My god, I went out this morning to take my kids swimming, and could I find my car??!! Turns out it had been "towed" by the poxy council, because I was supposedly parked "in" a disabled bay outside the doctor's in my rd. The wheels were NOT in the bay, a bit of the rear end was over the line, but there was LOADS of space to park, I was not obstructing the bay at all!!! I checked to make sure that there was loads of space still. My rd is a nightmare to park in at the best of times, and this is outrageous. I went to the pound today to claim my car (they want £200), and because I didn't have any ID on me, they said I couldn't have it. I told them all my docs were in the car and they could get them, and they said "we can't go to the car and get anything", even though the car was a few yards away! Don't get me wrong, I would not be moaning if I 'had' been parked "in" the bay (although, it is never used), that would have been fine, but I was obstructing none of it!! Any sized car could easily have parked there. I thought the idea of the law was to prevent people parking in the bay and stopping disabled people from being able to park there, seems to me this is just obtaining money from people by fraudulent means.

Sorry about the rant, but it really makes me mad this sort of bullshit!!! We are going on holiday on Monday as well, and that is £200 gone from our spending money!

Appeal the decision in writing and type the words without prejudice underlined at the top of the letter on professional paper (makes it look like you are getting legal advice already). Send the letter recorded delivery and stating your case clearly without ranting.

 

Say you will be taking steps to recover not only your car but any out-of-pocket expenses you incurred to. Suggest it was probably an error and that if the charges are waived you will take no further action...........

No, they will do 'anything' to get more money out of us these days. As I said, I could understand it if I was blocking the thing, but that is just a pure money making thing! Still, thats what this country is like now unfortunately, bleed the motorist dry, EASY MONEY!!

request a copy of the pic (if there is one)

I am going to appeal, but you have to pay first, then appeal. As you know, if you leave your car in the pound, you rack up extortionate daily charges for storage! They have you all ways. I will have to pay first and argue later!!

Yes they said they have taken pics, but I can't see them until sometime after I appeal!!

at least that should show ur in the right and hopefully you will get your money back.

the only problem with these ******* wardens is that they take a really close picture of the car itself, not showing where exactly the wheels are and the position of the car in relation to the surrounding signage. these guys really take shit photos. my mate got a ticket once and they wrote the wrong road name on the ticket, and when we requested a photo, we saw an extreme closeup of the car with the ticket on the windscreen, nothing else suggesting where the car was actually parked.

Don't mean to put a damper on your hopes however if any part of your vehicle overhangs the marked bay you are fooked but by all means appeal.

Do they ever cause any damage to cars when lifting them, does anyone know?

I expect they would take a certain amount of care but I suppose they could always say it happened overnight in the pound?

 

However I have been in a DVLA pound and I didn't notice any vehicle's damaged.
