As some of you may know nearly 4 weeks ago i was involved in an accident in my pride and joy. No fault of my own, and in fact the third party has admitted total liability.

 

My car is pretty smashed up, - drivers side rear wing, door, front wing, front bumper, headlight, pass side front wing, door. 2 alloys, pass window, both wing mirrors.

 

went through all the right channels with insurance etc. assesor came out last week, personal injury stuff all done.

 

when i took out the policy last year i went with MCE as a few people on here told me they did "agreed value" policies. so rang them, went through all that had been done to my car in the minutest detail and they came back with an agreed amount of £12,000

 

having some doubts this morning with the insurance takin so long so i thought i will ring my insurers and get proof of the agreed value, just in case i needed it.

 

After waitin for 20 minutes to get through i am told they have my vehicle down as book value!!! and they have no record of the agreed value even though on my policy it says - Value of Vehicle -£12,000 and their representative called me back to tell me of the 12k that their underwriter would agree to.

 

I am totally gutted!:cry:! i have spent in excess of 12k on my car in the 4 years of ownership and if it gets written off now i will get about 3k (if that)for it..

 

I am so upset and angry its hard to type this right now, the guy i just spoke to is ringing the actual insurance company (QBE) to see if anything can be done.

 

I just dont know what to do, i dont know if they will accept a valuation now but even if they would how do i get a valuation of 12k on my zed which is atm smashed up??:cry::cry:

 

pls if any of you have any words of wisdom let me have em cos right now i feel like the whole damn thing is too much.

 

and pls if you think you have an agreed value policy..... CHECK IT OUT

If there is 12K stated on the policy then that has to be a contract, unless there are some clever wordy get-outs somewhere else ...

Remember insurence is ment to pay out like for like to replace exactly what you have lost up to the value of your policy. So if it will cost 12k to do so keep on at them and tell them to get you the exact same car with exact same mods and condition and miles and you will accept nothing less or the 12K so you can replace it yourself.

Did you give them detailed pics of the car when the value was being accessed?

 

I would say if its on your policy they have to stand by it, dont give up, go to the ombudsman and they will sort it out.

Is it your insurance that is paying out or his?

 

I would have thought your insurance would have acted on your behalf and fought for you.

 

 

I hate insurance and use them as little as I can. But it's sad to see when you REALLY need them they just dessert you.

my mate has been going through the same thing with his insurance company for 8 months and has had to get a solicitor involved

i'd take this all the way if i was you, as its been said it was the other drivers fault so it'll be his insurance company thats paying the bill, therefore your company should be fighting your corner for you, afterall thats what you pay them for, keep at it fella and good luck.

Do you have legal cover? RAC/AA Membership normally comes with this?? You need some form of legal representation to assist and advise...before that though all the insurance sharks will try and do is see what you will accept...Stick to your guns and ask them to put everything in writing so that you can pass it to your solicitor....

Have you notified them of all modifications to the car. ie did you provide a schedual of all aftermarket parts fitted and all modifications needed to install them. If so it will say on your policy Modifications Declared and it will either have a list or it will refure to the list held by the underwriter.

 

If that is the case then they must replace like for like and hence the agreed valuation. They cannot give you the book value because that is based on a stanard car. So even if it doesn't say agreed valuation (which my policy Didn't) but states a £12000 figure and Mods declared then they have entered into a contract to insure a car with all those modes and hence the Valuation figure must stand.

 

Insurance companies always try to avoid paying out as much as possible. They have to keep their shareholders happy, but they cannot have it both ways.

 

Their is obviously a list of mods or they would be telling you that the insurance is nul and void. So nail the *******s.

 

I find a letter of complaint to the MD of the company and a threat to go to the press about their disgracefull treatment of you will yeal a more satisfactory settlement. Infact when I had to do it they even paid my excess.

This is nothing new mate. My missus had a rare Mini Cooper S which was valued at and agreed by the insurance company 7.5k. It got stolen and the insurance company initially were only going to pay £950. It took 18 months to sort it out and to get the agreed value.

 

Stick to it liam, and get some legal advice asap

markzx - i declared all modifications when i took out the policy and they have confirmed that they have all mods listed ;) so yeah maybe its not all gloomy... thank you

You're worrying me now, i'd better double check my policy when i get back and maybe give them a ring, i'm pretty sure its covered to pay out for the agreed value of the car but then again there's nothing in the paperwork to agree this.

 

Sorry to hear all this buddy, it was a corking car and it'll be a bugger if they dont' pay out the full amount. Keep fighting them

Well then their just doing the usual lets see how little we can fob him off for.

 

Fooking sock it to them and tell them you paid them promptly what they wanted under the understanding of the mods declared when insured and you want it sorted ASAP.

 

Keep at em Liam and you'll get it in the end, but don't let em drag it out. Tell them thats what your insurance was baised on and that if you have to go legal you'll be looking for expenses and costs of a hire car. If they don't come back with a sensible offer in a week do a search and get a snotty letter off to the MD. P.S. Follow every telephone conversation up in writing and tell them that is what you are doing

Dont give up, the insurance companies always try to get out, but legally they have valued your car at £12k and a contract is enforceable in the eyes of the courts..

 

You can always complain to the insurance ombudsman who will invetigate this for you, do write to your insurance company and tell them that you will be pursing legal action and making a complaint via the insurance ombudsman

Just a thought,if you asked for agreed value when you phoned them then they should have a record of the telephone convisation.

just had a call from the third party assesor that came out last week. Course i told him (because i thought i did) that i have an agreed value now he wants me to fax him the agreed valuation from the insurance which of course i dont bloody well have..

 

gah!! it gets worse

when i had an agreed value police on my lotus sunbeam they required photo's servic history ect then sent around a valuer who knew nothing about the car as he normaly did motor bikes but that helped me add value my point is when it came to claiming i had the same problem but i had the photo's they had stamped and sent back to me so they could not ague the fact because it had there stamp on the back of the photo's do you have any photo's they have sent back to you

sorry to hear you have problems with mce insurance,( i also have my 300zx insured with them at an agreed value) going to double check my policy now. insurance companys are quick to take your money, but slow in paying out. hope you get it sorted.

no, because i have never taken out this kind of insurance before, i didnt know what was involved, and the prick on the end of the phone went through all the modifications in detail, and the power increase, and came back with the 12k figure!!!

 

Have decided to let the wheels turn and wait and see what they do before going postal!!!

If he quoted you a figure of £12K then you stick to that and insist that. Also insist you informed him of all mod's and that they have given a 12K figure and a premium to match so they obviously were aware of them and cannot offer you payout for a tyre standard car
