in march i bought a car as my scenic caught fire on the way to work.

 

Yesterday as i was getting ready for work i heard a truck outside, knowing it wasn't bin day i looked out to see my car being put on a flatbed.

 

when i went outside to see what was going on i was informed that the car was sold illegally to me as it had money owed against it for a "log book loan".

 

Obviously i had to let the car go but this is not going to be the end of it. I have contacted ebay about it as the seller told me so much bull about it and i want my money back.

 

now i have printed everything off from ebay and have to take a trip to the local police station to report him for several criminal offences.

 

Just to top it all off i have just seen on ebay that the seller now has a rangerover for sale and it has bids over £10,500 so i have reported that as fraudulent as well. (the Fu***ng Wa**er)

 

Please beware of ebay sellers especially if they a called xxxxxxx

So sorry to hear that mate. There is a show on TV just now called Rep Man about this, 9/10 of the cases I saw on it were due to log book loans from previous owners, seems folk just take out loans right before selling on.

 

The bad news is one of the guys on it went through the courts and won but the previous owner then just said they couldn't afford to repay so the court let the previous owner offer to pay it back at £20 per month!!!! Sickening.

That sucks mate, but tbh technically they cant resposses the car.

 

If you bought the car in good faith then you own the vehicle, the finance is on the person not the car.

IIRC its do with the 1974 consumer credit act.

 

It was on TV last year, and all these places rely on people not actually knowing their rights.

I'm sorry to hear that Mark - and I'd be just as pissed of as you mate:angry:

 

You've done the right thing getting the police involved - but on what authority did the repo people have to take the car away from you? Sure, the previous owner had a log-book loan secured on it; but they were not collecting the car from him, they took it away from you! So they must have done their homework to see that you were the new registered keeper.

 

And I also believe they would need some kind of court order or warrant to take the car from you. I'd be taking legal advice right now with the view to going after the repo people - talk to the CAB; and check your house insurance policy as you probably have access to legal cover too. If so, it will cover your legal costs in getting your car back - they will probably put you in touch with their recommended solicitors.

All i know for now is the car was taken as it was the collaterol for the loan.

 

defo going to speak to CAB about it though, Just to find out about my rights and how i stand with it all.

 

reported to police and they put me in touch with Action fraud who deal with it all so they now have all the details.

 

going to speak to car insurers to as if anything happens to the car i dont want to be claimed against and maybe they can give me a bit more advice or help.

I suppose with log book loans getting more popular this sort of thing is going to become more common. Would it even show up on a Hpi check?

when i did the hpi check before it didnt show up. i have just done it again and it is showing.

 

I assume it was done just before selling so that is probably why it didnt show before.

No mate it was a cash on collection.

 

The guy has another vehicle on ebay for sale so i have reported that to the fraud people as well so they can always get him through that one as well.

From the show i watched they said its different to HPI, HPI is against the individual and they don't have the right to take the car but if its a log book loan then it stays with the vehicle not the person. The only course of action the victim had was to sue the seller...and as stated above they tend to say they can't afford to pay back and offer a small monthly payment that would take 3-4 years to pay it back.

 

A couple of times the rang the door bell and just asked for the keys, the owners weren't in and their children handed the keys over making the job even easier!

Having done an HPI check before hand may give you additional rights, I'm sure the HPI check means that the company verifying has some liability now, they may eed to give you compensation so I'd be pursuing that avenue immediately. Then I'd be paying the seller a visit!

I've never heard of a logbook loan! Although I wouldn't mind borrowing your logbook?

 

You get them from cash converters and the likes. 30,000 of them were taken out last year in the UK.

If you did an hpi check then they are definately supposed to give you compensation if the likes of this happens.

I didn't know log book loans existed. Scary as when you HPi check a car you assume it's clear but if you then leave it a day or 2 before collecting then they can go and get a loan after. Did you HPi it on the day or before?

 

If on the day then surely the liability is on the lender as there is nothing a buyer could feasibly do to prevent it....wonder how long it takes for systems to reflect the loans as if there is a delay then this could happen every time.

Most of them do but in the last couple of years the DVLA re-issued a red log book to owners. So there are still thousands of cars on the road with the original log book plus the new red one. The loan company is given one of the log books and hey presto the owner still has the original one to complete a private sale.

Yeah when I did my last one it definately said I would be covered up to a certain value if there was any outstanding finance on it.
