Here's a scenario:

Bloke gets caught for drink driving (2nd offence) and gets a 3 year ban. After ban buys car (crap) and pays huge insurance for two years.

By this point it's 5 years since the crime-does he no longer have to declare the offense when insuring or is he bound to declare it forever?

Does anyone know the actual (factually based) answer to this rather than opinion?

Not too sure mate, the questions asked when applying for insurance are:

any accidents claims or convictions in the last 5 years?

and you are also asked if you have ever been disqualified or refused insurance?

since he was banned for 2 years i think that he would have to disclose this at this point, or else insurance would be invalid, and i guess if he had no accidents or anything then no problem - but if he did, i am sure that the insurance company would use this as a breach of contract, and would then not pay out in event of a claim, and subsequently he would be done for driving without insurance.

This said, it shouldn't effect the actual premium. The ban can be completely removed from license in 11 years.

I think thats right, my brother is an insurance broker so i'll ask in tomorrow.

you must read the questions thoroughly. I have a copy of my last application and the question is "Has any driver ever been convicted of a criminal offence......."

Your answer must be yes.

You know the reputation of insurance companies, we think they only need a little excuse to avaoid paying out.

Just hope he's learnt his lesson as theres no exuse for drink driving, third times the charm just hope he dosent kill someone this time.............

That's what I thought too, surely it has to be disclosed for life.

I would appreciate that mate

if you do it via confussed.com or something like that sometimes they dont ask to many question. or you could take a risk and not declare it.

some companies like elephant will do a dvla check on you whislt your on the phone they phone dvla and confirm all offences if any,

every company does it differant but i would have thought 5 years youll be ok.

i work in insurance.

question is any convictions in the last 5 years.

you could have had 3 DR10 convictions, as long as the conviction date is over 5 years ago, will make no difference in premium.

One thing though - a drink driving conviction stays on your licence for 10 (or 11 years); not the usual (*) 4 years like with other offences!

Plus I think that DR penalties are from the date of conviction, not the offence. And it's a criminal offence; not just a motoring conviction!

* I know that points are only valid for 3 years but you cannot get them removed from your licence for 4;)

I have something to say............ It's better to burn out than to fade away..... :tt2:

I just received a letter from the cops saying all my charges were dropped, they basically were trying to do me for drink driving after a crash, but was I arrested 4 hours after the crash, I'd had the car recovered, no-one else involved, etc. and had a couple of whiskeys when i got home. 8 hours in a cell and 1 and a half in the interview room, load of pish, did nothing wrong but everything right, but with the coppers it's all about statistics and not justice, they were trying so hard to do me. Been on bail for 10 weeks, not been able to afford insurance as i had possible convictions pending, etc. etc...

Basically, the moral of this story is coppers are turds. Sorry for the thread hijack buddy :-)
