Evening guys. Cut a long story short, someone in a transit van has reversed into my girlfriend's parked car. They were either drunk or didn't check their mirrors as they shunted it a good couple of feet. We have the evidence on CCTV.

They were in a sign written van and contact has been made. The driver has admitted it and says he 'thought I could blag it and get away with it as no one saw me'. As you can imagine I am fookin' fuming!!

 

I have told my missus to go to the police with the video and to go through the correct insurance procedure.

 

My question is with regards to the insurance claim devaluing her car. It is an immaculate 09 plate Fiesta zetecS with low miles and FFSH. Current values are circa 7.5k but cat d ones are 4.5/5k. Is it possible to chase his insurance for the diminished value??

 

Thanks for any advice.

I believe it would potentially be an offence for the van driver to have left the scene and not giving details.

 

In regards to the claim amount, I'm guessing the car is going to be a total W/O? Has that been agreed yet? Also have the insurers actually made you a settlement offer?

It only happened a couple of hours ago. The police have asked for the video evidence and said they will charge him.

 

Going to take the car to Ford tomorrow for an appraisal. Told my girlfriend to call her insurance company in the morning. Not sure if it'll be a write off? The car was parked but moved a good couple of feet. Looks like the van was trying to park in the space her car was in, reversing quite quickly and didn't apply his brakes at all until after he hit it. Car was parked nose facing a kerb and the front bumper mounted and scraped it. Boot obviously has a huge dent in.

Been out and had a quick look earlier. Boot is caved in, rear bumper is heavily damaged and the 'diffuser' has a gouge out of it. Base of the front bumper/splitter is all scraped, looks like there might be a slight crease in the front wing. This is just taking a quick glance as we were both of to work.

 

I am so annoyed. More at the fact that somebody could knowingly do this and try and ' blag it' because he didn't think anyone had seen it. Accidents happen, but what is up with some people?!

I had a nice Honda prelude 2.2 vtec years ago was in top notch condition I went all the was to Scotland to buy it after looking for one for ages anyhow some silly cow talking on the fone drove into me she said it was here fault her insurance fixed it up and droped the car back to me they had sprayed the front wing replaced the head light and sprayed the wheel the issue was you could now see it had a brand new head light on one side the new wheel and sprayed wing it made the car look crap I had to battle them for 4 months to get them to change the head light to a new one to match got them to spray all 4 wheels so they matched but you could still tell the front wing was sprayed. now when you look at it you was just driving along some daft cow crashes into you and you end up with a car that's now worth less money when you sell it its not rite atall that you lose out in the end and it was not your fault. the moral of the story is fight to very last and don't just take the car back with the rear end fixed and half the car sprayed and blended in like is what will happened don't just give up they make it hard so you just give up but don't !!!

insurance companies are all con men

Often the insurer / their engineer will look to determine the per accident condition of the car and that'd be taken in to account before they make the offer. Generally speaking, the whole point in insurance is to put you back in the same financial position you were in prior to the loss (minus you excess if you were at fault/partially at fault).

They're just a business like everyone else. The problem comes because everyone inflates their losses as much as they can which means the industry is getting tighter and tighter sadly. Theres also a rediculous amount of fraud around now which makes everything worse. Heightened premiums, insurers naturally needing to investigate things more thoroughly etc.

 

I remember when I first started working in insurance, things were pretty good and now, it's really demanding.

we pay far to much if people they blame whip lash clames if that's the case thay should drive up the insurance of people who claim whip lash not the people who don't its not rite atall

It's a marquee company. They use the restaurant/bar at the hotel where Hannah is a manager regularly. I'm pretty sure the driver lives just up the road. Phoned the insurance company and they need the registration. Hannah is calling the boss now. I've told her to take notes of all the conversations she has.

I've got a feeling they might play up as the guy driving called last night asking not to go through the insurance. He's probably stupid enough to think it'll only cost a few hundred pounds to put right!

I am getting more and more wound up as the day goes on :thumbdown:

I agree 100% his insurer shop pay for the car to be fixed that's a must. but the guy should not be told to leave that could set off a chain of events ie the company could get pissed and sack him he could have a wife and kids to keep and be struggling to get by so other would suffer for his stupid driving that's not rite nor should you take him the cleaner that's just greed!. all you want is the car fix or replaced to how it once was that's fair and the way it should be

I'm sorry, but if you're going to do something like that, that's gross misconduct, we all make errors and damage things, BUT, this is more than just a prang. He should expect to have the book thrown at him. It's not a 'simple error', it was calculated and mischievous, the guy drove off, left the scene of an accident, didn't report and then told Daffy that he thought he could get away with it! Yes you SHOULD take him to the cleaners. Daffy's wife shouldn't just be entitled to a 'fixed car'. If that car then has devalued as a result of a category section insurance job, then she should go after them for the money that they've lost, ESPECIALLY based on the circumstances, so they very much SHOULD go after them for every penny, absolutely!!!

...I am not talking about claiming for stuff that they shouldn't like personal injury etc. Stuff they're absolutely entitled to, like devaluation of vehicle etc.

I understand what you are saying si and I do agree to a point but the best out come for daffy would be to get the car replaced the problem with every one claiming for more than a replacement car is going to turn us like the us every one suing every one else it just back fires on all us ion the long run with driving are insurance up. so I feel a replacement car would be ample here and that's the end off if. yes the van driver was plonker but . but he if get the car replaced no one was hurt and that should be plenty

The car once fixed would only be devalued if it's a cat c or d which means its written off and the insurance would payout a fair market value which if you don't agree with you can appeal the claim.

Hell no! If someone hit my car, drove off from the scene of an accident and did what this guy did, I'd be pressing charges. That's stuff you just don't do! It's a criminal offense!

You won't need to press charges though the police will do that anyway. Leaving the scene of an accident and also not informing the police of an accident within 24 hours is chargeable.

Anything up to 6 points for each depending on intent and seriousness of accident

all what wil happen there is the guy will get nicked and charged at the station and get a very small fine it will cost grands in police time witch we are all paying for in taxes see this is what I was saying we all lose out in the long run. if he get the car replaced for one of the same valve and condition that should be fine

I/we are not after anything more than what we are owed. I.e. An immaculate 09 plate Fiesta zetecS worth circa 7.5k. That car to my missus is like your Zeds' to you. She loves it, and worked and saved hard to buy it outright.

He has been reported to the Police, and rightly so. Anyone that thinks differently is the same type of guy as the driver.

 

The trouble is the car is now 'tainted' if you get what I mean. Even if it is repaired to pre accident condition. Really feel for her and like I said earlier it's not so much the accident, it is the subsequent behaviour of the guilty party.

as long as you get a replacement car of the same value in the same condition that's what important you can spend the next few week dwelling on what he did but that's just making it worse if you put the energy into making sure you get back and don't lose out that's whats important that's what I did I could of messed about trying to get the silly cow done for using her fone and driving into me but I felt I would put the energy onto getting my car at the time back to how is was
