Hi guys,

I need some help here. My car has been declare a total loss by the Insurance repair shop following a little accident caused by so weirdo middle-aged man who fled the scene - that is not the problem for me at the moment.

My worry is that I just pumped some 5k into the car last year with engine rebuild and new turbos.

Got a call from the insurance this morning wanting to take the car for scrapping! Hell no, I said. they reckon its not economical to repair for them, they would prefer to scrap it!

What do guys think I sould do?

thanks,

adef

you can (& should) buy it back from them after they pay out. Not sure if you can force them to repair it or not though

Dont let them take it whatever you do as They will make it so hard for you to get it back. They will charge you storage fees and just rip you off. If you dont want the car then settle the amount with ur insurance before you let them take it. buy it back at a mega cheap price and then re-sale or get fixed yourself.

Without meaning to throw water on the fire, there's a guy on SXOC who had a similar problem and the insurance company wouldn't let him buy it back. He did manage to arrange a time to go and remove the mods that he had put in though. Deffo don't let the insurance company take it anywhere.

the insurance company do not HAVE to let you buy it back.. it depends what their policy is on it and what their engineer says..

my skyline got wrote off last year, a category B (must be destroyed).. i wanted to buy it back but wasnt allowed, it went to the scrappers where my mates stripped it for their cars..

luckily me and a mate went and took off all the removable mods we could before it was transfered to the scrap yard...

hopefully your insurance will let you buy it back.. mine never...

Remember the car belongs to you not the insurance company and they cannot just do as the like even though they will if you let em

Firstly you insist that nothing is to be done with, or removed from, your car until the mater is settled to your satisfaction. You insist that you know of its where abouts etc.

If you can afford get a Solicitor to write it This should ensure that the savage company do not strip it. Or if they do you can sue the insurance company and get the police to charge the savage company with theft.

It is your Car and buy law if you have fully comprehensive insurance (dependant on the small print as to replace or repair) you have the right to insist on it being repaired. No on e can do with or dispose of your car until you agree to settle (in effect sell) to/with the insurance company. I insisted on mine being repared ( :smash: what a nob I should have taken the money   )

They will tell you that it is not viable to be repared (note they will not tell you it is beyond repare) providing that in the small print they do not use a term relating to none repare on a vaibility basis then they must repare if you insist or make you an offer.

You gotta haggle until you get what you want. Either fixed or a lump sum you see as reasonable and the car at a silly buy back figure.

A friend of mine runs a small recovery firm. The were told by the insurance company who instructed them to collect a car from an accident, to take it strait to a breakers yard. The car was mint and had expensive wheels newly retrim leather interior and rebuilt engine gearbox etc. Purely on the basis that the car was 20+ year old they decided it was scrap.

The work had all been declared to the insursnce company, but when the lad eventually got there the body shell was all that was left. He hadn't agreed anything with the insurer and they were offering him £800 even though he had £20k of bills and done most of the work himself.

after 12 months they paid him £23k + legal cost.

Its your car till you agree other wise.

Hi Jaffa, how you doing, I haven't heard from you since you left Hackney! Hope you're doing well.

Royal, the thing is the insurance already return the car to me. Its safely tuck away in the garage now. However they want to have it back as the repair shop should not have return it back to me. The insurance engineer wont discuss how much he's offering until I allowed their agent have the car.

Could i not ask them to pay so I can have repair privately. there is no way I will sell the car or let them salvage it not with all the work that went in.

Even if mange to remove the turbos, the motor still cost me quite a lot.

Good Solicitor mate

Free consultation and at most £100 for a letter. Make sure he's a good one not some arse wipe. Don't let em touch it. you can ask em who's car it is thats a good start. + insurance engineers are cocky arogant second rate nobs who think there gods, but once a solicitor points out who works for whom they become very helpful indeed.
