LEGAL DISCLAIMER (To keep andyP sweet :D )

This is purely "The word on the street" and not an accusation.

It is what is being discussed among members so it should be known to all members.

 

Emero's nose panel (with scoops) was removed while her car was being repaired after her crash, she was told it was cracked and was charged for a secondhand standard one, It is being said that her origional nose panel turned up afterwards fitted and painted on the car belonging to the person who carried out those repairs.

 

Also an invoice has been studied and questions arisen as to why a second hand bumper should have cost more than a brand new 99 spec bumper.

 

I dont know if there are any more things but I think that is the main 2 points. I dont know how accurate this is. I have not spoken to the people directly involved but many of you are asking what is being said in private so there you have it.

More things...

 

Claimed to have been jigged - No way I'm afraid. No clamp marks left from jigging and there is a definite bend in the chassis leg just in front of the OSF wheel. Also on the same part of the car, split weld on the suspension turret just in front where it meets the wing. This was covered up with silicone sealant - on removal of the sealant the weld had NOT been repaired and was also starting to rust do to inadequate protection. Rear toe-in was set at well over 15mm - spec is 0-4mm - any more shreds the tyres, this is why the rears were slicks after only around 1000 miles. This was EASILY spotted as the rear wheels were quite obviously not pointing in the right direction. The nose panel in question could no way have been damaged by the impact - yet it was replaced??? Then to turn up on someone elses car. This is NOT for certain but certainly looks suspicious with times of fitting etc.

 

There are far more things than has been stated but these are the major ones for now. The car left the garage in question unsafe IMO. When asked why the tyres were lasting so few miles, the owner was told it was because of the way she drove. Even my mrs said the wheels didn't look right - make up your own mind.

 

IMO the prices aren't really part of this discussion. However, it is quite obvious someone has been completely ripped off - especially as she was charged for work that wasn't actually carried out.

 

I would also like to say that this is in no way any grudge etc - any garage that would have done this would have got exactly the same treatment. Everybody on here wants a fair deal and to know that they are safe. The person involved felt she couldn't trust anyone with her car after this and was left with a car she felt she couldn't even drive - especially considering it gets used for the school run.

The issue is not freedom of speech but of culpability. In it's archaic way the law views the publisher culpable for the content and whilst this is orientated towards paper rather than electronic publication, the publisher could be viewed as either the ISP (Mike's company) or the owner of the service/domain etc (Craig) or even the moderators (Me, Mike, Andrew,Gio,Martin). Whilst Mike's company will have liability insurance we do not, so in the worst possible case we have EVERYTHING to lose from a court test case when the lawyers get carried away. To be realistic this is unlikely to happen, but nonetheless we have no desire to be standing next to Ian Hislop in court ;)

I dont think there will be any problems on the legal front - all the links have been 'guessed' at by everyone. Andy hasnt once mentioned any names. So it could be anyone really......

Well you answered it yourself - yes there was a test case and it was partially successful, so I guess it was legit. As I said before this is not about freedom of speech, you can speak all you like, it's about who "publishes" the information. Remember slander is verbal, libel is written. If you want to libel (and I'm not suggesting that you are or should do!) someone then do it on MSN, email or your own website. When it's on this web site then it's Craig or Mike who will most likely get the first call, usually a cease and desist from the lawyers - we don't want that to happen (again!).

 

Be sensible, be reasonable, be truthful and no one gets moderated.

I 100% agree Pingram but .... point im making is "the whole world is keen to throw libel at everyone else (which is an imediate admitance of guilt 90% of the time) and how often has it ever gone further?

Isn't that the key thing - if you simply state FACTS, then you have nothing to worry about. Libel is when someone challenges the integrity of what you have written because it damages them.

I'm just gonna type here what I typed in the other thread.....

 

I think the problems that Andy or Emero have should be a private matter until they have spoken to Jeff and hear his answers .........its THEN that I think it should come onto here with what was said etc. And I think it is important we do know what was said.......seeing as we're involved in this now!

There is a downside to all this aswell. I recently learned that Bob (Safe & Sound) decided to leave the forum after witnessing what went on last time over Emero/JeffTT incident.

 

Now that is not good IMO. Nothing wrong with Bob and he'd been a long term member of this forum from the very early days.

 

He was concerned over the way Jeff was hammered on here and never wanted to see himself in a similar situation that could possibly damage/tarnish his reputation for his business.

 

So although quite a few of us on here know where the Bob man is and can still contact him for excellent value for money on ICE and alarms/radar detectors etc. most won't have heard of him.

 

To me that's a shame!
