Had new turbos fitted 14 mths ago.....(I have turbo timer and breather kit)..turbos failed...sent to manufacturer they have stated that the turbos have been damaged by oil starvation and particle damage..possible left in there when fitted....

 

The guarentee states 12 mths or 12000 miles.......

 

1. The turbos where not particle contaminated as I have full faith in the bloke who fitted them.....he has done loads before (300zx) and all his work is quality.

 

2. If oil starvartion is found the turbos where starved of oil because they blew (particularly drivers side) in spectacular fashion...clouds of blue smoke.....eg the oil....

 

Looking for leg to stand on............any advice......

 

(any contacts for replacement/repair would be helpful...if the company will not accept responsibility......)

Note vehicle done way less than 12000 miles.....I was attending a barbecue in the middle east for about 6 months of the 12......the turbos where covered for.....

Did you buy them in the UK?

Did you buy them on credit card (not charge or debit)?

 

If there is dispute between you and manufacturer, you need to get an independent report on the condition.

 

You should also get a formal written report from the bloke what did the fitting.

 

Have you got uninsured losses insurance or legal assistance (might have come with your car insurance) or are you member of motoring organisation which offers the same thing?

 

Next steps depends on answers to the above.

 

As a general rule, the law is that something must be of merchantable quality and fit for purpose. 12 months is not a legal limit for warranty - it is just a reasonable one for most consumer goods. The question is "is it reasonable for turbos to fail after 14 months and less than 12,000 miles?"

 

IMO, not.

 

Downside at the moment is the fitment of breather kit. If there is anything nonstandard on the car which affects the turbos or could be claimed by the manufacturer that it might affect the turbos, that weakens your case.

Subs, bit of a strange one this, cos as you fitted the breather kit this would NORMALLY make the claim invalid, BUT and it 's a big but, i know the same company who supplied the turbo's also designed and supplied your breather kit for you, so it's their own piece of work and in my opinion should stand by the 12,000 mile warrenty, even though you have just got to that point, certainly for good relations, however your dispute is with the supplier of the turbo's not the manufacturer, if it is as i suspect a different company that supplied them to you, if that is the case, then they must secure the job of repair or replacement for you and cover the costs, they will/should argue the case in order to get a best deal as possible so that they don't pay too much as official trade suppliers of that compnaies turbo's, i would expect a very good deal to be done, again in keeping with customer relations.

Obviously as you know this happened with just 1 of mine and 300zxnewbie, i paid the subsidised cost of replacement AND fitting, cos i was the supplier, yours should do the very same, though after 14months i doubt you will get any help in fitting costs, sad thing is, the supplier may only have to write off a couple hundred quid, you however are left with a a far larger fitting bill, so fairs fair, pursue the supplier big time it's his/their responsibility.

i have had similar problems with vauxhall on my old V6 vectra

they replaced the rear wheel bearings and after 15 months the same problem re occured, this time the car was out of warranty and good old Vauxhaul wanted payment to re do the work plus parts , i simply took my case to the citizens advice office they wrote to Vauxhall and threatened a small claims court , end result

paid zero and had the bearings fitted free to keep the 'Good" name of the dealer out of the courts and the local press which i also threatened them with ..........its a last resort but if all else fails you could try the citizens advice office to see exactly where you do stand with your problem their input is totaly free so you have nothing to loose.

If this was Turbo Technics then I had exactly the same problem last year with a set of turbos. (Well, only one actually) but they said the same to me. However, they were fitted and primed perfectly. Trouble is, I left it until 2 months after their warranty ran out :S So didn't have a leg to stand on, even though it must have been a manufacturing fault, since the turbo failed immediately at first start. (Although this wasn't recognised until the engine was taken out and stripped 12 months later!)
