If it did, then there's that argument out of the window, but either way, you are still entitled to ask for photographic evidence.

 

There is currently a loophole in the law which means that you do NOT have to sign the NIP.

 

The photographic evidence proves whether it was your car. My brother got one through for a Rover 620 whose number plate was X662 XXX and my brother's Celica was X626 XXX. The photos proved it wasn't his car.

 

You *can* claim that you can't remember who was driving but only if there really is doubt. Otherwise you end up in a worse mess.

Ok, well at the moment there is a loophole in the law which means that you do not have to sign the NIP.

 

By all means fill it in, DON'T sign and send it back. It will be sent back to you for signing. You can either then completely ignore it or write them a letter asking under what jurisdiction they are requesting you to incriminate yourself. They will no doubt send back a letter stating a court case Something V Brown, I think, which has nothing to do with not signing a NIP.

 

I have a website back at home on my laptop that goes into this with more detail.

 

When I get home tomorrow night, I'll post it up for you to have a look.

40 in a 30...looking at about 3-6 points and around a £60 fine.

40 in a 30 is fook all if youre driving safely, but the law doesnt consider common sense . A friend of mine was caught with a lazer gun on weds doin 42 in a 30, let off with warning.

i agree - always ask for the photo.

 

I've heard stories about the police not being able to provide to photo evidence so they couldnt prosecute.

 

anyway 3 points aint so bad pitty the poor old bugger who flew past me the the roadworks on the M1 this evening. 50 mhp restriction in roadworks and i reckon he was doing at least 85 when i saw the camera flash. Bang goes his license.

 

Get a radar detector - i swear by my bell radar - you have to put up with some false readings sometimes but it has saved me many a time.
