I won something on ebay earlier, the buyer had added a note to the auction a few days after it had started stating the reserve was £100, but hadnt actually set a reserve on the auction. I won it today for £46 and paid straight away.

He sent me a message a few minutes later saying 'do not send money to paypal', so I replied asking which method he wanted and can he refund my paypal payment then.

Then I got another message saying 'did you read the whole auction and reserve'

 

If he didnt set up a reserve through ebay then he hasnt got a leg to stand on has he? its a legal binding contract? :angry:

Nah cos you have to pay to set a reserve and if he hasnt done so then that isnt how ebay works in my understanding. Id email him saying that he either takes your payment and sends the item or lets ebay deal with the dispute as you clearly won the item :)

It's yours Baz. He flupped up and knows it. Inform Ebay as he sounds like he's going to act up. Just keep them informed as the 'transaction' progresses.

Legally, its yours. But....If he wont send it, your better off getting a refund whilst you can and forget it. YOu could take him to a smalls claims court, but is it worth the hassle??

Contact ebay fella, legally the item is yours and he is abliged to send it.

Legaly its not yours as ebay "contracts" are more flimsy than a pancake surfboard.

 

If you wanted to go via the letter of the law the advert states there is a reserve of £100, and courts would rule in his favour.

 

Just tell paypal to refund and forget about it.

Opt for a full refund via paypal

 

Yes, you've won the item fair and square, but I very much doubt you'll ever receive it, at least you can leave him negative feedback

similar thing happened to me . i won an item for a fraction of its true value and was well chuffed . sent the money off straight away only to get an email back saying i,d had a refund as the seller couldnt find the item .

At least get a refrund now whilst he is offering it you. Paypal and be cnuts when it comes to disputes!

Whatever the law is on this one (and Nick has a good point) you're best off just taking the refund mate.

 

You're no worse off and TBH if he does begrudgingly sell you the item for £46, who's to say he won't damage it in some way just to drag the matter out or piss you off even more....

Thanks for the advice guys. May try contacting ebay see if they put any pressure on him and he sends it, I dont want to just accept a refund yet but may go down that route if I get nowhere in the next day or so.

 

Got back from work to find a message asking what my email address is, so I have replied asking why he wants it as he doesnt need it. (unless he means for the refund but he can just click on refund either through ebay or paypal).

 

After the sort of day I've had this tosser is lucky he hasnt got any abuse! (yet) :lol:

probably a sex doll thats why he hasent done anything about it yet as he dosent want anybody knowing what a perv he is:rofl:

Go for the refund bud, I have had this done to me so many times on the bay, it is not fair, I have sold things that I thought would fetch more money than I got, but I always send an item even if I thought I would get more for it.

 

Legally, the law states that if you place a bid on an item you as the buyer enter a legally binding contract, therefore you must purchase that item if you win it, but the seller is under no legal obligation to sell the item, the law cannot force somebody to sell something they don't want to sell, (even though as in this case he only doesn't want to sell it because it didn't fetch the money he wanted) but the law can make a bidder pay for something if they win the auction. I got this nugget of advise from Ebay themselves when the same thing happened to me, try it, they will tell you the same thing.

If your gonna talk about ebay rules you will find that the buyer is king when it comes to ebay and paypal. I do not sell anything on ebay anymore because you get stung by selling fees, paypal fees, ****ish buyers who want everything for nothing.

 

I sold a Superdry coat for £70 recently on ebay and out of that was £8 in fees. Then the buyer emails me saying the coat is too small and wants a refund plus a refund on return postage costs. CHEEKY *******. Emailed them back saying you got more chance of winning the lottery than getting a refund back from me! But the most spasticated thing about ebay is that if this tosser of a buyer starts a case 'Item not as described' paypal/ebay will start recovering her money for her! Luckily she can't do that now as she as already said in an email to me that its too small and thats the reason for wanting to return...although i'm sure ebay will find a way to shaft the seller in this case again.

 

I hope she has a shit christmas

I know what your saying, and I agree with you, just the unfortunate thing about this case is that the buyer or anyone else cannot make the seller sell the item, but on the other hand the seller can make the buyer pay for an item, it is only a legally binding contract one way, the buyer has to pay, but the seller doesn't have to sell if they "change their mind and decide not to sell" for whatever reason, in this case the reason is that they didn't receive enough for the item, if you know what I mean. As I say, the law is an ass.:thumbdown:
