Well having had a nightmare scenario for the past few months, i can finally feel vindicated, but through no fault of my own:

 

I gave a mechanic friend my old Renault Megane Scenic in October as i only bought it to get me by while my zed was being sprayed, but after the engine dying, kept it longer than originally anticipated. Everything that can go wrong with these cars, did and having no interest whatsoever in it, it was time to get rid.

With hindsight i wish i had just scrapped the bloody thing at least i would have had a little money from it and peace of mind, but oh no, i thought i was doing a mate a favor and giving him a project to make some money on.

 

He sold it on Nov 1st and like a fool he gave the whole logbook to the guy giving him the responsibility of dealing with the paperwork, which of course he did not send. The car had a few months tax left on it, so i guess he thought he would drive it till it ran out then sort the logbook. In the meanwhile i get a letter from my local council for an unpaid parking ticket on Nov 15th. I knew it wasn't me as i didn't have the car and i was at the NEC classic car show that weekend, so instead of writing, i went to the council office to deal with it face to face.

 

Anyway although i had all the info including the part of the V5 with the new owners details, they said it was still in my name according to DVLA and i am liable for the £70 PCN.

 

As you can imagine i wasn't best pleased, but for once i had everything in my favour and was adamant i was going to fight this to the very end.

 

As a back up i sent a letter to DVLA stating that i no longer owned the vehicle and the date of exchange, however in all the weeks leading up to Xmas they say the car is still in my name and had no letter on file from me, so i then fax the letter to a different department, phoned them a week later and they confirmed they are now in receipt of the letter, meanwhile my deadline with the local council is about to run out.

 

Finally got hold of DVLA today and they have confirmed and updated their system stating the car was no longer in my possession from Oct 14th 2014 and i will receive a letter shortly.

 

Id like to say im relieved, but i was prepared to go to court and fight this, but the ordeal is over now :thumbup:

 

Moral of the story: Send your logbook off yourself, recorded delivery if you are selling a car and dont trust anybody else to deal with it, thinking they are doing you a favor, you are not even guaranteed the DVLA are going to receive it, unless you do :thumbdown:

Glad you got it sorted Graham and talking about Scenic's I sold mine at the begining of February as the waterpump was leaking badly. Sold it cheap showing the new owner the water coming from the waterpump but his son was a mechanic and willing to fix it. The first thing he said to me when he handerd over the money and I got him to fill in the V5 was "You trust me to send this of dont you" I said it was my legal responsibly to send it of so he took a picture of it with his phone which was a good idea.

I have been caught before when I bought a car and the person I bought it of never bothered to send the V5 of to the DVLA but luckly had the V5c part to prove I now owned it.

dvla are hard hard work at times don't make it easy you same with the council we live in a blame some one else country now all ways some one else after your money even when its not you fault. just a not every car I have ever got I left with the car and the full logbook. apart form one time when I got the Porsche the guy selling it said he would send it off and he didn't bother after ringing and texting him for months he had still not done it in the end I had to send off a form to dvla to claim a log book was a total pain that went on for months when buying a car I always get the log book so show it can work both ways glad you got it sorted as I know its a total pain

My scenic needed a crank sensor, exhaust welding, gearbox mount, also had the common on that year, burnt out mirror control, broken rear hatch handle, indicators stopped working as did the windscreen wipers lol, it needed a new ECM, barrel and key to sort that little lot of electrical gremlins, but a good project for my mate as i hated even looking at it in the end lol

 

I also had the V5c, which the new owner is supposed to keep, however even that was not enough to prove i wasnt the owner at the time, its been a few months of battling, but luckily i had everything on my side, paperwork wise :thumbup1:

Both my cars recently bought never had the V5 sent off by the previous owner. I now ring the DVLA the day I buy a car to alert them that ive bought it and for them to expect the V5 in the post. If I dont get anything in 3 weeks, I ring them and then fill out the other form (cant remember what its called). I also found out that its free to send your V5 to the DVLA, just give it to the post office and they deal with it all.

Gotta fight the DVLA's corner on this one.... how are they morons? You didn't follow the correct procedure haha! Naughty boy!

 

I sent them a letter Dean the week i gave it away stating i was no longer the owner, to cover my ass lol, they said they never received it, it was only after faxing them again, they found the record of both.

 

When i sent the V5 for my Hyundai coupe, on 15th Oct, i got a letter 25th Nov to say they have received the V5 and i would receive the new logbook by 28th Nov. I eventually got it 6 weeks after the purchase, they just seem a little lacking in the efficiency dept, however having tried another phone number yesterday i got a very helpful girl who finally confirmed the date change, she said a letter was sent out on the 26th Feb, im still waiting to receive it.

 

Maybe the title was a little harsh, but thats how i felt about them after all these months, i should have said my local council are morons :thumbup:

....And indeed, agree with the moral of the story! Trouble is, in my experience, local authorities and government agencies are "equal opportunity employers." Consequently you do, occasionally, get to have your case dealt with by Joe Numbnut; who is only able to deal with anything if it follows procedure to the letter - as opposed to someone else using common sense to work within the spirit of what should have happened.....

 

We're all human; so it's a relief when you do get to speak with another capable human who understands the issue and is able to work with you in resolving it!!
