Had to go to court today for a minor driving offence.......that took an unexpected turn...

 

Just as I was about to get told what fine/points I was being given the Court Clerk interupts to tell me that "I" have been Disqualified from Driving since 4th January for Drink driving and no insurance....WTF....first time I've ever heard of it !! :eek:

 

Apparantly I was caught and convicted on same day and I even attended court !

 

I was in shock!. Never been so much as breathalised before. The Magistrates seemed to believe me but said they can only go on the information they have and have adjourned the hearing till end of the month.

 

In the meantime Im disqualified from driving and may be facing a prison sentence for driving while disqualified.

 

What a mess !! Either there is a serious admin f*ckup or my identity has been stolen !

Oh dear that's not good mate.

I hope they can sort it out quick but knowing what they are like it could be a nightmare.

You would think the court would realise it was a big mistake with the last offence, seeing as Im 28.

 

Im about to phone the Court that did the sentences, Police station and DVLA....

Had a similar problem a few years ago for not producing, Therefore no mot, insurance and license, They came and arrested my in the middle of the night and transported me from Bury all the way to Skegness, eventually got it sorted out from signatures given to the police when the offence occured and signature on my driving license being totally different...and I got a free ride back. sounds like someone has stolen your identity at some point mate

underage? i was 19 when i got that so i doubts it anything to do with age, i know it is to do with not having a full UK driving license whilst driving.

It's got to be stolen ID.

Knowing what the courts are like from a few minor motoring offences that they have managed to make a complete cock-up of I bet they will leave it entirely in YOUR hands to sort out with a solicitor at YOUR expense.

 

I had 6 visits to court over a fixed penalty "using a mobile phone" offence when stationary which I was given at the same time as a "driving without insurance" court summons which was all a mix up with paperwork.

I shouldn't have been charged with 2 offences in one stop and they should have been dealt with together but because I was facing 9 to 11 points in one hit and disqualification I had to go to court.

6 days off work and £600 in solicitors costs they admitted I had insurance and shouldn't have been given the fixed penalty either.

After all the confusion the DVLA messed up and gave me 3 points for driving with no insurance which is a 6 to 8 point offence!

I've still got the 3 points on my license and had already paid the fine.

Should never have had to go to court.

Had a chat with a clerk at local Police station....she told me she can see straight away on the system that it was'nt me and that the endorsements had been applied to the wrong license and put me through to DVLA who told me that they can see whats happened but cant do anything until the courts instruct them...

 

so now I got to phone the courts...

 

 

would'nt give me any details....was hoping to get a Registration number or something from them :( They all know details of the case But cant tell me

so an error by the fookin DVLA can cause all this worry and upset.

Hate the DVLA, especially the way they flog your details to private companies for 2 quid a shot.

 

Just shows how low on their agenda public security is!!

been on phone to the courts now (different court to the one I went to today) and they tell the person gave my name and address at the roadside but different D.O.B, and then when in court they must have been caught out as they gave a different address and D.O.B but somewhere along the line it was'nt corrected with DVLA so I ended up getting the endorsements.

 

Thing is that its my old address and I had'nt updated my address with DVLA since I moved last year.

 

So some f*cker was pretending to be me :rant: ......racking my brain -...depends what LC20 means exactly would give me some clues...if it means they were underage then I got no idea...otherwise I got my suspicions ! :mad::mad:......:rant:

Yes if you have to go back to court mention you've lost a day or 2's work because of being unable to drive and had to pay for legal advice and they will take that into consideration ;)

Maybe it's just a genuine DVLA mistake on the computer where they gave you the points instead of someone else with the same name?

Might not be identity theft after all.

Feeling pretty relieved now that somebody has recognised the problem. Thought I was going to have to deal with a legnthy Court trial and solicitors.

 

****ed off that it looks like somebody has pretended to be me and caused all this agro though....and Im still technically banned till DVLA confirm otherwise, and I still got to go back to court for my original hearing becuase of the adjourment instead of that being over and done with. :rant:

I don't want to put more stress on you, but I'm sure you need to notify them within 30 days of change of address. I may be wrong.

yeh, I was given a bit of a telling off for that :x: but no further action on that I dont think

court have kept hold of my license becuase of this mess....so I wont be able to go on the Track at Castle combe this weekend for the action day event :cry:

Id love to say i was suprised to hear this, but im not. Its the court system all over. Complete waste of time, infact not even half as usefull as a chocolate fire guard.

Only a suggestion, was the house you lived in before rented or sold by you? and if either was it empty in between you and someone else living in it? this is a little know erea for identity theft

I had a similar thing a few years back. Was caught speeding in my ford fiesta and had a court date sent. I have never owned or even driven a f##kin fiesta luckilly it was straight forward to sort out but was still stressfull as I didn't know what was going to happen
