Any one know much about GTO's ? it's the twin turbo 90 spec.

Mate of mine who unfortunately is very young and naive bought a modded one from Leeds the other day, after handing the CASH over, 15 miles later it loses all transmission ( no clutch) then dumps it's coolant on the hard shoulder, stuck there in the middle of the night he decides you get it trailered back to I.O.M ( against my advice) £400 lighter for said pick up, i get the car inspected by performance engineer, seems it's a minger ! quotes of nearly £3,000 result in tears, so question is does anyone know how hard/easy gearbox removal is, Engine in or out ? Water pump removal the same and as rear rack is fooked, again hard or easy ?

Unfortunately a private sale and seller made an offer that won't even cover costs of trailer :mad: Oh and get this, car was MOT'd on the very day car was sold :eek:

Any ideas or help would be appreaciated.Though i am trying to get him let me bring it back and plonk on sellers driveway....

Have you tried getting in touch with the garage that did the MOT or do you think the MOT tester was help make it pass by way of cash in the hand:eek: ? Surely there must be some comeback either way. If my car had got and MOT and fell to bits the same day that would be the first place I'd go. Just a thought!

fwiw, autodata give 4.6hrs to remove & install the gearbox, so it cant be too bad :(

If the first priority is getting your mates money back, have you considered threatening the MOT tester/garage with reporting them to the relevent people unless they put presure on the seller.

If they were to loose their license it would cost them a fortune in lost business and so is quite a big incentive for them to also put their hands in their pockets.

Thanks guys for the input, please any more suggestions, keep em coming, i really feel for this young lad, first time driving in UK on his own and first time buying over there too and he ends up on the hard shoulder at nite unable to get hold of seller and 6 1/2 grand lighter !! and very worried, anyways the list of faults is growing, estimated cost is almost at the amount paid for car in first place :( so it looks like pursuing for money back, even though it was a private sale, i think the courts would feel symptethic (?) seeing as it happened after less than 20 miles, will look at the MOT garage, anyone know M.S Digpai in Morley, LEEDS, are they Greek cos i believe the seller is, Hmmm

Go see the Citizens Advice, people think that you dont have any comeback when you buy something second hand from a private seller but you have more power than you think

I remember talking to a car salesman (sudder) cos I was looking at a Z they had there when me any my dad, who came looking with me, started to talk about the GTO to him.

He told us that a few weeks back his mate bought a GTO and 200 miles later the diffs packed in. Not just 1 of them but 2 of them at the same time :( ouch.

Just a quick one about the mot. An ex of mine bought a mini privately and turned out to be a bucket of rust, with other dodgy things wrong and also a new mot. She went straight to the mot board/governing body and they were more than keen to know about the mot testing station passing an obvious "fail". One thing led to another and the mot garage had to do everything to make the car road worthy, free of charge.

Adding to what someone else has allready said, the add must be correct, ie, if he said it was all good and no prob etc than it must be so, regardless of if he is private or not. THis is fact, I read about someone getting their money back in such a case.

I owned one of these (a 92 jap Twin Turbo).

Tell your friend to bring it back at all costs, when these things go wrong they go wrong big style, and make the repair costs on a 300 seem cheap!

Sounds to me like your mate is up sh*t creak without a paddle sorry to be so glum but the faults you have described the car could legally pass an MOT so I don’t know if you would got very far with the MOT station. As for the seller it was a private sale, as so he has very little rights he shod have got someone to look at it for him especially with the 3000GT have seen some bad ones. sounds like the bloke who sold it needs a visit from a few large men! I hope he gets his money back we all need some luck.

I returned a lemon from a private purchase one time. Parked it outside the guys house and put the keys back through his door. Fortunately he had accepted a private cheque which I stopped at the bank immediately I found the head gasket and diff had faults on the car.

 

Dont think you can do this with a bank draft. Also any clever private seller is likely to add the words "as seen" to the receipt if you get one and get the buyer to sign his copy too.

 

Its a danger buying a "special" car - you get carried away with the looks of the thing and forget good sense.

Thanks fellas, just some of the 22 faults found, which i assume are part of the MOT testing as we don't have MOT's over here.

Rear rack boot split and laeking fluid.

PAS steering pump leaking.

PAS hoses leaking.

Propshafr centre supports very badly worn with excess play.

O2 sensor missing leaving hole in exhaust and wires cut.

2 Tryes worn, 1 illegal

cam cover gaskets leaking.

door handle and lock US

Front crank seal missing.

Front track rods and ball joints desperate for need to replace.

Front track Boot leaking fluid.

Coolant hoses lose.

That's apart from total loss of tansmission ( found out exact same thing happened 12 months earlier !!)and water pump gone.

