Help. Plonker killed my Zed

Some little twat has just lost control of crap heap and plughed into the size of my pride and joy. At least drivers side front wing, door (including mirror) and rear wheel arches are knackered. Clunch also seems to have become heavy, although this may be psychological.

 

Since damage done by a third party who is 100% to blame (I have photos of the exact location, damage and puddle that he lost control turning in!!!!!), who has the right to declare my car an insurance write-off. Can I insist that his insurers repair it, taking legal action if necessery?

An engineer appointed by your insurance company will do the evaluation, they can write it off and judging by the ammount of damage done they probably will. You can get an independant audit done and then ask if you can buy back your car and get it repaired,

Forunately he was insured on his parents policy. His parents came out to sort out the mess so I have all details. He didn't admit liability (other than saying "sorry" mate) but if necessery I will hire top end bariister to squeese the ttruth out of hime and his three mates that he was trying to impress by going round a corner that was several inches deap in water at 50+ in a Citreon Picaaso

 

Fortunately being an old fart I don't have to worry about modifications, although I'll be taking the stereo out tomorrow and replacing with the original non working one that was in it when I bought it.
