my runaround has just been hit im not sure whos at fault, but as far as im concerned i was stationary and was hit.

 

i parked my car outside my friends house who only lives up the road. i was facing the oncomming traffic. i parked opposite his driveway about 2 metres behind another parked car.

 

i had to pick up 2 of my friends, they both came around and opened the door, as my car is a 2 door coupe, on of them had to sit at the back, so he pushed the fornt seat forward to get in the back, my other friend then pushed that seat back and sat inside as soon as he was closing the door a driver hit my car door pretty bad.

 

my door is scratched but no dents. the window shattered and hit my friend who was sitting at the back, luckily he was only slightly cut from the glass.

 

the driver was going quite fast and finally stopped about 15 metres after.

 

this was at 20:30, he said as my lights were on he and couldnt see my friend getting in. now there is no blind corner.

 

he said whilst my second friend was getting in i should have switched off the lights.

 

i called my insurance company who advised i go to a local bodyshop to get a quote. when i told the guy at the bodyshop he advised i go through kindertons direct and kindly phoned them for me, i spoke to them and they said they want the details of the third party and will call me when i get home.

 

has anyone dealt with this company? they are prepared to give me a hire car.

 

 

im third party so have to wait untill we find out the outcome which could mean i have to drive my main car everywhere.

 

should i go ahead with kindertons or wait till my insurance company gets a verdict.

 

i know mike groves here has dealt with kindertons.

 

help appreciated.

If you were stationary its not your fault, its also in the highway code that you should leave about 3-4 feet or a doors width when passing parked cars.

cheers guys, but the doors were opened quite a while before the car came, atleast about 20 seconds as you have to adjust the front seat before you get in.not sure if this helps?

of the door was open into the highway its your fault. You need to make sure it is clear to do so. Sorry fella

 

I disagree, its obvious it was clear as one person has managed to get in the back and then the other passenger in the front then the car was hit.

yes thats what happened.

you will fail your driving test for driving to close to aprked cars, incase someone opens a door, it works the other way aswell, you are supposed to leave a big enough gap.

I'd report it to the police to keep yourself right and get the incident number, i'd be very surprised if they tried to blame you as you were stationary for quite a considerable time.

No really, if the door is opend onto a car or left open and is hit by a car the stationary car with its open door is at fault.

Well i spun my car several times took of over an embankment (still spinning) and came to a stop in the fast lane of the M8 facing the wrong way, all because i was driving too fast, i even said it was my fault at the time of the accident but because 3 cars passed me and i was hit by the fourth it was deemed the other drivers fault because she should have avoided the stationary vehicle as the other had.

Will be interesting to hear the outcome.

A stationary car and a door open into the road are two wholely different things though.

 

If he had hit his car then yes its his fault, but the key to this is he hit the door that was left open into the road away from the body of the car. Also as there were people getting in they should have closed the door to alow the car to pass.

So what if he hit an elderly/disabled person who was getting in the car (slow mobility) would that be their fault also even though there was no traffic when they started to get in?

It's your insurance company's job to sort this out. If it's deemed to be your fault, how the hell is this Kindertons gonna screw any money out of the other side?

I do sympathise- however it really does irritate me when people pull up on the wrong side of the road and leave their lights on and continue to blind traffic.

 

For some reason it does not occur to them to just leave side lights on and that their dipped beams will dazzle oncoming traffic- police told me at one time that vehicle should face away from traffic when parked so reflectors indicated vehicle position.

i agree with dave if a car is parked facing oncoming traffic it should have side lights only on as dipped beam is very confusing for drivers coming up to it and if there is another car coming towards you it makes it very hard to thread your car through the space left and two sets of dipped beams glaring at you plus if you have a door open the oncoming driver will find it very hard to see it.

Anyway, back to the question LOL.
