Hi guys, can anyone give me a fairly close idea of redline speed in 2nd for an auto n/a ?? Trying to fight a speeding summons. Caught by motorway cop whose camera was defective so his word against mine.( said I was doing 94, but summons just says exceeding motorway limit) My box was playing up at the time and was stuck in second. Engine off and when restarted has been fine ever since. Thanks guys.

If its his word against yours, i would stand your ground and deny it. Without proof they dont have a leg to stand on, they are relying on you coughing up and holding your hands up.

They cant even prove you were speeding excessively, unless the patrol car following you has a speed log, if he wasnt following you and just had the defective speed gun, then happy days

And lets be honest, are really likely to have been flat out in second; bouncing off the rev limiter? Doubt it.......

 

If the officer has no hard evidence (video/camera etc) then say you'll challenge it in court. If they can't prove you were speeding they will just back down before it gets that far!

Hiya Graeme and Richard. The cops camera showed my back end, but blank grey box where it should have shown my speed. He quickly turned it off and then gave me a lecture for half an hour and made out he was being kind and only giving me a fixed penalty when he could have sent me straight to court for doing 94mph. I took the fixed pen. notice and then sent back the section that said I wanted it to be heard by a court. Nov 30th that was. Dec 22nd he wrote his statement and I got the summons on Sat.just gone.

Thats fine, go to court, he can state what he wants, but without the vital evidence it wont hold up. Unfortunately you got the court summons because you, wanted it to be heard in court, but there was no other way this was going anyway. You either pay the fine and except liability or go down the road your taking, no brainer.

 

Even though it will be a straight forward case, i would advise a solicitor to represent you rather than representing yourself. The judge or prosecution can twist things in their favour, as you are not aware of the points of law, like a solicitor would.

 

I only know this as i got done a couple of times in the last 7 years for my van being overweight. The copper got all the calculations worked out wrong and with a good solicitor i could have had the case dropped, but unfortunately i represented myself and the judge decided to work out what the weight should have been had the copper got his maths right, bummer.

 

ANy way good luck with it, i wouldnt lose any sleep over it

By the way, if you get a solicitor, get one that deals with highways law, the run of the mill ones wont do you much good, or you can get a court appointed solicitor on the day, most of the time they will have dealt with numerous driving convictions
