Evening guys. Cut a long story short, someone in a transit van has reversed into my girlfriend's parked car. They were either drunk or didn't check their mirrors as they shunted it a good couple of feet. We have the evidence on CCTV.

They were in a sign written van and contact has been made. The driver has admitted it and says he 'thought I could blag it and get away with it as no one saw me'. As you can imagine I am fookin' fuming!!

 

I have told my missus to go to the police with the video and to go through the correct insurance procedure.

 

My question is with regards to the insurance claim devaluing her car. It is an immaculate 09 plate Fiesta zetecS with low miles and FFSH. Current values are circa 7.5k but cat d ones are 4.5/5k. Is it possible to chase his insurance for the diminished value??

Agreed Dan. Only want a replacement car of equal value and condition. It does grate me though that he drove off thinking he had got away with it. Out of order bud, and I will not change my mind on that.

am not saying you should change your mind like am just saying what I did the first days I was so pissed and wanted to kill her but then I said sod this forgot all about her and what she did and just went after the insurance like a dog to get the car back to how it was thay did try half arse the job at first but if the read what I wrote before I got them to do all the wheels and change the light to match the new one. just wanted what was fair and nothing more. I hate it then people start suing every one for every thing thay can get its just hurt us all in the long run. don't waste ye time on the guy its done now just use that anger on what now counts getting the car replaced that's going to take enuf stress with out having to worry about the guy that's just what I think any how. and what I did. hope you get a car I think you will have a fight on your hands. as the from the vid you can see the insurance just fixing that if you want a new car you will have to get you game sorted and thay will battle you to the hilt. if thay say it can be repaired. I feel your frustration after the 4 months I battled with them and that was just to paint the wheels and replace the head light so you will have a battle on your hand now. so forget the guy and put the energy weres its going to be needed. good luck dude

We deal with a claim company that drags back all losses.........

I can't believe how well they hold their value. 7.5k was an approximation. Haven't studied prices too closely as we weren't thinking of selling. I'm told our next car will be a 'family' car. So of course I suggested a LWB Zed :sneaky2:

I have to say, and it is my personal opinion and nothing to do with 300zx.co.uk, but I would do just that Dave. Too many c*nts on the road knocking around in fooking pikey vans, driving without due consideration to other road users. Hell, if the cheeky b@stard told me he "thought he could blag it" and I knew where he lived....:mad:

 

He drove away from the scene of an accident - that is an offence under the RTA; so hopefully the police will do the right thing and charge him. As for the cost of repair/replacing Hannah's car, whilst initially you might make the claim via her own insurers; you have the third party's details so go for everything. Replacement like for like hire car until hers is fixed (or they pay out IF it's a total loss). I doubt it will be a write-off though - but make sure you dictate where it is repaired. Hannah is the innocent party - and you always retain the right to have the car repaired at a garage of your own choice. You want a top-notch job doing - restoring the car to its pre-accident condition; so if that means a main dealer, so be it. His insurers will be paying.

 

I am sorry this happened to you/Hannah; but you have the benefit of the CCTV evidence. Julia was not so lucky a few years back - some blind/stupid/thoughtless twunt in some kind of lorry/tipper vehicle drove into her car in a pub car-park causing £1200 worth of damage. There was CCTV, supposedly, but the pub refused to hand over any evidence - I reckon the scum who did it was a regular there, or a mate of the landlord. This boils my piss Dave, so do as Si says; since you have the good fortune of catching him!!

I'm sorry, but if you're going to do something like that, that's gross misconduct, we all make errors and damage things, BUT, this is more than just a prang. He should expect to have the book thrown at him. It's not a 'simple error', it was calculated and mischievous, the guy drove off, left the scene of an accident, didn't report and then told Daffy that he thought he could get away with it! Yes you SHOULD take him to the cleaners. Daffy's wife shouldn't just be entitled to a 'fixed car'. If that car then has devalued as a result of a category section insurance job, then she should go after them for the money that they've lost, ESPECIALLY based on the circumstances, so they very much SHOULD go after them for every penny, absolutely!!!

 

I agree - hell, having previously been a responsible company official; if any of my drivers had done that, I'd have fired them on the spot for gross misconduct. Wife/family/mortgage etc would be of no concern to me - driving away from the scene of an accident after causing £££s worth of damage to someone else's property is ALWAYS unacceptable. We're all adults and we have to take responsibility for our own actions, I'm afraid. It's like the mobile salesman who gets done for drink driving, thus loses his job - sorry, no-one else forced the booze down his neck; as an adult, he took that decision and must face the consequences. It's all part of growing up - if I should totally fook up in life, it remains my own fault and I must accept it.

 

Likewise everyone else - we all must take responsibility for our actions. And the consequences of getting away with it, just breeds contempt - look at Suarez this week. That arsehole should be booted out of football; that would teach him not to bite people. But no, he gets a mere 4 month ban....:nono: Something needs to change the pathetic, apologetic culture which seems to have snuck in over recent years.

