease but a poxy metro isnt so i guess i baited him slightly by stretchin her legs a bit when we approached a roundabout as i watched the metro tottally out of control at about 40mph with the kid in the back seat gettin flung around i thought these guys are willin to risk their lives to try and beat a car they have absolutely no chance of beating. At this point i did a round the roundabout u turn and fooked off thinkin what twats. Not more than 2 mins later guess who turns up, this poxy metro and the chavs so i just lanched the motor away and went home. I have read what has been posted by s.x.o.c and like was said before something is not quite right i would plead guilty to speedin but thats about all you,d get from me and if they gave me 5 years for speedin i would appeal. :confused:

I know this is a fairly serious matter. Well for that bloke it deffo is? But if you drive your ZED within the (enjoyment range). Not too fast but not that slow either? Then anyone in any normal car will have to thrash or race their car to keep up? Now if they actually got that far and overtook you, crahsed and died, just as a police car was coming around the corner and saw the tail end of the situation? You will be going to prison. (if all that was said in that case is true of course)

i dont know all the facts, however, his solicitor would have advised him to plead guilty, so there must have been some compelling evidence to sujest they were in fact racing, if what was said on that site was true, a solicitor wouldnt advice that. need to know more info to call that.

Causing death by reckless driving - "A person who causes the death of another person by driving a motor vehicle on a road recklessly is guilty of an offence." On the one sided facts given by the accused it seems quite cut and dried.

However without the full facts how can we make a true judgement.

yet some tosspot immigrant with no insurance in an unroadworthy car, mows down a teenager,throws her 30ft into the air on a pedestrian crossing, kills her and he does a runner -

 

 

18 MONTHS HE GOT AND HE'LL ONLY SERVE 9 OF THEM !!!!!!

i was involved in a very similar event and the 3 lads in the other car all died....i will not try and make myself whiter than white and say i wsnt racing as i was. what i did do though was stop for lights that were on red which they didnt and a 30 ton truck crossed right in front of them...at this point when it hit i knew they were gonna's did i stop did i **** as i knew what the end result would have been and still to this day i get people calling me a ****er for it.....why did he stop and why did he plead guilty if as he says he wasnt.....had he been at the cruise at festival park as i know what its like coming back from there as ive done it many times and the fact he was speeding himself does him no favours........he has been made an example of which is wrong but you are not telling me he hadnt been having a play on that stretch of road be it with the fiesta or not and its unlucky that he was caught but if you are not guilty of something and you know it you wouldnt change your plea no matter what mitigation comes afterwards to get a lighter sentence if you were certain you didnt do it because you would just appeal it afterwards

The natural reaction would be to stop of you saw something like that happen surely. :confused:

Again there are only part of the facts and we can't make a true decision based on that alone.

not a chance at the speed they were going and i knew no matter what id said had i stayed i would have been blamed......i will also give you another example of why as in another race i was involved in as i came to a bend i knew was tight i slowed down meanwhile the guy in the other car saw this as his chance to get by which he did only to hit a girl crossing the road he hit her at 75mph and both of them ended in hospital over 6months bear in mind i had 2 people in my car and 3 cars following me all friends again i never stopped for this incident and sure enough in the papers over the ensuing weeks i was painted out to be some road rager who had forced the poor unfortunate other driver to swerve......the guy who hit her is now married to her and i wonder how he sleeps knowing that but remember this i didnt make him swerve as i was 400yrds behind him as he hit her yet had i stopped as i had been racing i would still have been implicated.....without knowing every fact you can never know what had gone on and in the case of the guy in the 200 i know what im thinking and i say he was foolish to even stay
