not me but a friend wants to go but had a CR and i told him he needs to apply for a visa, but he said he is thinking of risking it and just going without a visa will they find out

dont u need a visa to get in, will you not have to produce it with your passport.

 

im sure my mums mate did it and got banged up for it!! so not worth it imho

they wont let him out the uk without a visa for the destination .... they check everything before you leave

drugs.violence,terrorist activitys must be declared on the "visa waiver" form and this visiting visa lasts 90 days if you want an extended stay or live and work then you would be very lucky to get in with a criminal record imho

Normally 10 years after conviction for minor offences and 20 years after for more serious ones (that could be tried in the Crown Court).

 

so if these apply there is no need for a visa then?

does it not go on the severity of the crime? i mean fishing without a licence is a criminal offence

if hes going for a visit and plans to return within 90 days then he can go without a visa and fill the visa waiver form in on the aircraft,if hes says nothing then they wont know about his cr unless it was incured in the usa then it will be on a database. no one can travel to the usa without a return jorney ticket or further onward travel out of the usa unless you have a visa to stay more than 90 days :)

No matter whats said, a criminal record NEVER gets removed.

Agree with BigKim here. Criminal records never get deleted but unter the Rehabilitation Act you don't have to declare them after a certain period.

 

Dipone, if I was your mate, I'd be honest - better to be refused than end up in American prison.

This is a fact. But it was 15 years ago. If things have changed then ignor me. My mate went to Tamper bay in Florida to stay with some biker friends that had left the UK to open a British Motorcycle outlet there, some 5 years previous. He got as far as Tamper Airport and they refused him entry into the country because he had a small but obviously significant criminal record here. He ended up waiting for a return flight and had to remain within the airport for about 48 hours before they could fit him on a flight home. Not a nice experience at all. He was issued a visa but the yanks dont have to allow anyone entry if they dont want to. Even if they dont like the look of you they can send you packing.

I think we could learn a few things from Uncle Sam in this instance :cool:

 

A friend of mine overstayed her 90 days by about a week. The next time she went to the US she was denied entry and sent home on the next plane. A bit harsh maybe, but at least they stick to their guns...

one person has a record from about 15 years ago for kidnap (he's a twat and broke up with GF her family wouldn't let him see the kid so he took him :slap: ) and antother person has a record from 30 years ago. i'm just not sure to what exstent you have to say you have a record as i have put above, it says after 10 years you dont have to say you have a record for minor offences and 20 for more serious. so would you say in the instances above

Thats just a civil offence, same as speeding. Not a Criminal Offence

no - it is a criminal offence!

Even though after 10 years you dont have to declare an offence as it is then classed as spent. The record stays with you for life. They can not use it against you its there like a scar on you charactor.

When my mate went to tamper he was issued a visa mate. Like I said it wasnt until he got there that they turned him away. I think its down to the descresion of the customs office at the time of arrival? Sorry mate I cant help any more than that. It might be worth him ringing the american embassy and asking them before he dares to go?
