Hi,

 

Just a couple of things I want/need to know.

 

As I'm disputing the quality of work done on my respray, do the garage have a legal obligation to keep my car safe and secure untill it's resolved?

 

When a bodyshop paints a car, after the paint has dried do they normally polish and wax the paint?

 

If parts are missing or broken, do they have a duty to supply new parts or can they just give you secondhand ones?

 

Sure there's more but my mind has gone blank will all this crap :(

they have to make sure its secure, they usualy polish and wax it, and for 4.5k i would want it valeted and served on a silver platter

 

if parts are broken they should replace, not sure on the second hand or new

I assumed they normally polish and wax the car but believe it or not, they told the original garage that I should wax it to protect the paint!!!! lol

To be honest, I think you need to get some legal advice... can't imagine there's any obligation for them to keep it, and it's probably in their terms that it must be collected within a set timeframe... from what i understand of what's gone on, you need to sue the original garage anyway as your contract is with them, not the last garage... they can then choose to sue the final garage... or not pay them!

 

as for missing parts, again, it will probably be contractual - but you can sue the original garage for the cost of new parts and negotiate down if necessary.

Really don't know where you stand... try calling the CAB for some advice: the 'good' (and I only use the word for want of a better one) is that if it's the preparation that's mainly at fault, they will find it difficult to say that you have caused any paint defects... you basically need to ensure that by taking the car back, you aren't confirming that you are satisfied - i'm sure a solicitor/ CAB would draft a letter to that effect, then the ball's in their court.

 

One word of advice - don't be afraid of issuing county court proceedings... it's really easy, pretty cheap and, even if you come to some arrangement, it's always there a a back up if they don't come good...

Mate, that's my next step - small claims court! I've really had enough so am taking control of the situation where I can ;)

Cheers bud. It never shocks me how far some people are up there own backsides!! I can't get my head round how they think it's a top notch job.

 

I'll hopefully know more over the weekend when I hope to have a painters opinion on it :)
