Rule changes coming into force over the next week and a bit.

 

First up, don’t forget that starting this Monday, the 24th September, anyone caught “failing to identify the driver,” when caught by a speed camera or suchlike, will automatically earn themselves double points.

 

Thanks to the provisions set out in the Road Safety Act 2006, the government has amended the law which now means that drivers who don’t admit to their indiscretion will receive six penalty points.

 

Paul Smith, founder of SafeSpeed.org.uk, said: "This change has absolutely nothing to do with road safety - it's just spiteful."

 

"Vehicle owners should be aware that they have no obligation to 'name the driver' if they do not know who the driver was at the time of the alleged offence, and cannot discover the identity of the driver using reasonable diligence. This is a statutory defence - sometimes known as the Hamilton defence - and is enshrined in statute 172 of the Road Traffic Offenders Act 1988."

 

Secondly, although vehicles with incorrectly displayed registration plates already fail the MOT test, from 1st October, the rules will be tightened further.

 

This is as a result of feedback from traffic enforcement cameras, Automatic Number Plate Recognition systems and road user charging technology. The new rules require the MOT tester to visually inspect the number plates, which must be present, secure, show the correct registration, colour and be the correct size, format and font.

what does this actually mean? Are you able to request the picture taken to try and identify the driver?

I am worried i will be getting a letter through the post soon and my girlfriend, who is a named driver, has a french driving licence and cant collect point so i am hoping she is shown as the one who was driving.

The thing I don't really understand .... If they can't correctly identify the driver, then who gets the double points, both of you ?

yep.. just thought about it Im sure I heard on the news one night that if the registered keeper (the owner of the vehicle) says basically 'I dont know who was driving the vehicle' he gets done for it....... how can you not know who was driving your vehicle unless it was stolen? Which would have been reported to the police so you'd be ok.

 

Dont know what would happen though if you said 'He was driving' but he goes up in court and denies it ... hmmmm

Well in truth there is something wrong if you don't know who was driving your car at the time, I know I wouldn't take their points for them.

so in this country it is now acceptable to punish a person who is innocent of committing a crime?

 

what next, if a murder suspect, denies charges through innocence, the courts will sentence him anyway, as the authorities are incapable to bring the real perpertraitor to justice?

so what is the crack with requesting the photos to try and work out yourself who was driving?

 

It is easy not to know who was driving because the fine normally comes through weeks later and if you were caught on a road that you and other people who drive your car use regularly how are you supposed to remember who was driving at that time if you didnt see the flash?

So i wonder what would happen if a car was cloned with the registered keepers?

in a way though you are not innocent saying you dont know who was driving.. how can someone not know who was driving your car? Surely as the owner of a vehicle you have the keys.... so you know who you gave them to??

 

to say that you must be 'sticking up' for your buddy or trying to get out of a fine.

What if you have a company pool car? open to any employee to drive at any time?

 

it is more than possible, that the registered keeper then, may not know who had it at a given time etc.

 

smaller companies, do not make you keep driving records like this.

 

if its your own car, then yes i agree you will know who had it, but as a pool car, then possibly not

i think it is a bit rich as the body that will issue these points can not even get their bloody database working correctly and are still fining people for untaxed vehicles that are taxed and at worse crushing them!!

 

maybe they should concentrate on one thing at a time, rather than brinigng in new regulations just to confuse them even more!!

I just got fined £650 for not supplying the name of the driver ! :mad:

lets face it. if its your car you know who's driving and your just trying to bend the law into your favor in not getting a ticket by saying, ok proove it was me.

 

on the other hand the whole policy surrounding speed cameras stinks so bad that they should be taken down and burned.

 

On teh other hand. If everyone was to "drive to rule", especial on the motorways, lets see how fast the speed restrictions get lifted, it would be caos

you know who is driving your car but if there are two or you on the policy and the camera is located in a place you both use regularly to do the shopping, pick people up, get petrol etc and it is on a normal week night and you dont see the camera flash how are you supposed to remember indefinitely who was driving at that exact point when the ticket comes through 6 weeks later?

I have 5 cars and they are insured for me my wife my eldest son and 2 of the people that work for me. My son or my wife maybe out at this moment in 2 off my cars and later this afternoon be out in the same vehicles but both in the other car depending what they are doing. I came to work in my pickup truck today and John who I work with has been out in it to get butty's and Bev has been down to the tip in it.

We have all traveled down the same bit of road and past the same speed camera. This kind of thing happens regularly on many days of the week. So in 4 to 6 weeks from now if I get a picture of one of the cars and you can't see who was driving. how am I supposed to know who's driving if they deny that it was them. Should I get done, is this right?

 

If you have only one car then maybe it could be argued that it is fair, but for people who own more than one car it sure as hell isn't. Also one of the fundimental statutes of British law (and infact international law and united nations human rights law) is the right to silence.

 

This law is saying that you will be punished for any offence comitted by anyone using your vehicle or one designed to look like your vehical (believe me this is far mor comon than you think). So this new bill looks like it contravenes major statutes that under pin the basis of a persons legal rights.

 

So all this law does is creat room for leagal argument (ie makes lawyers more money) by allowing people who can aford to fight it a way of keeping a clean licence and people who don't have thousands to throw at it will have to pay up and take the points.

 

I'm sorry but this is more unjust ******ks for the inland revenue. Just another Tax and a further erotion of our hard earned legal right to be inocent untill found guilty. When it come to motoring we are now guilty unless you can aford to prove your inocent.

 

If this was France people would be burning Effigies of the Transport minister and by Tea time he'd be out of a job and the law would never surface again.

 

What a bunch of spineless TW@ts we are in this country and yet another reason why when my divorce comes through I'll be slinging my hook off to France'e. Viv la France tout de mere.

When you can't drive cos your banded will you be able to get about your business on our world class public transport system?

 

Can you bike it to work? (most jobs are on business, retail,or industrial estates that are miles from where people live)

 

Is the money being used to get better services, look after our armed forces, old age pensioners, make City centres safer after dark. Deal with crime?

we go out in about ten cars a day here and sometimes I drive sometimes anna ,dave,andy or Barry so how the hell am i meant to keep track as if i was to keep a book or log as i am supposed to It would be massive LOL.

 

When i got that £650 fine for not supplying the name of the driver what could i do apart from pay it ?

section to be filled in at all times - normally your name, address, DOB etc

 

Part 1 - if you were the driver fill in your driver licence and sign

Part 2 - if you were not the driver and are not a hire company complete this, the driver's name, and address and sign it.

Part 3 - statement by a vehiel hire company

Part 4 - if you were not the keeper or owner of the vehicle at the time complete here (date of sale etc)

 

Thats on the fine Im looking at right now (Hampshire Constabulary one, they may vary slightly .... but now where really to 'contest')

well of course it is, muggers and robbers are usually out of employment, therefore do not provide income to the coffers, that pay back out to them, motorists however do!
