a week ago - along with additional £40 to get air con regassed. This is the issues thus far:

 

1. Car test driven 27/06/11. £200 deposit taken to hold car. Climate control not working – agreed to pay £40 in addition to £1000 asking price to pay for air conditioning to be re-gassed.

 

2. Purchased 30/06/2011. On date of purchase air conditioning was still not functioning. Was advised by Darren that the air conditioning condenser needed replacing and that the garage would order the part and resolve this issue at no extra cost.

 

3. On date of purchase, after app. 5 miles of driving, oil warning light came on the dash and warning alarm sounded. We immediately returned the car to the dealer to ask them to resolve the problem. Darren test drove the car and then topped the car up with some oil. He said his colleague should have done this before the car was handed over. He did not have enough oil for the car and that we should go to buy some. When we asked whether this was appropriate given that we had just purchased the car, and suggested that in fact, it was the dealer’s responsibility to ensure the car was in a fit state to be taken away, he was rather rude and swore at us. After some discussion we took the car away without enough oil in it. At this time, the engine management light came on the dashboard, and we had to immediately return the car back to the garage. At this point Darren got back in the car and drove it away. He was gone for over 20 minutes. We were unaware of what was happening at this point. When he did return, it was in a different car, and our car was nowhere to be seen. He told us not to worry and that he had taken our car into a garage for a repair. At this point we had no means of transport to get home and collect our daughter from childcare. Darren then went to see someone who gave us a lift home.

 

4. On the afternoon of 01/07/11 we had a call to say the car was repaired and was “running perfectly”, and would be safe to drive to Staffordshire.

 

5. On 02/07/11 we drove to Staffordshire. The car developed the oil light problem and warning alarm on the journey there, and was problematic intermittently over the course of the weekend. I advised Darren at the dealership via text message on 03/07/11.

 

6. On 04/07/11 we received a text from Darren to say we could take the car back on 06/07/11 for further investigation

 

7. On 05/07/11 the car’s engine became much noisier and the warning light and alarm also came on again. Darren and his colleague agreed to collect the car for repair. I asked them to keep me informed as to what was happening.

 

8. On 06/07/11 Darren’s colleague arrived at our house with the car. He said that they had not found any fault with the car and no further repairs had been carried out. He did not mention at this point when the climate control on the car would be fixed. However on driving the car, the oil light and warning alarm fault is still apparent, intermittently.

9. On 07/07/11 the car’s engine is sounding “rough” and the oil light and warning alarm are still present. I have text and called the garage to advise them of this but have not had a response as yet. We have owned the car for a week and so far have been without the car for half of this time, and on the days when we have had the car, it has been driven with a fault. Are we within our rights to request a refund? We feel we have given adequate opportunity for the car’s faults to be rectified.

This is without mentioning the time I've had to take off work to drop the car off, be home for them to collect it, as well as not having a working car for the week of ownership.

Oh and it DOESN'T have full main dealer, it hasn't been serviced in almost 3 years - my bad for not thoroughly checking everything fully

Oh and tonight I went to take the car to Tesco, could not get it in reverse. It crunched and crunched but would not get in - so another major fault. At this rate I'm never ever buying another car

Really sorry to read about all those problems. Sounds like that engine is about to seize!!. Have you noticed any oil leaks at all? Not a good sign either if you cant get it in reverse, could be a gear selector? Only guessing there mind you.

 

You certainly do have rights! I would ask for a refund as the car is clearly not 'adequate' for driving, let alone running 'perfect'. If you do get hassles, you can contact Citizens Advice or Trading Standards!

thats a shame Jan sound like the oil pump could possibly be failing and soon to be on its way out

 

As for the gear not going into the reverse could be the clutch fluid could need changing and bled or adjusted??

 

did you not get a 3 months warrenty from them??

 

I would get my money back if you can. i bought my 1st gsi changed the oil and a week later the oil pump went. mine was a private sale so i just broke mine for parts.

pick me up, take me to garage with car. ill get ya cash back.

"couldnt find a fault" even with oil warning light and buzzer going haywire? yeah sure. Sounds more like he drove it around the corner and parked it up for 20mins while he went for a mcdonalds in his new car.

Thanks all, no warrantee as such but having looked at Trading Standards advice online, and given the car has had issues from the day we bought it, I think we should get our money back. Just not looking forward to it, its like bloody Phil and Grant Mitchell who run the place - when Marc suggested that just perhaps the car should have been sold fir for purpose, ie with the right amount and type of oil in it, the bloke got really abusive, told us that it was b0locks and bullsh1t. Had to get Marc in the car in the end to stop him squaring up to him - hence me taking the car off with the oil light on and then the engine management light coming on. Sod it I'm crying again. Its all so horrible, like having to go into the lions' den tomorrow.

Bloody cars.

Sounds like the car is not fit for purpose and therefore you should be entilted to a full refund.

I would call consumer direct on Monday - http://www.direct.gov.uk/en/Governmentcitizensandrights/Consumerrights/index.htm and find out exactly where you stand legally.

 

I agree with what's been said, I'd be aiming for a full refund as it's not fit for purpose!

Thanks Stu - I'll try the "please can I have my money back" approach to start with but feel sure I'm gonna get told to go forth and multiply. So plan B will most definitely be to make a pain in the arse of myself, and I'll make sure I go down with the number of the Evening Gazette and TFM radio number in my phone so if I get no joy, I'll call the local media. Apparently this business has been established for years - so they won't want a ruined reputation. Hopefully it won't come to that though,and I hope they will be reasonable, eventually. If I can't get the bloody thing off the drive tho I'm fooked!

they will basically tell you to fook off, and say the car was sold as seen, you have drven the car away on numerous occasion's and they will say you caused the problem's

 

this is in no way right, but do you really think that the law will help you (doubt it because it protects the criminals, bast4rds)

 

if you think mark is upto it then let him take it back and belt the fooker's, i would have took the loss and rammed it into the whole fookin forecourt and had a nasty big bat and an horrible fooker to back me up

 

i reckon it will cost you more to take it to court and they know that

 

you have had some nice motor's, hang onto the one's that treat you well

Don't forget the trade descriptions act and I quote

1.Products must be sold as described.(full main dealer service)

2.Products must be of satisfactory quality.

3.products must be fit for purpose as described.

 

The act makes it a criminal offence to

1. make false statements or comments (full main dealer service)

2. recklessly make a statement which is false or misleading (again full main dealer service)

 

You could also throw in that if you decide to pursue it thru the courts a magistates court could impose a maximum fine of £5000

I would print off a copy of their ebay advert and tell them this will be your case for false and misleading statements

Just as a side comment this is not the first time they have tried to sell a vehicle which is not as described if you check their feedback they tried it b4 on the 20/2/2011 but the buyer refused it.

Anyways Jane - back to the plot. Warranty/sold as seen aside; as a dealer the supplier is obliged by law to ensure that what he sells is fit for purpose. You have given the dealer more than a reasonable opportunity to put it right and he has failed.

 

I'd say that you are now entitled to your money back. It's not like you have had the car for a year and it's suddenly developed a fault. You've had it a week and the problems were there from day one; plus you have the advert which claims full history etc - it clearly was mis-described as well.

Not exactly a Mikey Bean? I'm not sure if you're thinking he's huge or tiny, either way, I've seen the man with a torque wrench, and it's something to be very afraid of if you're not a car! :D
