I think Im a very lucky guy! I just went to the Police station to surrender my license for 3 points for speeding and the kind lady said "oh dear he hasnt put your reg. down!"

 

"We cant enforce it, your have to go to court"

 

So where do stand?

don't invalidate it m8, it just enables them to reissue, its YOU who is being prosecuted, not the car:(

A mate of mine got away with his offence through an incorrectly completed NIP. I say contest it all the way mate.

I heard that if the officer diosnt document the vehicle correctly then its tough shit as they cant prove it was you and your car.

 

I would defo phone one of them legal advice lines, but I am sure they are trying to scare you into going to court and admitting it was you so they can charge you.

 

They cant charge you at the mo cause the paper work and file is wrong. So hence they want you to go to court to 'legally' correct it yourself by admitting the offence.

 

Get it checked out matey, dont accept what they tell you first off.

Spot on - they are just trying to get you to admit it.

 

If any details are incomplete or incorrect it is invalid. If you are in the AA or RAC call their legal service for free advice.

i think? that has he has been asked to produce his license

that its not a nip, but a fixed penalty, and he will have already admitted guilt

(otherwise he wouldnt have been given one)

probably my fault as i mentioned nip in my first post, but they are two different things, and i guess BigRoy would have signed acceptance of the speeding and agreed to produce his license for points??

 

so i would say he is still liable to the points, unless her tells us something different;)

the wrong or incorrect reg is to all intents a minor adjustment in any legal hearing i would bet on the judge accepting that as the case and so find you guilty and maybe add costs for taking it to court...however if it is your last 3 points (i.e. you're on 9) then what have you got to lose

You could try the AA Legal Services helpline Roy, they were v helpful to me once. Although I was a member they never asked so try them - they are v knowledgeable.

 

These speeding laws are changing all the time as precedents are set (or not set) so check it out yourself with a solicitor. I got off a loss of licence because they couldn't prove who was driving the car... took a long time and in the end cost me nothing and I kept my licence.

Costwise, assuming you go through a solicitor - worst case, hundred or so £ fine plus couple of hundred £ legal costs and your 3 points.

 

Best case - nothing, no fine, costs reimbursed.

 

Do nothing case, £60, 3 points, closer to losing the licence and insurance up for 4 years...

If you give me the correct details of the offence i will get you the RIGHT answer....was it a HORT 1 form or was it an NIP...if the deatails are wrong on either then you have a get out of jail free card....but i need the info and deatails of the forms.

so i assume he has had Endorseable Fixed Penalty Notice, which he must have been given IN PERSON and signed to admit the offence, not "camerered"

so no dispute in who was driving, i hope for his sake he has got an "out"

but to appear in court and the police say it was him speeding, will be hard to argue against

btw, you may have a get out of sorts, as you went to hand your license in as requested, and as long as you havnt got 9 points or doing a daft speed

then you DON'T have to attend court

Hi guys, yes it was a Endorseable Fixed Penalty Notice. I have a clean license at the moment so its not the end of the world but would like to get out of it if possible. I will see a solicitor tomorrow.

I was given a fixed penalty for doing 55 on a 40 limit dual carriageway.

The copper told me to produce my documents and I told him my license was away at the DVLA for a change of address.

When I got to the station the woman said that as I couldn't produce my license I shouldn't have been given a fixed penalty, that it had to go to court and that I was now charged with driving without a license! FFS

Is it too much to ask for the Police to contact the DVLA and check I have a license?!

 

Anyway, after all the messing and my license arriving back a couple of days before court, they dropped the no license charge but I was given 5 points and £180 fine for what should have been a 3 point £40 fixed penalty!

If it goes to court you'll be in for a lot more than a fxed penalty I suspect.

Sounds like a tricky one Roy. My mate who got away with it when he was actually stopped by a bike copper and issued with the NIP there and then. Don't even know if there is a hard and fast rule or if its down to the judges discretion each time. Try and find out for definate mate! See what Mr. Solicitor says. Last thing you wanna do is stitch yourself up.

Just goes to show how the government hates car drivers....because it can't

control when and where you go nor how quickly.

Government, particularly this one, is about control.

(It's always wittering about public transport but how many of the members of the gov actually use it? How many cars does JP have?)

dont get me wrong it is an imperfect system...but by seeking redress in court over a minor detail (and for an admitted offense) may well end up costing more but only to those who bring such actions, the rational behind it is fair, that is to say tax payers dont foot the bill of everyone who wants to go and have their say using the service...in theory you could seek court redress over this or any thread on this site you disagree with and yes the judge may agree with your point of view but your costs would be yours...noway would the state pick up the tab...moral victory indeed but is the financial cost worth it just to be right

I had this a couple of years ago.

My ex was bringing a bloke round my house and after warning him to stay away from my house and my daughter on a previous occasion, I ended up in a fight with him that he started.

My ex didn't see what happened but lied to the police and he pressed assault charges against me.

He got legal aid and I was told it would cost me £3K at least to defend the charge with little chance of gaining any result.

In the end I had to agree to be bound over to keep the peace for 12 months as there was no way I could afford to plead not guilty.

I was told afterwards that due to the circumstances we should have both been charged anyway!

 

The law in this country is an absolute joke.

It basically comes down to how much you are prepared to pay for your principles - unless you are an unemployed toe rag and you can have it payed for.

Every time I have been involved with the police or court for whatever reason - my fault or not, I have ended up worse off because of their mistakes and stupidity.
