After being charged £170 in one day by my bank for reasons that, as far as I am concerned, are totally down to them, I am out to get their blood and am going through the procedure of trying to get all my charges back from the last 6 years.

I was just wondering if anybody else has had this problem before and went down the same route and what the outcome was if they did.

banks are on 'the list' along with insurance companies... robbing fvckers the lot of them.

Well I went out and spent the last bit of money in my account last week after checking online, telepone banking and cashpoint and all confirmed the money was in my account.

Only spent about £30 mind and left some in there.

Then the bank took charges for something that they should not have taken charges for and then decided to make my card payments class as card misuse, even though when I made the purchases, the money was clearly in my account.

It may well be my fault but £170 for £30 worth of purchases is absolutely ridiculous

Apparently unless the charges exceed £2000 then they are unlikely to put up much of a fight.

 

I believe the process is a little like this:

 

They will tell you to get lost after the first letter you send them requesting your money back (this is more than likely just company proceedure).

 

You then threaten small claims court in your second letter and I understand this is the point they will settle up with you.

 

I know this has worked for loads of people although I can't say I know anyone who has done it.

Yeah thats right. I receive tax credits and child benefit as I have kids and they have swallowed that up because of these charges and so I did a bit of digging around and discovered that they are not allowed to take that money from me as it is for 'the kids'. After reading the 1992 something or other act to them over the phone the agreed and said I could have my tax credits back but it will make me overdrawn again and so they will charge me for it again :headvswal

I have my first letter ready to send and am hoping for a good outcome.

Will let you know the outcome.

Not expecting it to be quick process though. I have to request all my statements from last 6 years and they are allowed 40 days to comply with that and then they have 2 weeks to reply to the request for the money back so Im expecting it will be a few months yet.

i have claimed for my charges back and they gave me 650 pounds paid into my account in 7 days it does work good luck

just visit http://www.consumercorner.co.uk register & click on forum you will find all the info you need & templates of letters to send to your bank/building society including step by step guide. i have claimed back a total of £1200 the whole process took only 3 weeks, honestly it is so easy, the only bad thing is once they have refunded you any charges they will close your account, also if you receive working tax credit etc then its FOC if you reach the county court stage plus you can add 8% interest at that stage but 99.9% of the time they will refund you before going to court good luck not that you will need it lol :D

in all fairness to everybody that has to have a go at banks and insurance ppl, its these ppl that help you out when shit hits the fan and you need a loan or you have a crash and u wanna make a claim, these are the ppl that help you out, so in my eyes and no one take this as an offence but i think you should look after your money abit better and dont over spend, thats the be all and end all in all honesty, if you know how much you got going in and how much you got going out, you know how much you can spend safely, and that is a fact, they would only charge you if you went over your over draft or your limit, they wont charge you for anything else. i see alot off people getting charges back but its because of there own fuk ups and trying to live outside there means.

Yeah thats fine but its a fact that it doesnt cost them £30 for a bounced cheque for example. It probably costs them no more than £4.50 and so it is unlawful for them to actually take more than £12 from you. So I hink I speak for everyone when I say we are only trying to get back what should have never been taken in the first place.

And if its wrong what we are all doing, why are banks paying up so readily???

Because they know they are in the wrong!!!

Thanks for all your advice guys, now I know its successful and the process works I will definately be claiming my money back from them as soon as possible.

As for them closing my bank account - it might be a good thing! Save me constantly phoning them up and having a go!!! lol

Hi Anna, I reclaimed over £1200 from Lloyds TSB. If you log on to "martinsmoneytips" all the information is there from start to finish, easy peasy.

I'm about to do this myself.

The fact that my statement arrived today with a mystery £75 "arrangement fee" on it just made me even more angry about it all.

I've been overdrawn and gone over my overdraft all this year but never had a charge like that before, usually just an excess overdraft charge which is fair enough.

The annoying thing is the way you have to do all the banking for them yourself by phone or internet and their computer does the rest LOL

No wonder they're making so much money.

im starting procedures for this next week. will keep you all posted as to how it goes. halifax have charged me a fooking fortune over the years, mainly when i was in iraq and couldnt sort my finances out

Oh the bright side Barclays sent me a very nice letter saying I'd gone over drawn for 3 days for the first time ever, amount was just over £40 and they charged me then said in the same letter that as I'd never gone overdrawn before they were refunding the charges :shock:
