Right I have a brick detached garage[that was built with the house]now I intend to demolish this and put a concrete sectional one in it's place, albeit a bigger one :) .

So thought I would do the right thing and inform the council using the appropriate forms-and guess what? they are trying to say I need planning permission[which though unbeleivable,don't worry me too much]and building regs!!! :confused:

WTF??-it's concrete! :xxx:

Got any ideas what to do now?

When do I need to make a Building Regulation Application?

 

You need to make a Building Regulation Application if you want to :

-Erect or extend a building.

-Alter a building in a way that could affect structural stability, fire precautions, fire escapes or disabled access.

-Underpin a building.

-Do any drainage works.

-Change the use of a building. This includes putting sleeping accommodation in a building that has not previously included it, converting a property into flats or turning a property into a public building.

Exactly why I went for concrete sectional!!-If I go for both the above I may as well Build one!!! :(

I "think" (Wife used to work in Council Planning department, but still confused me), that generally you always need Building Regulations when you extend or alter, but only need Planning permission when it meets certain criteria (like size, distance from other land/buildings..etc)

if you got questions i can ask my dad, but i'm pretty sure you need permission for any attachment to a building these days, jock may be able to answer any questions also as he is into this sort of thing also

I have done a similar conversion under Amber Valley Council, not a million miles away from yourself MantaV8. I took the forms along and had an informal meeting with a "council bod" who was surprisingly helpful!

I actually needed only building regs(for a concrete sexual type garage) and not planning. Its all to do with % of total plot and distance from house etc!

Its one of these cases when a little "bowing and scraping" might be helpful!!

You can always run down the corridor afterwards shouting "officious barstewards etc etc"

He came out twice to inspect the work!! Officious jobsworth!!!!

Iam going through the same process at the moment. I have built a concrete prefabricated garage which is sectional and free standing. The planning office came down hard so after paying them £120 and filling loads of forms, Iam just waiting for there approval.

But if you're a group of Gippos who buy a farmers field for peanuts you can build a concrete shanty town overnight and get away with it???? :confused:

 

Even if permission was denied for their permanent mobile eyesores, they still appeal and, if they build it in a nice wealthy Conservative rural area, that nice Mr Prescott rules they can stay :headvswal

dont take my word for it but on jobs i have done, i have been told that if it is built 5 metres or more from the main building. ie your house then building regs dont apply because it is classed as an out building and hence planning permission and such like dont apply, on the job i did the building inspector didnt bat an eyelid because of the 5 metre rule, and the garage was built with out a hitch!

I tried the 5 meter rule, but its also down to cubic capacity I think your allowed upto 60 cubic meters max. The thing is, my garage is on the side of my house making it closer to the public highway than the house actually is. Even though there is a high fence around my boundaries

 

The moral of the story is if you don’t get on with your neighbours, then you will have alot of paper work to contend with.

 

Work this one out then….My dad has owned his factory for 26 years, Approx 8 years ago he stopped using it as much and bought a retail outlet instead. I used it as a garage for years (10k sq foot , nice). Over the years I noticed that the neighbours fence seemed to be moving over ever so slightly (cheap trick) Well anyway five years had passed and my dad decided to visit my workshop one day and to his horror the front fence boundary had moved 2 meters onto our land and at the rear a patch of garden measuring approx 40ft by 20ft had also been lost to the neighbours. A little pissed off we decided to dismantle both fences using crow bars and the help of an old car. The police arrived an attempted to prosecute us for criminal damage. Over the next year visiting solicitors and attending court on several occasions it was brought to our attention that because the factory had not been used for the computer business which it was initially registered for, then after 6 years the land becomes anyone’s. WTF. We tried battling it out and paid over 10k in fee’s over the next year but hit a brick wall. Now the factory’s value has decreased significantly and we have lost a large portion of land. How can this be.

 

Now to prevent this happening anymore, my dad has bought loads of scrap cars and placed them round the perimeter to stop anyone else moving there boundaries. Has anyone got any advice for this ongoing situation????

Dave, I rung the guy dealing with the building regs and apparently because it is attached it is not exempt.

''Noproblem'' says I-I'll get a detached then!

''But'', the guy says you can't have more than 30 square metres.

So the upshot is I have lost about 4 square metres in total-but I don't need building regs! :D

They haven't mentioned the 3.2 mtr height yet :x: -lets see what the planning dept comes up with! :wack:

you should be ok mate-------your garage should come under"permited development", my bourough allows 30 cubic meters of biuld if its not less than 5 meters away from house,but in your case your allowed to knock down and re-biuld with new iff the original was on the exsisting plot,ie allways been there,go in the council office of planing and throw that one up there spouts and see what they say------------good luck
