Got fined today, was waiting for a call from the garage to tell me when my z was ready to pick up, (had a tint put on windows looks the biz);) any way, my phone on silent, me in the courtesy car, noticed voice mail on my moby, picks it up to listen, im at a round about waiting to pull away when wpc plod drives round rbout in front of me staring, by the way theres still nothing behind me so i not holding any one up, so i pull off round rbout and plod comes back pulls me in says do you kno why i stopped u, to which i say prob the voice mail, she asks me in the panda car with pc miserable, do nothing but check me and courtessy car out, when she then writes a producer out and gives me a ticket for "not in proper control of a vehicle" when i said what happened to a good old fasioned telling off she said its up to her weather to tell me off or give a 30 pound fine, i got the thirty pound fine, i have never even heard of this offence is it real?? its so annoying as i was caught 40 in a 30 last week so i now owe the police ninety quid, yet they drive about talkin on their radios so are they in proper control ?? Im unhappy that its so open yet i got fined, like when would they decide not to fine u n just tick u off, blah blahh rant rant etc etc grrrrrr

Gavo its not just 90 quid....if u declare the points to your insurance i bet your premium jumps......me being an honest citizen my 42 in a 30 cost me 60 quid, 3 points and 90 quid on my insurance.......so 150 quid later...the bast****...my old boy was in the police for 30 yrs and i had respect for them..not now

Just kinda got me thinking.............so you weren't "talking" just "listening". Don't remember it against the law to drive with just one hand. You "listen" to the radio, so whats the difference? I hear you say "but you don't take 1 hand off the wheel to listen to the radio"...........no, but you do to smoke, undo the window, even to operate the indicators, and they haven't made that illegal?!! Wonder how you'd get on if you were to contest it under the grounds you were "listening" and not "talking" ?

What is the actual offence by using a mobile? is it the physical thing of not having both hands on the wheel, or, talking into it and therefore not having 100% concentration?

its because you are more likely to have an accident whilst on the phone than by driving slightly over the drink drive limit.

 

you could aruge it but you'll end up getting a 70quid fine instead heh.

I thought they could only do you for using a phone whilst driving if you actually do something wrong, ie stray out of lane etc. Then again i suppose theyve bought new laws in now.

 

Takes the piss really, its only the same as smoking, or drinking a can of pop whilst driving, it would be interesting to see where we stand when using car stereo remote controls!!:confused:

I wouldn't advise it, a bloke got done for eating a Mars bar while driving few months back.

 

Anyway, what about truck drivers with CB radios, taxi drivers with their radios etc, etc.

DO NOT talk about justice when you are in the wrong...point 1. Regardless, you shouldn`t have been doing it and you knew it. My wife was hit three weeks ago by some idiot in an Audi TT who was paying more attention to a handsfree kit than to the road. All she was doing was putting the wheelie bin on the bottom of our drive. Idiot comes along, one hand on wheel, other on earpiece, looking down and realises she is there at the end of our drive just too late. Hit her in the lower back with his wing mirror and f***ed off! If I ever find that SOB I will kill him.

 

How can you permanently drive with two hands on the wheel....point 2. Window controls, (most) stereo controls, wing mirror and rear view mirror controls. All involve one hand being off the wheel. This issue is a joke. Cars these days virtually drive themselves anyhow, two hands are just not necessary at all times

 

The police are pricks......point 3. Last year, a sales rep driving down the M54 not too far from me felt suddenly tired, could not focus and became very dizzy. He pulled onto the hard shoulder and turned his engine off. Shortly afterwards he passed out. This man, despite following all recommended advice was successfully prosecuted by the West Mercia constabulary of dangerous driving. He did what was right but has lost his license, his job and who knows what else...just not right!

 

My final point?..well....I think that mobile phone use in cars is utterly out of line in any respect. Apart from this however, there are SO many rules governing every move we make in our cars these days that any real fun is being utterly lost. You (almost literally) cannot do right for doing wrong. Hell, a friend of mine was stopped in a 30mph zone last year for doing 28...why? because he was hindering the normal flow of traffic. He was prosecuted too. The world is going truly nuts and its no good.

 

(BTW, no offence to the thread starter, I`ve just got too many personal feelings wrapped with the whole mobiles in cars thing to be really objective right now).

and the insurers count your points for 5 years not the 3, that stays on the license so 3 points in a zed can mean £60 + 5 X £100 depending on your premiums - painfull!

If you forget to tell the insurers then dont bother paying the premium either!
