I was driving no more thaN 2O MPH at bout 1pm today when a girl reversed out of a parking space causing me to spank the rear right of her bumper. i quickly ran after some young bloke who seen it and asked him to be a witness i took his number.

 

when i got back to the scene she was shouting f'ing and blinding, she wasnt happy.

she said why wearnt you looking where you were going couldnt you see i was pulling out??? What the fook???

she said its not her fault..... has she gone mad?.

i asked for her deatails but she wouldnt give me them and atempted to drive off so i had to stand behind her car to prevent her from getting away. at this point i rang the police, and vola she started to co-operate. i handed her the phone to the police she said it was my fault. but i had already told the police she tried to drive away and it was happening while i was on the phone to the police.

She eventually calmed down and we swaped details.

she said she had just sold the car and was buying a bmw and that this would mess up her insurance. AH now i see.

she offered me 100 quid to call it even. has she gone insane? thats not guna cover it. I said its guna cost more than that love. So i said il get a quote and let her know the damages and she can decide to go through insurance or not.

 

Ive been to my friends garage and he said it would cost £350 to get it sprayed. he then said if it was to go through insurance it would be priced with a new panel. which in total came to 185 for paint and 360 labour.

 

So its up to her whats shes happy to do.

i tried ringing her an hour ago to let her know the quotation but i left a message.

im so annoyed why cant people just admit to being in the wrong.

she knows it. I can see this one being a very long process.

 

When i pulled of it was obvious what she had done as my tyre was rubbing on the plastic cover under the arch, i had to get out and bend it back.

 

oh and guess what her name is????? TRACY

but i have right of way no matter which way she pulls out she has to make sure the road is clear before attempting to pull out correct?

how many times have you seen someone attempting to pull out and you drive past?

what if that one day you see them and they just shoot out like they have a force field around their ass?

Was it on a main road?? if so then see is fccuked and you would have nothing to worrie about :D

Thought id keep ya updated on this crap....

Ive been on and off the phone for months now trying to sort this out, because im TPFT my insurance dont deal with the claim directly and another company called car crash line are dealing with the matter, fine.

Its taken months just to get a witness statement back to them, the witness was not a problem he has been very helpful and has up to now filled out 3 forms 2 of which were lost misplaced or just disrigarded by my insurers and car crash line. To be honest ive been doing most of the work myself. ringing my witness, my insurers, having the statements emailed to me, delivering them personaly to the witness, photocopying them and having them posted via royal mail recorded delivery, the reason for this is because i have posted 2 forms both of which the insurers say the have not received which is *****x coz i posted them myself so now im making sure i have proof by using a recorded service and have emailed a scanned document also, as it seems my insurers couldnt give a rats ass, they are just interested in ya money and once they got it they dont give a damn. They also said that the claim is closed until they hear back from my witness and that i should take it up directly with the other parties insurers. WTF isnt that what my insurers are for? God dam it...... grinds my gears i tell ya.. and the worst part is, it stills goes down as a claim wheather or not an agreement is made..... GRRRRRRRR

 

Oh hears another piss take.

My insurers sent me a letter saying the third parties insurance had contacted them because id been harrassing the other party and advised me to stop imediatly or the police would be involved WTF ahhhhh. What a bunch of lies id only texted tracy once to say i was contacting my insurance and thats it.

 

Anyway, now the scanned witness statement has finally reached the ****ers and they are forwarding it to the third party. Lets see what other excuses they can come up with now.

Yep going thru exactly the same as you, sent forms loads of times etc which havent arrived, to get 2 letters saying its our fault...:headvswal then they say the havent admitted it, now getting letters asking why my car wasnt named on insurance, its been on there from the start cos opened policy with it makes you :hurl: such complete tossers, dont know what they are doing and they have paid matey for his bike to keep him out of a hire car, then telling me not admitted it...its an absolute joke:rolleyes:

Have you tried taking it to the ombudsman/FSA as a complaint mate

DON'T take this the wrong way Jim but if i was you i'd be on the phone to them now saying,,,,,,if you dont get this sorted within the next 2 weeks i WILL be taking you to court, just feed them full of s**t the same as they've been doing to you, you need need to pester them as much as you can.

I know what ya saying mate, il give it a couple weeks for them to fix up now that they have the witness form. If nothing then il do as you say, but i might just contact the other insurers myself.

Im gunna ring them in a minute and ask if they recievd the witness form i sent via royal mail recorded coz they only have the scanned one at present. If they so no then i know they are lieing as i tracked the mail and it has been delivered so lets see them try and lie out f this one ;)

the same as a banking ombudsmen really, deals with all the complaints and gets it sorted, he's like the law i suppose.

there are 2 ways it can go from there... your first option is to go directly to the omstellasman... alternatively, you can bypass him straight to the top to the umbongosman in the jungle. if you get no joy from there you may aswell give up as the next hierachy up is the russian mafia... sorry to break that news.

I just checked with a road traffic officer mate of mine.

 

If you hit anyone while revercing it is YOUR fault unless you can prove they where traveling so fast there is no way you could of seen them comming taking all reasonable care while manouvering. His words not mine.

 

All reasonable care means, if you spot someone while looking both ways all teh time you must remove the car from their line, think back to passing the driving test. When reversing round a corner, if you saw a car, what where you REQUIRED to do?

This is pretty much the same damage that mine suffered when a little old dear did an emergency stop in-front of me at a clear junction.

 

Cost me £40 for a 2nd hand wing and £150 to spray it. Plus I had to spend a while correcting all the bent support brackets for the wing/spoiler.

 

There`s a little plastic thing right at the front tip under the wing with felt type padding on it. The fixings on mine snapped. Had to glue it back together.

one good thing is that the bumper will be fine as its polyurethane so it springs right back into shape.

 

I'd just go on and get a wing sprayed then fit yourself. Plus it gives you chance to look at anything under there and sort it - which the body-shop wouldn't touch.

You can't ask the insurance person if you can speak to the ombudsman as they don't work for the insurance company!

 

The FSA is the Financial Services Authority. They look after all financial services. They charge the insurance company like a grand to simply look in to something straight away and that just goes up and up.

 

Most companies will have different stages of complaints starting at level 1 which is the people on the phone that you speak to.

Level 2 is normally a manager / high level complaint handler

Level 3 is normally customer relations etc and within our company they can offer compensation etc if need be. These are normally customer relations Department.

 

The above is how my company works however different companies will do things differently. I would follow the complaints route by speaking to a manager. If your still not happy I would ask the manager what their next steps are, so who is higher up the scale to them.
