Was rather pleased with myself last night, finally found myself a really nice ZX N/A to use as a daily driver alongside the TT.

Bid fair and square and got a good bairgain.. happy days.

E mailed the guy imediately after the auction to ask how he would like payment and when I could collect.

Came home from work today to find an E mail saying as stated the car was advertised elsewhere and he had taken a better offer on the car, and adding "better luck next time"

 

What a complete R sole.

 

Negative feedback and a complaint to E bay on its way right now.

That seriously sucks!

He has the cheek to say "Please note that bidding on this car with the intent of not buying will not be tolerated." in the ad...if he has no intention of selling it to the winner then he shouldn't have it advertised!

 

I notice he didn't put on the bit about reserving the right to withdraw the car (which he didn't he let it run the duration!) on the ad until his update on On 22-Mar-10 at 12:26:24 GMT, did you bid before this update? Not that the statement really counts since he didn't withdraw it.

 

Show up at his door with the money in your hand and call him out :2guns: :biggrin:

oh I really feel like that at the mo... to say I am annoyed would be an understatement.

gutted matey :( you would have got it for a bargain though!

i thought ebay said at one point that you couldn't withdraw the sale "as its advertised else where" unless it was a classified add? and that the contract was legally binding due to the auction running its cause, I'm pretty sure that would even stand up in a court of law? as it even states when bidding its a legally binding contract, has anyone even taken someone to court over something like this? would be interesting to see what the outcome was.

 

I know that there were a few cases in the US about false advertising, but I've never seen one where the person one the auction and the seller refused to hand over what was rightfully won.

 

Sounds to me like the dude selling didn't like the low selling price and came up with BS as to why hes not handing the car over.

Not always later! some NA's have them, my TT slicktop has it as well. Convertibles all have the manual climate control. Digital climate control was an option on some cars. I _THINK_ LWB TT's were standard with it throughout though!

it was 100% on 3 but I just neg feedbacked him and reported him to e bay.

Sadly when reading the terms and conditions it seems e bay buyer protection does not apply to e bay motors... something to think about next time any of you are on there.

For all who shop on e bay I have sent he following message after no response to my previous mail that stated that I was unhappy about him withdrawing the car from sale.

You have advertised without a reserve to save money on fees and when you did not get the price you expected you decided not to sell.

Withdrawing an ad before the end of auction is fine when stated but withdrawing it when the buyer has bid and won and then sold items cheaply himself to fund the purchace is against e bay rules and quite frankly dishonest.

I would be interested to know just when you agreed a sale on the car and to who you have decided to sell it to as you may well be in a legal contract to sell it via the public auction that you allowed to run its course.

A proper answer from you would be very interesting if you are able to be truthful.
