Hello... i'll try make this short - I got a few questions... I was driving on my birthday (last week) and I decided I would go to the gym instead of the pub (wish i went to the pub now!) Anyway on the way home i was involved in an accident...

 

I was hit by a stolen motorbike which was traveling in the WRONG direction down a dual carriageway with no lights on in the dark. The rider decided not to wear a helmet and is now in critical condition, the passenger ( aged 14) was wearing a helmet who suffered minor injuries.

 

OK so basically, I spent my birthday in the police station giving a statement and doing breath/drug/fit tests. Anyways, the next day I call my insurance... I am not entitled to a courtesy car apparently until my car is being repaired by an approved garage (so now i have no car) :no: the police have my car and wont release it till they have done the tests they wanna do.

 

also my insurance want me to pay my excess of £350 ! Its not even my flipping fault.... So I dont have my car coz of the uninsured theif, also i cant get a courtesy car either, i spoke to an accident management company regarding a hire car but they said as the driver wasn't insured they wont risk giving me a car as they probably wont recoup the costs! So I seem to be losing in every situation??!

 

My question(s); Is there anything I can do while the police have my car?? I know once they release it to the insurance I will get a courtesy car but until them I am really stuck?? The police wont even release items in the car yet, so my mates wallet is stuck in there along with my gym bag and loads of other stuff I really need on day to day basis like my ipod!

hope it gets sorted out. the insurance ombudsman will pay out and you will get a courtesy car. put it this way i was hit by an uninsured driver to which i had a courtesy car for 6 weeks!!! while the body shop tried to source me a bumper!

Our lasses car was hit by uninsured driver we had a hire car for 10 months:cursing: while they argued it out, all for a £1500 Celica

10 month later I got a cheque for £1100 and they got a bill for £25,000

for the hire car. Its a fooked up world:pinch:

But I'm glad you're OK though. As for the insurance - as soon as you can get the car to their recommended repairer then you will get a courtesy car. It's usually provided FOC by the garage so really it's nothing to do with the insurer.

 

Secondly, if you were hit by an uninsured driver, get straight onto the Motor Insurance Bureau. They have an unofficial "fund" for helping out motorists in this situation.

 

Back in my teens I was forced off the road by an uninsured/untracable driver and I only had 3rd party cover. My insurers couldn't help me; however because I had a couple of witnesses who were able to corroborate my story, the insurance company put me onto the MIB. Long story short, I didn't lose out in the end. But it did take some time though.....

Wifes car got hit by uninsured driver woman driver last year, gave a false name and address, no tax license or insurance, anyway we found out were she lived and gave the details to the police, got a letter the other day to say that they could not find her and were no longer pursuing the case. The bitch only lives up the road from us and is known to the police from her drug habit, f**king useless coppers. Insurance company are still trying to get the wifes £250 excess back. Good luck with getting sorted Jazzy.

Thanks for all the replies guys, yeah i'm fine actually, completely injury free, i was shocked but I think finally I kinda ok now. The damage to my car wasn't all that major to be honest.

 

Ok so i got more questions... So this MIB - do I contact them direct ? Would they fund a hire car for me? Only reason I ask is not including normal daily tasks I do take my mum to hospital once every 4-6 weeks to Manchester hospital (next week) which is about 100 mile round trip, I really dont want her to go by train and to be honest I dont have any1 else who can take her, apart from maybe a taxi :( more expense!

I'd have the discussion with your own insurers first; if you have no joy then look up the MIB on the 'net and contact them directly.

your insurer should contact the mib to claim back the funds , you i shouldnt have to do anything as it was not your fault

See when you say that the insurance company want you to contact the police, the police will just tell you to get the insurance company to do it. Mine tried to do the exact same thing. Something to do with the insurance company having to pay to get info from the police so they ask the claimant to do it.

Thats shocking! It's almost as though the newpaper want everyone to pity the rider.

the MIB(motor insurers bureau) u have to contact them..they have a web site with a form u fill out u will need the police reff number & all the info from the accident date, time,reg numbers etc..they will pay out but take £400 out of it!!!

Sorry to hear Jazzy mate, hope you are ok, i hope the thieves can never steal again with there injures. Also try going through that Injury lawyers for you.

In my opinion the police have had ample time to examine your car. i cannot think of any excuse for retaining any of your personal property and you should go to either them or the garage and demand to have it returned (your property) don't forget that if your car is on police premises they will be charging you for removal and storage by the day and if it's on garage premises they will probably do the same so you will have to pay them to get it back. Odds are your insurance company won't pay this fee so keep on top of them, it's around £100 per day in some places.

i 2nd richard...goto MIB...that or sue the driver in the county court if he's under age/kid then dont bother....good luck

we pay all this insurance per year,,,yet when ever your involved in accident they take forever to sort out......years ago a bloke ran into me,,,was lookin for a house,not watching where he was going and wacked my rear bumper,,,he admitted everything,claimed it was his fault,yet it still took months to sort out....think how much we've spent on insurance in our lifetime,,,bloody thousands.....
