Ive just had my mot and it failed on worn tyres. I now have new tyres on so its in roadworthy condition now and will pass the retest. But. The mot expired yesterday and the earliest that i can get a retest is monday. I need to take the car to awesomefest this weekend.

What would happen if the police did pull me over?

Without a valid MOT certificate you have no proof that the car is roadworthy,and the cops will know you have no current MOT before even stopping you as it is all on the data base and the ANPR camera`s will alert them.

 

The only time your covererd to drive without a vaild certificate is on the way to a pre-booked test or retest by the shortest route.

 

I know all this because I watch police interceptors! :D

Technically you can only drive to and from the garage to have the car re-MOTd.

 

Whilst it may now be safe to drive, the MOT has expired so it is no longer legal to do so - you can of course at your own risk. HOWEVER your insurance will no dount be invalid if you have an accident - and driving without insurance carries big penalties. Personally I'd not take the risk.

 

Make the effort to get the car back to the MOT garage ASAP so that you are legal.

Ill have to see if i can get a cancellation at the mot station or something. They say there fully booked, but i find that hard to believe, especially to fit in a 5 min inspection to see that its now rectified.

Unfortunately, even though you are an upstanding motorist who has got his car fixed there are many who do not and will flout the law, the cops have to draw a line some where.

 

As Richard said its a grey area and not worth the risk, image a simple rta like running into the back of someone, your insurance would be void the cops would do you for no insurance and no mot, what a mare that would be.

If its so important to go to awesomefest this weekend and the mot station can not do the retest and you are confident that it will pass the MOT just go to another garage and get the MOT done there

All right it will cost you for the test again but hey if awesomefest is so important to you it is worth it

God forbid you have an accident, do you really think you're insurance are gonna cover you with no MOT. Just not worth the risk....................

i know. im just gonna ring the mot station till they see me. cant afford another test. ive planned this trip for months and budgeted for it. Cant miss it :D

What happens if you need to take your car a different garage to get it repaired for mot?

Ok just to clear this up, insurance companies are not allowed to invalidate your third party insurance, only your "self-insurance", i.e. if you have an accident with no MOT, they simply will not pay out for the damage to your vehicle, the police will not do you for driving without insurance just because you have no MOT, purely because, the insurance companies are not legally able to invalidate Third Party Insurance without 7 days written warning, and that applies for ANY reason. As for the police, they'll slap you with a £60 minimum fine and will probably inspect the vehicle, if you happen to get one of the coppers that is a trained MOT tester, he'll likely confiscate the vehicle and give it a thorough test, possibly more so than an actual MOT tester will, if that then shows the vehicle has something that isn't road worthy, you'll get points for driving a vehicle that isn't road worthy, etc.

 

Long and short of it is this, it's your choice, the police MAY be lenient if you get a good copper on a good day and you show him the fail cert proving the only thing that failed was the tyres and they now have 8mm of tread on them etc. However you're far more likely to get a robot, who will simply fine you and issue you with a notice to say you cannot drive it on the road without an MOT, which then means if you do drive it anywhere other than home or the MOT garage from that point on, they can crush your car if they so choose.

 

Basically you'll be breaking the law, albeit a technicality law as the vehicle is now road legal, you're better off taking it to another garage for the sake of £30 - £40 to get it tested or waiting until you can have the free re-test. Personally I know how annoying this kind of stuff is, but the law is the law, until it's a civil matter! :D

That's not actually true, it's a myth, you are allowed to drive the vehicle to a pre-booked MOT or to pre-booked repairs FOR the MOT, you cannot however drive it anywhere in between and it must be the most direct route from point a to point b. You also cannot have a car which has failed an MOT and drive it to a garage for upgrades or repairs which were not subject to the MOT, UNLESS that same garage is also doing the MOT repairs at the same time and the appointment was pre-booked.

We said very different things, perhaps I didn't clarify.

 

Sorge said you cannot drive it to a garage for repairs, you can, but only if the repairs are FOR the MOT, doesn't even matter if you drive it home again and then drive it to a pre-booked MOT later, so long as the appointment for the repairs is booked, and is for repairs that pertain to the MOT, you don't actually have to have an MOT booked at the same time. Occasionally repairs are spread out over time, or have to be done in stages, etc. the law allows for this. HOWEVER, this is the one kicker, the vehicle must be in a roadworthy condition :D HA!

the fine for driving with out an MOT is £60, plus you will need to produce an MOT with in 14days, or you could try your luck in court.

 

But adding it up, £60 fine plus MOT = £115

Getting another garage to do the MOT = £55 (or what ever the current test is at as they seem to keep changing the damn thing)

Hollowpoint is correct , for work I used to have to drive a fair amount of mot failure cars to and from mot stations and garages, all legally.

 

And its all on the Back of the mot failure sheet !

 

It is generally an offence to use on a public road, a vehicle of testable age that doesn’t have a current test certificate, except when:

 

* taking it to a test station for an MOT test booked in advance

* bringing it away from a test station after it has failed the MOT test, to a place of repair

* taking it to a place, by previous arrangement, where problems that caused the vehicle to fail its MOT test, can be repaired

* bringing it away from a place where the problems with the vehicle have been repaired

 

Even in the above circumstances you may still be prosecuted for driving an unroadworthy vehicle if it doesn’t comply with various regulations affecting its construction and use. Your car insurance may also be invalid.

 

 

The distance of where you can take it to the mot or garage is a bit of grey area though. There are no detailed rules.

As much as I hate to say this, and I am by no means advocating it at all, but I have to be pedantic and point out that the fine is £60, if he produces an MOT within 14 days, that fine may well get reduced I don't know? But either way, if he's got 14 days to produce, he won't get the fine + a new MOT cost, he'll just get the fine and have the free re-test.

 

Personally I won't break road rules, sure I've accidentally crept over the limit and back down again from time to time, but tyres must have tread, car must have an MOT, must have Tax, must have Insurance etc. etc. etc. because my license and my car mean too much to me. Places like NZ where you just get a fine for that kind of stuff, and that's if the copper is in a bad mood, the roads are much less safe places out there believe me!

 

Get your MOT sorted, don't drive without it, it's just not worth what could happen if you get one angry cop on his period and the only thing stopping you getting the MOT is £40.
