Car has been recovered :D :D :D :D :D :D

 

 

Guess what! Just got a call from the police and they found my CAR!!!! ITS A MIRACLE!! It was found on rivenhall Gardens near Epping forest E18 area in a car park next to a house o.O, i am very surprised at how the police did nothing watsoever to secure the car, they just rang me to tell where it was and left it there!!. Unfortunately when i went to pick it up i can see some serious bumper and side wing damage as whoever took it for a joy ride was a new driver. Random but there was a fire extinguisher and a 1.8 carat diamond holder stating a price of £2150:w00t:, *******s also sprayed the car full of the powder from the extinguisher too :S. Really pissed of with the damage but the garage who lost it has agreed to repair and do all work for free. So right now i am thinking abot how to proceed. I am amazed that the police even found the car so deep in a block of houses/flats, i think someone might have reported the car. Also 20% of the other cars i saw had broken glasses no surprise there at all. Seems they only drove just under 30 miles till the petrol was about to finish and they couldn't probably afford to put more in. Also the passenger side window was pushed down and then they broke the key insert, so had to start it with a screw driver myself!!

So if anyone has a OEM UK SPEC front bumper do let me know, was smiling from ear to ear driving it back home :D

Hey Guys,

 

I need some advice, i gave my car is for some work to a mechanic yesterday. He rang me up today saying that he parked the car on the road and that its gone!!!!:cursing:

 

Firstly i was pissed of that he would park my car on the road cause he didnt have enough space in his garage and worst of all he is trying to say that he is not liable. When clearly the car was left in his care and is his responsibilty to keep it safe. :mad:

 

What do you guys reckon my options are and is it worth taking it legally??

Tell the Police immediately they may still be able to find some tool driving it around, and is deffo his responsibility. You should be claiming against his garage's insurance for the loss

Ask him for the Keys and you'll probably find he left the keys in it..... either an inside job or gross negligence.... Sue Him !

what a dick... of course he is liable, go to the CAB and get some free legal advice.

I've been in the same spot as the garage is, had a 2001 Mondeo stolen from my workshop, after they broke in, they got the keys and used it to shift stuff, at the time my traders policy would not cover for outside so I had to pay it myself, after all, it was in my possession and my responsiblilty whilst having work done to it, so he is really in the same position and should sort it

Well they could have thought it was the mechanics and snatched it, but they do have a V5 so it probably isn't....

yeah garage is totally liable, the fact he's being so defensive makes it sound like an inside job,

 

my poor zed was stolen in jan last year, they stick out like a sore thump particularly in London, so if they are stupid enough to drive it it may turn up on a camera.

 

as long as it doesn't end up like mine probably did broken for parts or sold abroad...

Well i asked him and he is refusing to pay, keeps saying it isint his fault, i get a feeling he doesnt even have traders insurance or something. So i need to seek some legal advice now, well pissed of with the whole situation. Yeah i am going to call the CAB and ask whats the best way to take it forward!

 

He had the keys when i went to see him this morning, so i got the keys off him as well. I doubt it was a inside job as a lot of my friends go to him to get work done too, but nevertheless he still should pay out for it.

 

Anyone here who is a solicitor, need opinions from a legal point of view??

Oh mate i cant believe that has happened :(, i hope you get it back!

Mate we need as much detail about the zed as possible, any aftermarket parts that stick out, reg number, and colour, what it had on it.

As we all look on sites for bits, whether on here on ebay. Might show up something, more eyes looking out for it the better. Hope you get it back, but definatley the garage is to blame.

i'd go to the CAB , when i some problems they were really good and won't cost you , good luck

the garage is at fault! and its completely ridiculous that they try and deny it. like KJZ32 said, when it happened to him he sorted it.

This is aj's zed its a UK black zed the only thing that sets it apart from others is the alloys

As well as the CAB I would consult your own insurers; they will have direct experience in dealing with this kind of thing. Their own legal team may well pursue it as an "uninsured loss" for you.

Quite right Richard, I agree.......and the people who stole it, small minded idiots that cannot stand anyone having something they haven't got.

IMHO, the garage is liable and was wholly negligent. I'd also go along with what's been said already in getting advice through your own insurance company - that's what their legal team is for.

 

CAB would be my second option - end of the day it's just a volunteer service (I used to work at one) so they won't have as detailed advice as your insurers will in this matter.

Owning a garage myself I would have to say the garge is liable the car should have been kept inside unless he told owner that this was not going to be possible and would be left outside at the car owners risk given him the option not to leave the car ,sounds to me like the business owner does not have any cover apart from possibly road risk a lesson all owners should learn I am affraid, a reason some garages can be cheapper is they cut there overheads and insurance is a massive one ! the only people that suffer then tend to be the customer !!!!

they way i would see this is that if you left the car in their care then they are liable. just call the police m8, the garage are obviously going to be no help. and please post the name so noone else suffers the same fate

Well you will be able to claim on your own insurance, it shouldn't be invalidated by the garage having the keys, especially since the keys weren't in it when it was stolen.

 

As far as the law is concerned, if you haven't signed anything to say you were responsible for the car while it was in his possession, then to my knowledge he's legally liable for the responsibility of the car.

 

As for his insurance, he must by law have all the various applicable liability insurances, including public liability, which covers damage or loss to others through his/the companies actions, one way or another, he's got to be covered to sort you out, if he isn't, he'll be closed down for not abiding by the law. He should also have a traders policy and being a garage where vehicles do get left by the owners, that policy should cover the vehicle being stolen from his possession.