Will be pusuing this on Monday as i think a refund has gotta be on the cards plus expenses ??

The MOT is our only ammo really to get the faults ether fixed or push the seller into refund if the paper work was in fact made up.

So does anyone in Leeds area know Station road garage in Morley, Leeds ?

Off the top of my head, the following out of that list are MOT fails;

Cheers Aaron that would be a great help, i'm sure there is a connection between the seller and garage other than that of customer relations, so in which case rather than the garage losing it's licence, i'm sure they would tell the seller to sort out rather quickly !! and just a reminder, the MOT was done that very morning of the sale :eek:

PAS leaks are a failure only if you can actually see the fluid leaking out (not just wet)

 

propshaft - not part of the test

 

O2 sensor - as long as it passes the emmisions test then no failure (you cant actually fail it on the sensor) did you get an emmisions printout with the mot?

 

tyres must be a min 1.6mm across the centre 3/4 of tread - the outer edges CAN be bald & still pass!

 

cam cover - not part of mot

 

front doors must open from both inside & out

 

crank - not part of mot

 

Track rods & ends must be considered *excessive* wear

 

coolant hoses - not part of mot

 

 

the MOT test is a *very* low standard actually & should never be used to judge a vehicles overall mechanical soundness.

 

hope you get it sorted, if you want any more info on the mot i will help all i can.

Every town/city etc has garages that u can buy MOT's, the real shit thing is when someone gets stung with a car that obviously aint roadworthy and is gonna cost a fortune to fix, its different with an escort or something that maybee could be made roadworthy at a minimal expense with parts from scrappies etc but with a GTO.....many pennies by the sounds of it. I am not trying to make excuses by changing the car type or anything like that as i think to sell a ringer gives to me the buyer the right to give the seller a bit of BASEBALL BAT............

You need to know exactly what the add said. It is fact that if the seller said it was good "in the add" and it isnt you have a very good case. which I think the trading standards ot someone will chase for you.

There was a small article in Autocar, (I think) about just such a case.

One small point is it may not have been the same car that was MOT'd as yours, lots of car can quite easily be made seem like anther car, MOT the good one sell the bad one.

And the MOT station my never know. Or you have a bent MOT station we had one close to us some years ago pass anything and I mean anything.

All I can say is after that list of flouts please doesn’t let your friend buy anther car on his own.

I would try to force the MOT point on the seller .if they MOT'd this car the MOT station and the seller could be in the sh*t. get on to trading standards and ministry of transport. Good luck.

I bought a car which was a complete wreck. This was a private sale. I went to the Police, and they called the owner and told him, he had 7 days to arrange return the money, or be taken to court by them!!

 

Try this as your friend should get his money back.

I personally wouldnt want to keep a car, which has this many problems, because you dont know what else you might find.

Also if your friend desperately wants a GTO, my mechanic has a Black GTO for sale, £6000. Its got a misfire, which he is sorting out, one of the spark generators has gone.

There must be some law in place to protect people from being so obviously ripped off despite what was said on the receipts etc.

 

The same thing happened to me when I was 21.

I bought a 280ZX from London BY MY SELF!

I paid £2200 back in 1989 for a 1981 car which wasn't particularly cheap.

Unfortunately, I bought it in the rain & therefore it looked OK.

The seller also agreed to drive it back to Wales for me. He drove it half way & fooked off back to London! Leaving the car in Wolverhampton.

 

In the ad, the car was described as 'Immaculate black'.

When I got it home, it looked like a total shed. It was full of filler from front to back! & the spray job was cr@p! Someone valued it at about 1K less.

 

Looking back, I should have sued but I was 21 & very naieve.

Irrespective of the MoT issue there is almost certainly a course of action under the Sale Of Goods Act in that goods have to be fit for the purpose for that which they are intended.

Unsurprisingly it is known as 'Fitness for Purpose'...and in the case of a car it means that the car should actually go, unless sold as a non-runner.

 

There are a couple of things that can cloud the issue..like 'Caveat Emptor'....essentially this means that if the buyer has actually inspected the goods then he has LESS recourse than someone who didn'y!!

 

In the case you mention it should be fairly apparent that a cursory visual inspection will NOT reveal major mechanical defects so it should not have (too much?)/any impact.

 

 

Definitely get him to talk to his Citizens Advice Bureau....they will almost certainly het him to initially approach the seller. If that fails to get anything done ( and to be honest anyone who sells a car with that many problems knows what they are doing...so don't hold your breath!) then it should be done through the Small Claims Court.

 

 

Steer clear of solicitors....over £100 per hour and that money is NOT recoverable, pretty soon your costs are more than your claim. With a Small Claims case you pay a fee dependant upon the size of your claim....this money is recoverable if you are succesful.
