Following from the neighbours thread the other day.

 

I've recently bought a house that is semi detached, next door the other way is a bungalow, complicated ownership/living arrangement but basically the parents of the girl do all the work on it.

 

Now between our two drives there was an 18" high wall that ran about half of the way along and just stopped and it appears to be on my drive so thought well its mine, I want rid as it restricts my drive bingo. So I figured Id be doing everyone a favour if we just got rid of it, meaning it was easy and safer to drive down and it didnt look as silly.

 

I explained my plans to which my horror they stated they wanted a 6 foot high fence down the middle of the drives! Just totally stupid in my opinion. Anyway, a friend and I removed the wall yesterday (more on that later) and now they are on with putting this massive fence up which is going to not only restrict my drive (by the looks of the string they appear to have put up and it looks like a foot into my drive) but the light into my kitchen as it looks out over the drive!

 

The wall was a slight problem though, it started of sat on top of the concrete slabs my drive is made of and a few feet in it dropped into a gap "between" the drives, even though it was built on my side of the gate post at the road end.

 

I was hoping that they would be sensible and realise its much better without and just get it all tarmacced between us and make it look nice. Now its going to be my old cracked concrete slabs and some awful crazy paving on their side.

 

Not really sure what to do now!

Chris do the 6ft fence and be happy you cant see them mate...I love neighbers so much i live in a detached bungalow and still spent 30k building a 6-7ft wall right around my plot.

A lot of drives are built about the size of a standard car parking space, and this area will be on your deeds as yours, with there being just enough room to slide out of your car with the door slightly ajar.

Most land at the side of your drive will either be next doors drive or a flag side path, this will enable your car doors to fully open and is a reasonable and acceptable way of putting houses close together as it suits both parties.

Doubt very much that a 6 foot fence will be allowed making it practically impossible for you and them to get out of your car, along with the other issues you have raised, you need to consult your local council to clarify.

I just dont understand why they want to seperate the drives! Seems stupid! Their argument is that they want to stop their kid (6 months id say) but they have a yard, twice the size of my garden, a front garden and a path down the other side of the house, so surely no need for them to play on the drive! Just madness.

 

The gap I was meaning, is 9" or so, which was the width of the wall.

a lot of people like the open aspect like it seems you do mate but other people like a defined boundry like myself so atm ime on the "fence" with this one..can you not give yourself more room on the other side of your drive??

hmm just had another look at it as they have actually gone now. I have realised that they cant start knocking holes in my drive, then I can certainly kick up a fuss. So far they are taking up a flag of their crazy paving and digging a hole. Not ideal but I suppose I cant really stop em doing that. What I dont want to happen is for it to stop me getting a car down the drive. As I searched high and low for a house with a long drive and a garage just for that reason!

 

The string they have put up they are not sticking to at the moment so I shall watch, as long as it doesnt affect my drive material then I suppose its not to bad.

The problem is the otherside of the drive is the house. Not a brilliant picture but its the only one I have of the front of the house atm.

Try and seek an amicable solution - as its difficult to rectify if things turn sour..

 

But as mentioned above, your deeds will state where the boundary is. Providing they are on their land, they are well within their rights to stick up a fence 6ft high. Even if it is a stupid idea.

 

Photos would help, tell them you're just taking a few pictures to send to your solicitors.. They'll probably think twice about robbing any of your drive then.

 

Edit: just seen the pic... probably best if you buy a shotgun and get it over with quickly, a 6ft fence will fook things right up.

Seriously, it's exactly as I stated above, a fence will close it up ridiculously, what about the rest of the houses on your street?

looking at that I don't think you have a choice unless it's a shared drive (which it doesn't look like it is). Is there anything in the deeds about convenant rights of access?

 

Have you measure between the houses to find the boundary line?

 

What are the other houses around like?

Check on your deeds or homebuyers questionnaire who actually owns the boundary and is responsible for it's upkeep. If it's shared then surely they can't force you to live with something you really don't want? Also there's nothing worse than long term rows with your neighbours so let them know how strongly you feel rather than sitting there seething. Ideally before the fence actually goes up!!

if your gonna do owt about it, then do it now before it's built, you wont have a hope in hell of getting it removed once done

I wouldn't know the legal standings, but I don't think there is a lot you can do if its on their side TBH.

You have gained the wall width (if the fence is on their side as it has to be), and it looks like you have a full garage width all the way up ?

 

If its any help:

Ours has a neighbours house wall running into a 6ft brick wall one one side, and our house on the other, which actually would block one side of the garage partially if it went all the way back. Luckily it doesn't, and I have room to open the driver door fully on the drive if I back up to the right spot + or - 2 inches (due to a patio wall) !

At the narrowest point its about 7.5 ft so if you have that or better you should be OK to get the car up and I have 10ft between the corner of the house and the garage, were the space widens to 9 ft 4" at which point I can open the drivers door fully.

Of course working on the passenger side is not possible !
