Im having a lot of trouble with a garage as youll see in this thread

What should I do

 

A. Take him to the small claims court and NAME and SHAME him - He deserves it

 

B. Just take him to the small claims court

 

C. Forget it, forget the money and let other people find out for themselves the hardway

 

It has caused me lots of grief, stress and cash - and i STILL have a broken zed :(

I think you can get all the small claims forms on line and it only costs about £30 to get a case going, depending on the amount you want to claim.

Deffo small claims court then name and shame when it's sorted - don't jeopardise your claim in any way...

It's been said before (even on this thread!) and it'll be said again - but this is the only correct advice.

 

1) If a forum member: via forum dispute resolution (eg MAC1 for trader and shunter for members if you see what I mean)

 

2) If no result or not a forum member: Trading Standards http://www.tradingstandards.gov.uk/ and take their advice. Or a motoring organisation you are a member of (RAC, AA, Green Flag etc). Or your insurance legal service.

 

3) If you paid by credit card (not charge or debit), they may be a party to the contract under Sale of Goods / Consumer Protection Act and (if they agree your claim) can be very powerful allies.

 

4) Suing someone or a company through the Small Claims Court sounds a lot scarier than it is. Read the forms, fill 'em in properly, ask the Clerk of the Court for advice (that's what they're paid for) and go for it.

 

You can even do it online http://www.courtservice.gov.uk/index.htm and there's yet more good advice here http://www.bbc.co.uk/crime/law/smallclaimscourt.shtml. As it says

As a general rule, a person has a legitimate claim if someone owes them money and is refusing to pay-up. All you need is proof that the debt exists - a document or reliable witnesses.

I sued a bodyshop for doing substandard work and won. But you have to follow the rules to stand a chance.

 

Airing the dispute in public before it comes before the court is a sure-fire way of p*ssing off the judge and risks prejudicing your claim. And this forum is a public place....

 

Leaving aside the fact that it is illegal to offer legal advice without being properly qualified, you are far more likely to get better advice from qualified people than asking "a bloke in a pub" or even forum members.
