my missus is being 'sacked' from where she works. basicaly shes been there for 9 months, the guy who runs it is a total tosser who has got in debt and is trying to fob her off.

as i say shes been there for 9 months, she got given a contract at the beggining and he never signed it despite being asked to several times. but we have the contract still.

she's owed 2 weeks hoiday as it is, im going to pay him a visit 2moro but i want to be armed with all the facts before i do. so anyone know what she is entitled 2.

Also, during the probationary period, which is typically 2 years, you can be got rid of for pretty much any reason. And "face don't fit" is pretty much a valid reason at that point.

 

Entitlement will probably only be statutory minimum.

cheers bud, im gonna do this as sensibly as possible for now, just gonna discuss it with him, as my missus is too upset too and tbh isnt really the type of person to stand up for herself.

Andy is bang on, by the way, the minimum right is usually 1.6 days holiday per month worked.

i think well accept the minumum, not expecting a big payout but this asshole is giving the impression that he isnt gonna pay a penny out, just want to work out what the absolute minimum is that shes entitled 2

Mention industrial tribunal to him if worst comes to the worst.

Although she had a "3 month probationery period" an employer can get rid of someone anytime within the first year without too much difficulty.

 

After a year then the employer would need a watertight case to avoid tribunal action. Even then, the eployer doesn't legally have to abide by the decision of the tribunal; if the employer still refuses to accept the tribunal's decision the employee must seek judgment in a county court.

 

Still, your mrs is still entitled to payment for her notice period, plus payment for any accrued holiday pay not taken at the time of her dismissal. That is on top of her wages for the time worked since the last pay day.

This is true TBH. Once the contract is issued, an employee has (typically) 30 days to object to any particular clause in writing otherwise they are deemed to have accepted the terms within.

Is she a member of a union. These days nobody should work without being a member because employers will screw you over as soon as look at you, I would try the citizens advice bureau first its free.

If i was you bud i would get on the phone to ACAS as soon as.. they take a very dim view of employers like this and will give you very sound advice..could save you a wad of hassle too
