Speeding Ticket Problem!! Please Help - Long Post!!

Right i thought i had sorted this but it is biting me big time on the ass and i'm now worried :(

 

In december is was driving on the M6 doing 70mph when a 4x4 was driving like a dick and was a few inches from my back bumper while i was in the outside lane!! as i couldnt move over due to traffic in the centre lane i accelerated away to move over and let the dick pass but sods law as i accelerated away i was caught by a van on the bridge and got done for 79mph!!

 

So in Feb i got the ticket in the post, took this long as its a company car so they had contacted them first and they told them i was the driver. I knew immediatly what it was for so i called the ticket office to speak to them. After a conversation with the office they said i had a really good case to get the ticket cancelled and needed to write in and the case would be reviewed which i did. Few weeks later i get a reminder about the £60 fine and 3 points?? so i call them again and quess what they never got the letter?? so i asked them for a fax number and faxed it across, called them a few weeks later to get an update and guess what they never got it???? so getting pi55ed off by now i asked for an email address and i emailed it across!! wooohooo i got a call to say she had got it :)

 

A couple of days pass when i get a call from the ticket office to say sorry but they had sent off my file to the courts and they couldnt recall it and i now had to wait till i get the summons and do it all again but it would be heard in court. So i waited for the summons

 

In June i get the summons for July so i completed all the paperwork, i was quite happy as the evidence clearly shows the black 4x4 closely behind me in the pictures, so i sent it all back in. I even called them to check they got it and they confirmed they had and to wait for another summons as the first one would be adjourned so they could look at the evidence.

 

Anyway got a letter on Saturday to say my court date in on the 28th July but i am now being done for "Person other than keeper fail give driver identity"???

 

i called the court who told me to ring the CPS who i spoke to and they were kind off helpful and are looking at it and basically said they will get my email and if its before the original summons they will cancel the second one and redo the whole thing but as its in a few days they cant guarantee that they will be able to do it in time as it involved getting files sent over etc??

 

So at this moment i am worried as i have 5 points on my licence and really could do with no more but i dont know what punishment this has or how to approach it so any help is much appreciated.

Ouch. Sounds like a nightmare. Hope you get it all sorted mate. Been in that situation with some muppet right up my backside far too many times to count (OK... that sounds slightly dodgy on reflection, but I'll let it stand). Like I say, hope you get it all sorted out... sounds like you've just been snarled up by our delightful beaurocracy.

 

Only thing I've found that works, and really annoys them which is a bonus, is gently easing off and very gradually slowing down. At least it means there's a nice big gap in front of you to give you some room to maneuvre if you need it.

I was under the impression that the whole thing may be thrown out as they have to give you notice of intended prosecution within 14 days.

Sounds like their mistake kirbz? surely its the companies responsibility to id the driver, and you've been in contact as soon as you found out. Do you have any proof of correspondance? ie copy of the first letter, and copy of the fax? If you've got hard proof then you'll be back at stage 1 ie driver up your arse etc??

I'm waiting to see if I get a summons for stopping and reversing on the hard shoulder to help a broke down zed, bloody police car appeared out of nowhere and did me for reversing :headvswal Worse news is I've got 9 pts so fecked if I get done for it.

Ive had 12 points on my license mate and didnt loose it. I think after the 12th point your buggered. Of course thats if they issue 3pts.

Could be a light at the end of the tunnel :)

 

Since the offence is now over 6 months ago they cant "do" me for it as they have already put forward the "failure to give details etc" so all i have to do it prove that i sent in the letter before i got the summons which i can and the CPS "should" drop the case. The court have been great and moved the court date to 3 weeks away to help get all the info to sort it.

 

So fingers crossed

Not always - as long as the NIP is sent to the registered keeper within 14 days. So if you have a company car or your car belongs to a lease company you would never know when the original NIP arrived at their address.

Just to let you all know whats happened over the last 2 days

 

The CPS got the file from the central ticket office and gave me a call to say they did have a copy of my letter i sent in but it arrived 2 days ofter the summons was signed off to be issued so as it was after the summons its tough and i have to go to court and plead either guilty or not guilty etc

 

I did try to explain that i had sent/faxed and eventually email this letter and i'm sure the girls would say i had been in contact with them all the time to prove this and i was not ignoring it but it seemed to fall on deaf ears!?

 

Anyway i gets a call today from them again to say they now have all the file from the ticket office and the lawer has reviewed them again for me and they have dropped the case :)

 

So result in a round about way

with hindsight its probably best to send everything via registered mail and get the buggers to sign for it.

I had something crap like this happen to me a few years ago when i had a company car for the day, picked up all my colleagues then set off in milton keynes up a duel carraigeway section.

 

Two cars had crashed and parked up without hazards on the size of the road, i looked behind, had loads of room to pull out at 50, signalled, moved out and the corsa that was all the way down the end of the road had stormed up behind me at 90 od miles an hour and locked their brakes slamming into a lamp post about 100 foot behind me so i pulled out and went to help them out the car.

 

Gave a witness statement and police officer said it was nothing to do with me they were going too fast.

 

Week later got a letter from some two bit lawyers firm in manchester sueing me for wiplash.

 

I passed it onto barclays capital lawyers and moved address and never heard anything more from it.

 

Always nice to have some good lawyers on hand for free to sort out problems like this :D
