some fvker has owed my a sum of money £5000 for roof work done nearly 9 months ago and refuses to pay,hes now telling me hes on the dole but ownes the house that hes living in :mad: can i put a charging order on his asset and would it incure intrest iff he never sold the house for a while. the county court aint no good here because he.ll take the pisss and offer £5 a week with now claiming dole :headvswal

im sure the court pays you in full and they take it from him at whatever he can afford, go to your local citizen advice bureau

tried it rich :( hes made a harrasment complaint to cops,i have a couple of handy lads begging me for the debt but i just dont need old bill knocking at door right now

I know this is a bit obvious, and I am not an expert, but was he on the dole when he got you to do the work? Because if he was - he effectivley bought something knowing that he couldn't pay for it. Isn't that theft?????

Personally I would pay £50 to a solicitor and get some good advice. If he owns the house then he has the means to pay and the court might take that into consideration, as it is more won't pay rather than can't.

Even if he is on the dole, someone, somehwere will lend him the money against him property so I wouldn't rule the courts out that fast. But thats just me.

You need to talk to 2 people.

A debt collector.

A lawyer.

 

You will find it might cost you a couple of grand to get he money from him through court, but talk to a lawyer first.

 

If you know of a debt collector, then they may be able to offer you alternative advice.

mate of mine who fits windows has been done a few times!! last time was last christmas, fitted £4k's worth of windows and when he'd finished and went for the money the guy just said "sorry bud spent the money on presents you will have to take me to court for it" smiled at the guy and slammed the door in his face :mad:

 

Worse thing is he cant spent the time off work to take him to court and he cant go on his property to rip his windows out so he just walks away.

 

If it was me i would just rather smash al the windows or roof, what can he say?? he hasnt paid you so its yours ;)

it costs money to chase money all too true...but if anyone here wants any help with this sort of issue get in touch as i have a debt collection and debt counselling license and lots of experience in the debt/credit industry....i cant promise to make everyone a winner when things go wrong but as i'm often saying you dont get what you deserve you get what you can negotiate

I'd put a claim in on the small claims track. A solicitor is just going to cost you money which you won't be able to claim back from the guy. Then get Uno to send Papa Lazaru round to negotiate with his army of wives and peg bag.

only problem with small claims in it costs you 10% of the claim to put it through court and in my experiance of small claims they tend to move in favour of the party owng the money, and as posted above the court do not pay the money until it has been paid to the court in full so could take years to get it back.

10% sounds about right but the cost of claiming are added to any successful claim including solicitors cost but those are limited @ £70 per claim...you can add and charge interest of course...so not all bad :)......but the maxim still holds true its cost money to chase money as you have to pay the upfront costs of claiming etc unless you're on tax credits n benefits when you can lodge small claims for free :D

Did you supply him with new tiles? In that case, why not turn up with a team of lads to take back unpaid-for goods? The police are unlikely to be interested as it's a civil matter... worked for my mate who delivered a load of soil and turf which they refused to pay for... soon changed their minds when an eight wheeler and 2 mini diggers turned up!!

What the guys are saying about it costing money to chase your money is true + if you take him to high court though you will be able to claim all your costs if you win.

 

The threat of this may be enough to make him find the money, because

1) High court means Baristers and they usually charge arounf £1500 per day and up to £1000 per visit.

2)Once the court has found in your favour they will set a deadline as to when it must be paid. Also you will then be able to put a lean on his property at a accrued interest rate. a legal lean means that he must disharge that dept if he sell the property. Also the longer he leaves it the more of the value of his property becomes yours.

best thing about the high court is (if) you can use a sheriff enforcement officer to enforce your judgement, however not all debts can go to the high court, or can be enforced by a SEO...depends on a lot of things

 

charges against property are usually allowed if the debtor says its ok either by mutual consent or voluntary charge or they dont know their rights, as in most other cases before a creditor can get a charge against assests the debtor actually has to default on a court order....in my exp the high court solicitor costs are never £1000's a day a few hundred quid over the course of a couple of hearings is about the norm....the big bills often reported by the press are reserved for appeals, corporate law or class actions etc

yep your right ime afraid,allmost got charged with theft and tresspas about 6-7 years ago when i tried to take my goods back after another coc-k tried the same thing, think he still walks with a limp even today :) :x:

If you got to high court a solicitor cannot represent you So you have to have a Barister and he employs a solicitor to trawl through the paper work. I have been to high court on two property matters. I won both times and I assure you a good Barister will cost £1500 per day. I thonk your mixing county court and Crown court.

 

Brian could take this customer to Crown Court for breach of Contract as there is 3 breaches as I see it under corperate and comercial law.

 

The other Alternative would be to say to his customer that he would accept 70% of moneys due to clear his dept. If he refuses you could then take him to county court under artical 36. This way if the court finds in his favour then he would be awarded all costs, which a good solicitor would ensure make the 70% up to the full amount originally sort. This system though would accept a weekly drip payment which is no what he requires.

re the solicitor / barrister...yep you can now directly approach a barrister whereas before you always had to go to a solicitor...and you need a barrister for the HC...though i hear some solicitors are going to be called to the bar...god knows how that works never used it myself anyways in the high court stuff i've done lately it always been a case that a solicitor employed a QC as part of the deal...though this is usually a junior not a silk (top guy in the chamber)...hence costs are less...just come out of a case took 2 morning sessions...the cost for solicitor & barrister was @ £650 all in @ £100p/h...less that some garages charge....esp merc main dealers... :tongue: :D

Ask a legal eagle about putting a 'Lien' (Ithink that's the right term) on his property. That's registered on Land Registry

 

That means he can't sell it without paying you off. Also find out about putting his debt on Experian etc..... stop him ripping amyone else off
