I have got a Single mother and her un ruley kids living next door to me in a coucil owned property. She has now started erecting a make shift shed (supported by my fence)out of sheets of OSB board and hundreds of screws, nails and felt. Some of the screws have gone threw my fence, which I paid a lot of money to have put around my garden :( I am also worried about it binging my fence down in high winds. I complained about it to her and all she said is fu.. off your always moaning. Its one thing they play loud music all hours and her son who is 14 is a hoody who trys to terrorise people around the area and does not go to school. He also drinks neat Vodka in the street with all his chav and hoody friends. I have complained to the Council but they are useless, anybody got a suggestions apart from violence. Cheers.

P.s in the summer her fooking kids used to throw their fag butts over the fence and they used to burn the garden seats :(

Might sound petty but if she has not got your permission to screw into you fence then it is criminal damage...Fact. If the fence is yours according to your deeds??

When I put my shed up I was told by the council that it had to be 1 mtr away from any main/permanent structure and you must have permision to put a shed up too. As for her throwing litter into your garden ...take some photos and submit them to the council. make a daily diary of whats going on even the smallest things. this will deffo help. then if nothing gets done.............we will have to have a meeting at yours and turn her place upside down or set fire to her shed? I hope this helps.

You need to get on to your local council, probably the housing department and complain about the hut she has erected. Secondly they should have an anti-social behaviour team. You will find any anti-social behaviour is a breach of the tenancy agreement for which they could ultimately get evicted! Furthermore I'm sure that the kids at the address are annoying more people than yourself, try and find other victims, between yourselves you can record incidents on diary sheets as evidence against them for which the council will have to act upon.

Crminal damage, it does appear by screwing into your fence she has commited criminal damage however, did you see her erect the hut and cause the damage? If you didn't then it is almost impossible to prove although she obviously did it, won't stand in court without her admission. I would go to local police station with photo's and speak to local beat officer for advice.

Throwing fag butts over fence and burning seats is criminal damage but again you ould have to have seen who did it to prove it.

Finally if the council do not seem to be doing anything then I would go to you local MP's surgery and complain to them, they often write letters asking for something to be done, especially if there is an election approaching.

Well the Police just rang back saying they cannot do anything about it, but to contact my local councellor. They have now started building an extension on to the fookin thing which I have pictures of them constucting. I am going to get something done about this if its the last thing I do I am pi55ed off now.

People like this are scum no other word for it, they have the luxury of a free home provided by the local council and still see fit to treat it like they do, besides the appauling shanty style shed look at the garden in general!

As far as I am aware council tenanats require permission from the council when making alterations or addition, without it they are unathorised.

 

The council bear a responsibilty to ensure their tenanats and surrouning neighbours cannot come to any harm on what is essentially the councils property or a nusiance be caused.

 

In their lease/ rental agreement will be provision for ensuring the tenant is in violation of their agreement if they undertake additions to the property without first seeking approval ( yeh right like they would get it!)

 

I would be inclined to be asking the council for compensation, to pay for having to live by their crap tenant and for fence repairs both present and future ( high winds etc)

 

Been a landlord myself I know my lease agrements make it clear that the tenant behaves or they are out ! having said that I am responsible in law if they behave in an anitsocial way so I am very strict! the council agreements are most likely written to the councils favour though.

i now the law says they have the right to erect it as its timber and any timber structure isnt permanent,, but they have broken the rules by fixing it to your fence,, not allowed, also as said before it is criminal damage if they have screwed it to your fence as well , ,good luck with this , contact the councill should be able to help you ,

I believe they have to take action with in a certain time scale it is quite a short time scale as well

what would happpen is he/her would get in touch with the local council and they would look into in almost straight away as they shite themselves when a mp has got involved

but it no use using the phone as there is no record of it it must be in writing snd best to make the letter as polite as possible

me an a few buddies will come an burn it down with her an her chav clan in it if you like..............

Steve is right. Send a letter to local councillor, with photos. Registered post it, and tell him if you don't get satisfaction, you will go to the local press with his failure to act. They hate bad publicity.

the local authority rules state and this is on all council authority property,

 

any exterior building albiet temporary or permanent must be presented to the local authority, as you may only intrude into 1/5th of the area of the ground.

 

also any permanent or temorary structure must obide by the local authorites rules reguarding suitability for use and safety.

 

any exterior building must have acess from all sides to offer upkeep and general maintainence.

 

you must not at any time interfere with any boundry or permanent structure that is part of local authority property or private property whilst a council tenant

 

if your property is private you have now legal ground to pursue the council, as they are responsible for their tenants, actions and any anti social behaviour.

 

If your house is also council owned then you can also pursue the council under the tenants rights act.

 

I had a problem with the council reguarding the road at the rear of my property subsiding into my garden as they had never built a retaining wall, after waiting for too long i then threatened them with legal action as they were failing under terms of local authority guidlines and regulations. Lo and behold two days later they were there fitting rebar and boarding and poured the concrete the next day. After that they were most obliging to any complaint i gave them albeit justified.

 

It was amazing that when given 7 days to sort things out or face paying a construction company all fees and legal bills how t hey got their act together.

Sh1t bud sorry to hear this, looks like theres some pretty sound advice being offered it just frustrating that wading through the bulsh1t and red tap takes so bloody long.

 

I have similar scummy neigbours who think the world owes them a living, they have a teenage daughter whos often left in on her own whilst mommy goes on the p1ss this started to result in gangs of scum hanging around outside my house.

 

I sorted it by my own means in the end but we still have to listen to rowing and fighting occassionaly but I ignore that as it sounds quite possible that they'll kill each other one day.

 

Any how I feel for you and I hope you get it sorted soon.

Finally getting them sorted out after listening to all your advice, and contacting every councillor and MP this side of Devon.

As mentioned in earlier posts, the Council should have an Anti-Social Behaviour Unit, which is staffed by the Council/Police and should be located in the Town Hall. They can take out an ASBO, but you need lots of evidence, ie photos/video/diary. Used correctly ASBO's are superb.

this wouldnt fall under the current asbo regulations and as such would only fall under local authority statutes and guidelines.

WOOHOO!! The shed or what ever it was called has gone, she got one of her havies to take it down and it was down in about 3 minutes. Now all I have got to do is work on getting ridd of them.