Yes the insurance companies do cover transport costs as I recover a few rta cars through insurance companies would be worth asking.

I dont reckon its bad enough to write it off ? We see all sorts in our place.

But jeezo !! To openly say that he thought he could get away with it ?

Failing to report an accident ? Leaving the scene of an accident ?

Why did he scarper ? Lunchtime drinkypoo`s ? Last night swally after the footie ? Has he done this before ?

A wee touch of punishment, car properly sorted/replaced, nobody hurt and all will be good again.

Is it possible to demand new body parts or will this be done as a matter of course? We don't want a repaired boot/bumper/diffuser etc as that is not pre accident condition. And as they have been told something doesn't feel right at the rear will they put it on a jig to check alignment? Hannah said the car felt 'funny' when she drove it the short journey home and then into work the following morning.

don't tell them it drove funny before the crash. the car may have had a crash in the past and you don't realise my mate got a 106gti when they first came out he got the car 2nd hand from a proper Peugeot dealer had the car for 1 year. then someone at a garage spotted it had been in a crash and was not even repaired properly. he got a independent guy out who did a full report the car was not safe and had to be taken of the road. there may have been some issue before the guy ran into is and this has highlighter the it.

also if it is bent don't what ever you do take the car back, been pulled back to shape on a jig it never drives the same. its not a good idea atall no matter what evenyone says

I never said it drove funny before it was hit!! Hannah drove it a short way after it was hit and said something didn't feel right. She drove it home to ours, and back to work the following morning. We only live a mile from where she works. Take the time to read posts properly.

I will to very surprised indeed if its chassis is damaged due to the low speed but deffo plenty of force to bend the rear wish bone that would upset any cars feel

as long as you get a replacement car of the same value in the same condition that's what important you can spend the next few week dwelling on what he did but that's just making it worse if you put the energy into making sure you get back and don't lose out that's whats important that's what I did I could of messed about trying to get the silly cow done for using her fone and driving into me but I felt I would put the energy onto getting my car at the time back to how is was

I am not one to milk the system; but let me inform you of my own incident back in 2008. I had only had my old black SLK a couple of months, when some knob-jockey rear ended my car whilst he was on the 'phone. To say I was livid after spending not far off £30k for a 2 year old car - was an understatement....

 

....So whilst having the car put back to its pre-accident condition was the first priority, I also did not want to suffer any major inconvenience as a result of some twunt not paying attention to his driving. Not long after the accident, I had a call from his insurer - Direct Line - they admitted liability (naturally) and offered to collect my car and deliver me a courtesy vehicle for the duration of the repair works. HOWEVER, I asked 2 vital questions - 1. where was the car being repaired; and 2. what courtesy car would they deliver......

 

.....The answers - 1. at our "recommended" repairer; and 2. a Vauxhall Astra.

 

Sorry - wrong answers!!! As far as I was concerned, a 2 year old Merc, still under warranty was going straight back to the MB main dealers for a PROPER repair (rear end damage; roof mechanism and all that). And 2. I drive a high-spec Merc - and pay the prevailing insurance premium for the privilege - and the accident was not my fault; so why should I settle for a poxy Astra (no offence to Astra drivers) whilst my car is being repaired.....? Oh, and as the accident was your driver's fault, my own insurers are happy for me to leave the car with MB (having already recovered it for me); PLUS they are delivering a car of equivalent status to my house tomorrow for the duration.....!!!

 

The next day, my insurers delivered a shiny new E350 CDi to my house - which I had for almost 3 months whilst my own car was repaired; I believe it took a while owing to how busy the MB bodyshop was - plus the time it took for all the new roof bits to arrive from Germany.... The point being, the inconvenience to me was minimised - which is how it should be for a non-fault incident; and what I meant by agreeing with Si's "take him to the cleaners" comment. I do not advocate making spurious claims for anything and everything - merely making sure Hannah suffers the minimum stress and inconvenience whilst the claim is handled!

that's seem fair Richard I think. the way si put it. made it sound like screw him for all his worth and make him lose his job the state of the uk rite now that's what we all don't need more uk people losing there job. and more immigrants coming in to replace them in the end the uk wil go pop.

that's half the issue use it properly. I would not have a rejiged car back not a chance I have seen one in action on a few bent cars thay wouldn't be aloud to re jig a car if its bent its purely about saying money money over safety I don't agree with.

The assessor called today. The car will have a new boot(and badges),bumper and diffuser at the rear. Apparently Ford bumpers come pre painted? And the front bumper will be repaired and painted, and a new grill at the front. The rear slam panel requires a 'very slight' repair according to him. Are we within our rights to ask for the car to be four wheel aligned due to impact at the rear and the force it hit the high kerb at the front? Also I'm worried about the paint match. Existing paint, pre painted rear bumper and repainted boot and front bumper is a bit of a miss mash! Colour is Ford panther black.
