I hired a corsa last year (feb!) for my girlfriend to get to work in for a couple of days. When driving in the fast lane of the M4 in heavy stop/start traffic a stupid bitch ran into the back of her in a VW Toureg. As the traffic had completely stopped both my girlfriend and this woman got out of their cars and the woman gave my missus her details written out by her! On returning our hire car we informed the company of the accident and that i had filed a police report. I had to pay £500 to the hire company even though this was not our fault and was told that when they recover the costs we would get our money back.

 

I have spent the last year chasing this trying to get my money as the woman is now denying all knowledge even though she admitted to the hire company she was involved when they first contacted her.

 

Now after all this time it is going to court.....IN MANCHESTER!! Because that is where the defendant wants it!!!!! We live in Wokingham near Reading and have to now get time off work and go there. I cant believe how stupid this all is and to top it off i just received a copy of the womans defence where she admits to following behind my girlfriend on the M4 but denies the collision! Then why the **** did she get out of her car and give her details to my Missus!!!!!? :headvswal

FFS - if you travel to Manchester and win then you can claim back your lost pay and travel expenses. However, were there any witnesses? This may be crucial to you winning the case IMO.. :(

I have no idea why these things happen niether. My son had some twat do a U turn in hes path and they collided my son into the front off side of the other car. A bloke came up and said he saw it all and would be a witness. the other car driver admitted he was at fault and they exchanged details. 6 yes 6 months later and the bloke reckons it wasnt hes fault and my insurance company settled knock for knock without consulting me. i argued that we had an independant witness and they said the other insurance company didnt believe hes staement so disregaurded it?????

 

It makes you wonder who the crooks are? THE LAW IS AN ASS!

Priority 1 - Make sure no-ones seriously injured or fleeing the scene.

Priority 2 - Don't allow any witnesses to go without getting their names/numbers first.

 

But now it seems that witnesses are even a waste of time. What do we need now, 4 on board cameras FFS.

Because they stopped in the fast lane of the M4 details were exchanged quickly!!! We still have the womans details in her handwriting which we hope will show that she must have been involved otherwise why would she give them out! No names of witnesses were able to be taken which is a bit frustrating but my missus had never been involved in an accident before and didnt really know what to do. Just as well the daft bitch who ran into her offered her details or we would really have been shafted!

 

There was very little damage to the hire car and we probably could have gotten away without saying anything in hindsight but i thought we were doing the right thing at the time. The hire company have had the corsa repaired for £700!! It could have been done for about fifty and i would have paid it and saved my other £450 plus all this aggro :smash:

Im a bit paranoid now and always carry a disposable camera in my car for any incidents that happen....digitals cannot be admitted at court due to the ability of manipulation of them.

I live in southampton and someone from north wales hit me. But when the court place came through it was half way for both of us.

Think it was somewhere in Northampton or summint.

Shouldnt be where 'one' person wants it.

Bazz, You can get the case switched back to your home court, it is not the defendant that decides where its held but the Plaintiff, unless of course they are on 'benefits' which I doubt if she was driviing a VW Tourag. Go back down to your local county court and tell them you wish it to be local.

I have had similar experiences. I keep a disposable camera in the glove box now. Any “accidents” and I photo the entire scene and send a copy to both insurance companies. I’ve never had any disputes about blame since.

OK i've done a lot of debt court stuff and IIRC you can ask for the judge to make judgement from the evidence supplied no personal appearance is required in cases such as small claims (esp over such a long distance), phone court service for more info as their maybe a deadmine for filing such requests...also i am 100% the defendant has the upper hand as to location of hearing....HTH
