Monday I was coming back from taking my girlfriend and her sister out for lunch and decided to take a different route back to their house to drop her sister and her kiddy off! Wish I had gone the A55 way instead but I wanted to drive past my old house...big mistake!

 

Basically I was munching along in the 5 Tubby on a national speed limit stretch of road and was about to turn right towards my old village when this blue Vectra pulled out from a side turning in front of me. I slammed on the stoppers whilst we all said "What an idiot!" as he'd nearly made me do an emergency stop when the "P O L I C E" sign illuminated in his rear window and an arm appeared outta the drivers side window gesturing me to pull into a layby behind him...oh f\/ck-a-rama! :(

 

So I'm thinking "Eh? WTF have I done wrong??" so the copper gets out and comes over to me motor and says "Can I have a word with you about your speed please sir?" and shows me the laser cannon with 73 on it.

 

So what's happened is he's clocked me doing 73mph at 233 metres away and reckons I've done that speed where the 60 limit breaks into a 40.

 

But when I drove along that road that night and saw where the 40mph signs are it got me thinking that 233 metres away from where he was sat in his unmarked seems like a hell of a long way to me.

 

Is it worth me going to see a brief as I think it would be worth checking to see if he's actually got me before the 40mph signs where I was still in the national speed limit section of road which would mean that I was only 13mph over the limit??

Tim I know a traffic cop I will ask him for you,for your sake I hope it was before the 40mph limit as 33 over the limit is a ban:(

His Vehicle has to be so far away from the speed change.

 

for example a speed camera cant be put within 40metres of a national limit to a sudden change ie 40 zone then the speed camera it has to give you chance to slow down. How far was he from the speed change?

 

could you see him or was he spying? seriously hes not allowed to spy on you and trick you. Its classed as setting you up.

check the way he pulled you over scour every legal police information everywhere...

 

he has to do everything to the book or its dropped simple as it doesnt sound like he dealt with you in the most serious way? was it dark and dodgy where he pulled you over.

 

reason I ask all this is because anyone can buy a vectra with a blue flashing light and one of those digital displays that you setup to say "thank you " "goodbye" "dick head" or of course "POLICE"

 

afterall you had women in your car

 

 

plenty of women have been raped and murdered this way!

 

It sounds OTT but youve got to be otherwise the police are gonna get even more OTT with the way they pull you!

A driving ban is looked at ( automatically ) if you are doing more than 30mph faster than the posted speed limit. You can still get off, but this depends on whether the magistrate got his/her leg over/under the night before. :D :D :D

 

You're probably looking at 3-6 points for 58mph in 40 zone.

Olly wont get a ban for that,as Simax said 30mph above the limit yours was only 18.

Doesnt there have to be 2 coppers in the car? Im sure i was told that unless he has a 2nd copper to back up you were actually in the 30 zone you can get it thrown out.

I presume this is one of the new long range laser speed detectors. It ought to be able to tell the distance at which the speed was measured. If you can prove he didn't know how to use it then you may have a chance.

I dont think they need 2 people anymore if there is a video, if there is you are allowed to view it. If it has him making you take evasive action you might have him on a driving ticket.

 

Ask to see teh gun, if it not calibrated it is not legal, should have a litle sticker on it. Trouble is they tend to be as smart asses ask a lot these days.

 

You might be stuffed on when and where you were speeding, as the law clearly says "in the driving test and everything" that you are required to have slowed down to the relevant speed limit before and not after. ie doing 40mph as you cross from teh 70mph to the 40mph.

 

I would advise getting legal help on this as your going to kiss your licence bye bye otherwise

I feel gutted for ya mate. I just lost my licence for something equally as stupid. Hope u get it all sorted and yeah i would seriously suggest a brief for this one!

This quote was taken from http://www.ukgatsos.com under the use of radar guns section - although they mainly deal with gatso camera's they have info on radar gun use and plenty of links to sites that will explain the use and law regarding radar guns.

 

From the sound of it though the officer that stopped you was in an unmarked car and according to the quote above they must be in flourescent jackets and marked cars??? - well worth checking with a brief IMO!!!

I thought the NSL was 60 and not 70 unless your on a motorway or on a seperated dual carrageway with a sign saying 70. I have been in your situation a few times in the past. 107mph on the M56, 63 on a 30 zone and recently 99 on the M56. I still have my license, when your in court you have to play the yes sir no sir games. If you try and be a smart arse with them then you will get the book thrown at ye. When I done 63 in the 30, the judge gave me 3 points and £200 fine (i should of snatched her hands off) but no I dident, I became aggressive and passed some sexist remarks, you know "women cannot drive and who is she to judge me". BAD IDEA..lets just say all of a sudden my points trippled and I was £400 lighter. When i looked into it I found that I could of been banned but she let me off lightly. Everytime I get pulled over now I just act as polite as poss and agree to any endorsments they might give me. This does not help you apart from the advice when you get called up...Good Luck

Tim. The side road that he pulled out on was in the 40 limit? how far after the sign was this road? Seriously now, (think about it...) how much did you have to hit the brakes, and for how long...(speed=distance/time :() when he pulled out?

 

Can you get a map of the place from streetmap or multimap?? might be a bit better from an aerial shot?

 

Just a quick few things i can think about right now, maybe more later.

But once you check out the other's suggestions re positioning of car, visibility etc you still were speeding before the drop to 40mph - ie 73 in a 60.

 

Hopefully you'll beat it but if you can't the best you can push for would be the 13mph over the 60 limit.

OUCH ! Tough lesson - I always act soft and apologetic - you get the last laugh when they give you a milder punishment/let you off [i got off twice within a week using this ploy - both ~40MPH in 30s]. It also stops them from getting off on treating you with contempt and wielding their power.

Tim If you buy yourself a copy of Headlight or Truck and Driver and look in the classifyeds. There is a solicitor based in Hereford who specialises in getting HGV drivers off. HE generally finds a Proccedural Technicallity that the officer has not or has carried out incorrectly. The coppers hate him. I think I may have need of him to so I'll be buying my copy of Truck and driver. Maybe we could get a group deal.

That's what I said matey, that would mean I was 13mph over the national speed limit if he nabbed me before the 40 signs. ;) Therefore worthy of a fixed penalty instead of a court appearance. VASCAR needs to be calibrated don't think Laser does by the way. As I was stopped a while back by a VASCAR and they let me off with a caution as the equipment had either not been calibrated before their shift or it just wasn't working.

 

Andy, he did have the distance mate...233 metres away from the laser gun at 73mph.

Can you go back to the side road where he was parked and pace out 233 metres back towards the NSL/40 sign. It may be worth checking if the 40 speed limit has recently been introduced at that spot and if so is it legal? It's not unknown for the signs to be incorrectly placed either.
