you buy a car from a trader with 6 months warranty... a week or so after the purchase you find that the engine is actually buggered and a new one is needed...

 

the car is booked in to a garage to be repaired but because of awaiting the availability of another engine the car is in the garage for a long period of time...

 

when i do eventually get it back there will be next to fook all left of the warranty period so if the new engine causes any probs i would have to fit the bill...

 

so basically since purchasing the car iv hardly driven it and had to seek permission from the person i bought it from to join the z parade at silverstone.

 

any advice welcome :)

I think the biggest problem you are going to encounter is that you are dealing with 2 different companies. If you had bought it from a garage and they were the ones fitting the engine I think you would have a case to have the warranty extended. Under the current circumstances, and I'm reading between the lines here, I think you might struggle to get the original party to extend the warranty as the repair is out of their hands. In addition the garage repairing the car will only be interested in faults that occour as a direct result of their work.

 

I'd drop Citizens advice an email and they will be able to speak to someone who can tell you exactly where you stand within UK law. Email them though because going to see them in person is a painful process :)

 

I hope you get some satisfaction one way or another cos I hate to see people, especially club members being f#*ked about.

I'd be speaking to the seller to confirm that your warranty will freeze from the date the car entered the garage and will recommence on the date of completion of work. As the seller has agreed the garage for repair they have basically became an authorised repair center as far as the seller is concerned.

 

If this is acceptable, I would also request that the garage that is doing the repairs to date the work and forward a progress report to both yourself and the seller.

Key days would be - Arrival Date of Job, Ordering Date for Parts/Engine, Arrival Date of Parts/Engine, Completion Date of Work.

 

I would of course call the seller first to confirm this and ask that they confirm it back in writing to you.......I assume that you do not have a written warranty as such and it is a 6 months from date of invoice.

 

It would really depend on the terms of the warranty that you have though.....you could ask that the warranty period be frozen as you are not claiming reimbursment of hire charges etc.

 

Just my thoughts and of course based in no legal knowledge what-so-ever.........

well if i had bought a 5hagged car i would take it straight back to the registered company i bought it from and demand my money back, you have legal rights if he is a company and not private seller.

This is the key sentence IMO. You bought the car from a trader, who warrants the mechanicals for 6 months; you find the engine is fekked after 2 weeks.

 

The trader therefore has a legal obligation to foot the bill for the repairs.

 

Firstly, if the engine was fekked before you bought the car, then (if the car was advertised as good condition etc etc and priced accordingly) that trader has sold you something not fit for purpose. Said trader must then either refund your money and take back the car, or put things right to your satisfaction - regardless of any stated or implied warranty. Sale of goods act - simple ;)

 

Secondly, you also have a warranty. If it is insurance backed then, in accordance with the claims procedure, obtain authority for the repairs directly from the warranty company and get it done. A warranty will be valid for the specified time only; however once you have lodged the claim they will still meet the appropriate costs even if the work is not finished until after it expires. PROVIDING YOU HAVE NOTIFIED THEM IN TIME AND OBTAINED AUTHORITY!!

 

In each case above, try to arrange everything throught the trader to help protect your statutory rights. If the car is off the road for months and the trader is decent, he should provide you another 6 month warranty from the date the works are completed to your satisfaction.

I can only wonder why these fookin idiots sell cars that they know are shite? I think they should be taken out at dawn and shot. Some people. No most people work their boolx off getting the money together to buy their cars only to be ripped off by these tosspots. We should get a little crew together and when a member gets ripped off the crew should be despatched and go and sort the idiots out. OK I know it would never happen but you can guess what would happen if it were to. Yep! They would think twice wouldnt they.

Good point, but I doubt whether he 'knew' the car was a bad'un. It took us a couple of evenings to rule out very minor problems before it became obvious there was a real problem.

Ive worked in the motor trade for 17 years and have seen many people who buy a used vehicle with a warranty then find out when a fault occurs its not covered.The warrantys usually cover mechanical failure and not wear so if your engine throws a con rod your covered but if it gets low compression from bore/ring wear your out of pocket.Its a total farce as its not properly explained when the purchase is made.One particular vehicle a firm sold who i worked for had a common problem with syncro wear.So to help out the customer i had a snapped baulk ring and syncro cone which id let the warranty holding company examine.As it was broken and not worn theyd pay up.it was named the harth rug in the end!!.

Hey buddy. You might wan't to go and see the Citizens advice. They are free at least and may be able to point you in the right direction.

 

I would say that if they are not going to pay then you need to get legal advice.

It is identical my friend and I feel for you. My advice is regardless of the warranty, make sure you get the thing fully sorted and you'll be happy again.

 

I'm fukked off to high heaven that after buying such a high grade car that I'm £2,000 extra out of pocket with no offer of recompence, but Jimmer did a fantastic job of rebuilding my engine and that kinda makes me feel better. I now know things are good with the car.

 

Bite the bullet and get a new engine built by Jimmer or something. Gives you the chance to upgrade and replace parts. I know it's a **** being out of pocket, but it at least gets the car sorted and feeling less depressed about it.

Anyone who sets themselfs up as a dealer are legally required to sell their goods as fit for purpose. For something to fail in such a short time means that it was not fit for purpose. Stop messing around and put the onus for the repair back on to the dealer you purchased it from, they should be sorting this problem out. Get the car back to them and it is their duty to put things right. In a court of law, you are definitely the injured party. Trading Standards will support you especially if they have previous history similar problems. This is not the first time this has happened from what has appeared on this club site, so why is he still allowed to trade. ?

Im pretty sure the Dealer is paying for the work to be done.

 

Current status, from what I have seen (although I do not know full story), is that Dealer wants to supply new engine but was unable to find one, so garage has now sourced one for them which has been tested and is/was waiting for approval from Dealer for work to go ahead.

When buying from a dealer, the law says a car must be:

 

Of satisfactory quality. It must meet the standard a reasonable person would regard as acceptable, bearing in mind the way it was described, how much it cost, the age and the mileage on the vehicle. Amongst other things, this covers the appearance and finish of the car, its safety and its durability. The car must be free from defects, except when they were pointed out to you by the seller.

 

As described. If the advert states “air conditioning and CD player” then the car should come with these features and they should be working.

 

Reasonably fit for any normal purpose. It should get you from A to B.

 

Reasonably fit for any other purpose you specify to the seller. For example, towing a caravan.

 

These rights are not affected by any mechanical breakdown insurance (which is often sold by dealers if the manufacturer's warranty has run out), guarantee or warranty giving additional protection. Once a trader gives a warranty it becomes an agreement on its own, but it is not your legal right to demand a warranty from the trader.

 

If you inspect the car, or someone does so for you, the dealer may not be liable for any faults which should have been uncovered by the inspection. It's a good idea to get a description of the vehicle's condition from the dealer: ask whether there is a pre-sale inspection checklist.
