As my search for a pair of OEM rear spats for a Shortie came up dry, I decided to do some hunting on the Net.

 

I came across a US firm called Ionic Dynamics who, believe it or not, make replicas of the very spats I was looking for! :D

Emails were sent, prices were agreed and an order was placed. It got stuck in Customs for a few days and I had to pay an extra £18 to get them delivered. They arrived this afternoon! :D

 

Sooo... you can only imagine my disappointment and horror when I compared them to the OEM set off a LWB I have here and found that they're identical! :(

 

Yep, they seem to have modelled them off the 2+2 rears, not the Shortie ones. :( :(

 

I've sent them an email to make them aware of this but I'm gutted. If I'd known, I'd have saved my money!!

 

So, all in all, that was a complete waste of time and money!! Sick as a chip.....

So we have a conclusion that everybody is happy with. Good points that I see this thread has exposed are -

1 If you have a problem and you want to talk about it openly then you can if you stick to the facts and dont get angry

2 A fault in the description of a part on a website has been highlighted and now changed.

Also thankyou to FunkySi for helping out as a go between for the two parties and his offer to take the parts back with him to the US. Plus thank you to Jose and Ionic Dynamics in there refund and the way they seen what could be misleading on there site and updated it. (I hope you guys get a mould for the oem swb mud flaps as they are in demand.)

Mondo glad its sorted mate I know that you in your business sector are very much focused on customer care and expect the same from other business's so you try very hard to get your message across.

Just had a look through Jose parts, wasn't aware of the company before this. There is some really nice stuff. I particularly like the roof spoiler, very reasonable as well considering it's carbon fibre too.

Although this has been unfortunate it will at least of brought the company into the spot light for the club. We could do with more American vendors on board here.

Secondly, I have made no attempts whatsoever to "defame" you or try to coerce you into issuing a full refund. The purpose of this thread was simply to draw peoples' attentions to something that could well affect somebody else, and to seek opinions over my options. I've never slandered you in any of this, I've praised the quality of your products and I've been continually polite, courteous and avoided being overly familiar so as to maintain some professionalism. I don't appreciate being talked down to by a supplier, especially when I haven't done that to you, nor do I appreciate being told "not to cry" about being misled!

We will always be on opposite ends of the spectrum in our opinions and basic core values. I would never post private email correspondence without the other parties consent. It is the same thing as posting a private letter. For me it's not only unfair it's rude. Add to that the fact that we didn't even reach a resolution before you made your post, with my email replies. An informative post would have been very different, and my previous replies would have been different as well.

 

I've continued to mention my analogy because pictures seen do not necessarily have to be of the item a customer will receive. I'm not suggesting for a second that your website shows pictures that are unrelated to the actual product here, so please don't start thinking that - however the fact is that there are sellers out there who use that practice.

Your analogy implied that your customer received an item sight unseen based on your description, you did not.

 

You've mentioned my failure to do my "due diligence." Here is how I see it: when there are no part numbers and no multiple options, then an item's description is the key thing. I didn't stop to consider the possibility that your items could be moulded off the incorrect parts because your description basically assured me that that wasn't the case. I've explained how the SWB spats don't fit the LWB bumper so, when your description clearly stated that your items were moulded from genuine SWB parts and they would NOT fit the LWB bumper, then the obvious assumption to make (and not an unreasonable one either) is that they are replicas of the exact parts I was looking for!

 

So my intent to transfer "the blame" as you put it simply isn't so. The fact of the matter is that your initial knowledge and statements were incorrect, leading you to inadvertently market your product incorrectly, leading me to purchase the product based on incorrect and misleading information.

But there are different part numbers for the Nissan product that you were fully aware of and you knew that one design could fit both model variations, knowledge that you know fist hand based on your own experience. That is failure to exercise your "due diligence" to verify what version was actually being offered since the original LWB could fit both models. Our items descriptions are not only text based, they are image based as well

 

You mention your "binding returns agreement" but I'm fairly sure that doesn't (and shouldn't) necessarily relate to items that aren't what you described them to be, hence me looking for a full refund. Had they simply been marketed as "your version of OEM mudguards" then I'd have asked for more information before ordering. As I've continually said, I didn't ask for any more information because your description was so specific.

Yes they are binging and every single one of our order links and descriptions makes a reference to them. In our first section titled "MERCHANDISE RETURN - ORDER CANCELLATION" it states "Shipping is non-refundable". You as a buyer decide to do business with us under those terms. It's at our sole discretion to enforce them or not. Because the item description was not precise I decided to refund in full.

You're right - it seems that we will always be at opposing ends of this discussion. You have your opinion of what I should've done before I placed an order and I have my opinion of what you should've done before you replicated and marketed a product.

 

Your spats have been reboxed and are getting booked in this evening for delivery to Si - I'll drop him a line with the tracking info so he can monitor it's progress until it lands at his door.

Your situation would be a different story if you'd (for example) purchased something explicitly stated to be a LWB propshaft and the seller sent you a SWB one instead. You say you didn't check part numbers carefully enough, whereas I relied on an advert that clearly stated what the parts were and what original parts they'd been moulded from.

I quoted every chassis no, details, Japanese car etc etc, and specified a propshaft for a TT. Look what I got:

Because they never did TT LWB in the US, the only part he had for the TT was for the SWB. So who was right and who was wrong?

 

Nice guy, he offered to refund but shipping meant not worth it so I modded in UK. Result and I still saved money (as well as providing some laffs :D )

All my initial thread did was highlight an issue between myself and a supplier. I didn't go on a witch-hunt... I didn't defame you or say anything that wasn't true... I simply stated facts. There is nothing illegal, immoral or ungentlemanly about that.

 

If I, as a consumer, no longer have the right to air my experience with a supplier, then what's the point? Are you seriously suggesting that consumers can only comment positively...?

 

If anyone who's read this entire thread has decided not to deal with Ionic Dynamics, I imagine it's more to do with you posting deeply professional comments such as "don't cry about being misled" when your possible target audience are watching!

 

Throughout this entire debacle, I've maintained that the items I received were of good quality. So I haven't slandered your product quality in any way, shape or form. Your attitude, I fear, is the issue for 1Daveg... food for thought there, Jose...

I feel this thread has highlighted your site and a lot of UK 300zx owners have viewed the Ionic site and have liked what they have seen. Dont look at it as bad publicity far from it Jose it is good for you and your Company.

Mondo has highlighted his thoughts and you have responded ending up in an agreement between you both. So all good :thumbup1:
