Hi guys,can I pick your brains. Got ran up the back of my daily drive,my vectra c. It didnt do too much damage, crumpled the bumper around the reg plate a bit. Stupidly agreed to bypass the insurance and didnt report the accident to the police. Got a quote of £570 which he thought was too much so got a second and it was £9 cheaper. I know he is trying to get out of paying but where do i stand legally? I havnt tried my insurance company yet(AXA) but it is now 7 weeks since it happened. I know where he works and have his reg no. but he wont give me his home address or insurance company. Am I screwed???

you only need his reg if you're going to report it to your insurance now, they will be able to get his insurance details straight away from that. Just got to hope he's insured.

The thing is mate if the other guy has reported it to the Police and you haven't (for all the right reasons) you could get royally screwed for not reporting it as an accident.

 

A friend of mine, Gaz, got whacked with 6 points and a £1000 fine last year for clipping the wing mirror of an old dears car as they drove past each other on the country lane just outside the entrance to their cul de sac. He pulled over a couple of hundred yards up the road to check for damage (just a minor scuff on his wing mirror) he could see that she hadn't pulled over so thought nothing more of it. As it turned out a friendly 'neighbour' stopped the old dear and gave Gaz's details, subsequently the old dear reported it as an accident and claimed that the other driver hadn't stopped (which technically in the eyes of the law he hadn't as he was a few hundred yards further up the road).

Like I said, he got screwed big time, so just be careful mate especially if this other guy knows that you didn't report it.

just tell your insurance company that the little prang you tried to sort out to stop getting stung next year. but the bloke now not playing ball, before you do that give the bloke one more chance to settle buy way of cleared chque by 7 days, drop a polite letter of at his work in a sealed envelope with the quote in. saying with ref to damaged caused on said day date by his reg no and please settle within 7 days or yourll have no option to go through your insurance. dont change any accident dates or nothing. if his got insurance then sorted. if he ant them hell pay up. and if he ant them hell be getting a visit from hawaii five o. what ever you do in the letter dont incriminate yourself by slatting him just be factful and keep a copy and dates what you do. me thinks, well thats what i would do.

He has broken the law there mate - after an RTC you have to exchange names and addresses; the road traffic act says you must pass such information onto any party with a legitimate right to have it. You do not have to provide your insurance details; although it can look bad for you if you refuse any reasonable request.

 

As Vijay says, you have his reg number so your insurers can trace him through the MID. And he drove into you remember, so it is most likely all insurance companies involved will find in your favour - make sure you mention the unofficial agreement you had wherein he agreed to cover the damage too.

 

And don't worry about not reporting it to the police. Whilst the law says accidents must be reported within 24 hours, you have exchanged (albeit incomplete) details with each other and no-one was injured. Truth is, had you called the police at the time, because no-one was injured and you could both drive away safely afterwards; they would not have been interested and most certainly would not have bothered to attend the scene. In Jap Slapper's mate's case, he drove away from the scene remember - that is the crime there......

Iv been to see him countless times, he always had an excuse thats why it now 7 weeks later. Today he offered me £450 then upped it to £500 as I wouldn't budge on the quote. After ringing my cousin, who is a DI in the plod,he suggested I take the money and take the hit. I went back to get it sorted and said he would get a cheque for me tomorrow. I aint holding my breath as he wouldn't take my address, he said he phone to meet up!!! This guy own's his own resteraunt and I'v found out he has been bust before a few times.

 

There is no way this guy has been to the police to report this jap.slapper,I'm not worried about that.
