Unmarked police cars are an infringement of you human rights and anyone who is given a ticket or entrapped by one should imediately apeal to the European Court of Human rights. I garentee and charges will be dropped.

 

Unmarked Police cars are only legitimately used for observation in Criminal investigation by CID. Although they could observe you they cannot pull and any equipement used to record your speed in a unmarked car is deemed as covert Policing for which there are very stringent laws. Ipswich: Unmarked black Golf GTI came flying past last week, with little blue flashy lights in the grill and a load of camera gear mounted on the dash! It only went past me because I was in my mates Beetle you understand :)

I was in a Cavalier SRi last year overtaking a new shape mondeo on a dual carriageway, when I was level with him he decided to accelerate so I had to floor it to over 100 to get in before the dual carriageway came back down to 1 lane. As soon as I pulled in front, on came the hidden blue lights but amazingly he let me off cos I said we had a hospital network down. My manager was in the car at the time and he still talks about the day I raced the law. It was nice to do him in a 17 year old car though!

Covert Policing all fall under the same rules of national and international Law.

A covert Police car is the same as putting hidden cameras and bugging devices up, in a place of work, public building or in your home or Hotel room. ie thats why there must be signs up anywhere where static or mobile speed cameras are used.

 

These all have to have a clearly visable public notice to state you are being filmed, recorded or monitered. Unless it is part of an investigation and a High court order has been granted. These can only be granted on the basis of national security or national safety interest. Which before some bright spark says speeding is a danger to the public and therefore deemed worthy of covert policing. They still cannot use it without a High Court Judge deeming it is.

 

Then a High court Order must be issued for each specific case and the reasons must be able to hold water in the European Courts in Strasburge, The Hage or United nations Court in Washington (or is it New York, not sure on that) However having a winge at the copper who is doing what he's been told to do by his boss will proberbly jog his mind to do you for a shed load of sh1t that don't exist or he wasn't looking for in the first place, Because contry to belief they are humans just doing a job and like the rest of us find our daily job and the grief from management and punters a pain in the ass.

Always hearing about this sort of stuff but nobody seems to know the channels to use to test these theories out. Not saying I don't believe you Mark but I would love to at least have a number to ring or some kind of case evidence that proves that this sort of hole in the system is accessable.

No i think the money from speed cameras fund John Prescott's lavish Jaguar and the Spanish (due to the ridiculous amount of money that we send to europe which then gets passed onto spanish spongers) But it wouldn't suprise me if the money from speed cameras is involved in these £50,000+ 'police cars'. :headvswal

I have to say I've never seen or heard of them and Birmingham is my stomping ground but hey, you never know :) I do know that Nottingham has at least two marked Scooby's though as they frightened the bleeding life out of me when they both barrelled round a corner, out of no-where at around 90mph! Late for their tea I guess...:D

Its not a hole in the system Tim, it just that the Magistrates haven't got a clue and rely on the crown prosecution service who's existance depends upon attaining succesful convictions and the Police. Who are abusiing and bending the rules because motorist are soft targets and they all must attain a certain number of convitions or face a review and possible sack.

 

All of which increases Revenue so the government are happy for it to continue. + The police keep getting their number of convictions so don't have to actually deal with real crime like the gun toeting wrapping smack heads who terrorise the streets of our cities.

 

Your local MEP will Give you all the Details require to make all steps for an apeal. So too a good solicitor who specialises in EU and/or Human Rights Law. If you write to the EU court they will send all appropriate literature (in what ever language you want it in) and give you advice on getting funding for your case if you can argue that it is a national infringement of British Human Rights actively persued by the British goverment or by its officers upon it behalf and not just over zelus cheif constables.

 

Oh yep I forgot. You will have to appeal to a UK court first.

 

P.S. Sorry did i forget to mention it may cost you a tidy sum to get wheels in motion, but you will win and should get compensation. Depends how deep your pockets are and how much your prepared jump through the hoops to get justice.

I don't have anything to show you, but believe it or not I read about it in a surveillance technology magazine. They where dicussing the legality of private eyes owning and using some of the kit for sale.

 

The hole issue of covertly attained information being admissible in a court of law and how and when it could be used without infringing on individuals Human Writes.

 

My friend is a private investigator For a large insurance company whos work recently help lock up a few fraudsters in Liverpool. They have to show sufficient justification to warrent a court order being granted for covert monitoring and even then the footage may be inadmissible if it invokes an infringment of human rights law.

 

Lets call him Jim, has to be on the ball with regard to the law and even though he is an ex copper he has also studdied law and keeps abreast of any changes. He has to because his lively hood depends upon it.

 

He informs me that there are no records or cases of anyone successsfully defending themselves from prosecution by a covert police car, because if you fight it far enough the mater will be dropped as the police cannot charge you. It is incorrect use of covert vehicles. Like I said though it could get costly to get that far as unwritten policy is to prosecute as many motorist as possible and improve crime figures.

 

Hence your solicitor cannot look up Mr Takemetothepub verse the state for wrongfull arest by covert vehicle as there is no grounds for such a battle to be fort. Any legal battles would be for compensation and just that. Takemetothepub Verse the state for compensation.

 

You see yet?. Can you see why they are getting away with it every day and all but a few well off well informed people are getting justice, at a price.

 

No out cry because you push it far enough and the Police just drop the case and you are no longer at a loss so no case.

Yup i seen one of the lotuses, it's unmarked but you can spot them a mile off . This one was parked, had 4 ariels on it and a SW radio stack in the dash ;)

I remember in the 70,s (fook that really puts an age on me)

South yorkshire Police had jaguar 5.3ltr XJS'es. When they really were something. I was Mr biker then. I had a Brand New CB900F and a Paggett RD400 LC with sponden monoshock frame and 5 gallon tank, Cutting edge and these Jags were still scarey. They would eat the 911 of the day no probs. 1979 (I really was gods gift and I didn't abuse it enough :headvswal i really shouldn't have been so disearning) These days a pulse and a willing disposition would really impress me :rofl: :rofl: :rofl:

Generally police forces that drive around in Porkers, Scoobies and Lotus' don't pay for them out of tax payers money, they're usually on loan.

 

At the first legal Southend cruise the rozzers turned up in an Audi TT (how embarrassing) an Elise and an NSX. All were donated for the night by the main dealers to help the police soften their presence at the cruise. ;)
