I had a new customer (member of the public, not a business) pay me (Limited company) by cheque for a job last week. Cheque has been returned to me today marked as "Stopped" :rolleyes: The customer seemed very happy with the work carried out and I've heard nothing from them since. I've also been charged 4 quid for the privilege!

 

It's not a great deal of money but it's the principle as far as I'm concerned. I've called and left a message on her answering machine this afternoon.

 

Any (sensible!) ideas on the best way I should handle this?

Might be a genuin mistake, she may have forgot what the cheque was for and stopped it, or was ment to stop another cheque and stopped yours by mistake.

 

These things happen now and then, give her a chance to explain.

I'm hoping that it's a genuine mistake guys. Gut feeling says she's pulling a fast one :( I forgot to mention that the cheque is from a NatWest "Student Account" :rolleyes:

I thought you ment she was a limited company until I read student account. I was going to say i'm sure it is ilegal for a Ltd company to issue a cheque if it doesn't have sufficient funds so must have a bonifide reason. Then realised your the Ltd Company so this was a post whoring post.

She only lives 5 mins away from me so I'll keep that option in reserve. Will wait to hear from her first though...

It's been returned as "Stopped" not "refer to drawer". This means that she actually called the bank to place a stop on the cheque as far as I understand... :(

if your customer’s cheque is not honoured or is stopped by the customer (for example, because they are unhappy with the goods or services you supplied to them), you can immediately sue the customer and there is virtually no defence that the customer can raise to that claim. You can claim not only the amount of the cheque, but also interest on that money and payment towards the costs you incur in chasing up payment

If they issued a cheque knowing the funds were not in the bank then its a theft charge they are up against? Some people write a cheque knowing the funds are not there and cancel it thinking it wont get to the bank. Its still called theft. So you can ask the bank if the funds were there when the cheque was issued. If there wasnt you could pay them a visit and let them know you intend to take the matter to the police.

I think she is skint. IMHO.

Used to work on a market stall selling tools etc and always had people writing chq's with no card, business account chq books etc etc. As i was only young, i'd usually be sent to follow the buyer to thier car and take down the car reg no. If the chq bounced they would be reported for theft as it is actually an offence to obtain goods by deception.... That'd be my route if you have information. You could always contact the bank if you're with the same group and your manager might assist?...

Panic over - she called this morning, very apologetic and explained that she hadn't used the chq book for ages and the whole book may have been cancelled. She has offered to pay me cash today including my bank charges :cool:

If she is fit you could explain how you would accept payment by installments in kind over a period of several weeks. Only because you are trying to help he financial situation of course!

You should of got them to put chq gaurantee card no. on back. then they cannot stop it.

If it was deliberately stopped then it is a criminal offence, obtaining goods or services by deception, police matter: you can use this to get her to pay up or go to police.

Good news - just been to get my cash. Funny thing was, another girl answered the door dressed in just a t-shirt and told me that her sister was in the bath! I had to hide a smile as I thought about Mark's suggestions above :rofl:
